Update: SC threatens Jake Macasaet with contempt over bribery report

Last week, Malaya publisher Jake Macasaet ran a series of items in his column “Business Circuit” about Cecilia Muñoz Delis, a member of the staff of Justice Consuelo Ynares-Santiago, who got a surprise of her life when she opened a box intended for her boss and found P10 million. Macasaet never mentioned the name of the Supreme Court justice. Newsbreak and TV Patrol, in their stories today, identified the lady justice as Consuelo Ynares-Santiago.


TV Patrol said Santiago herself asked the high court in its en banc meeting tomorrow to take up the alleged payoff.

The story is that, the gift-wrapped boxes, the size that can contain of two dozen milk cans were delivered for the jusrice last March at different dates. Delis would pick up the box at the guard house and give it to the justice.

The day the fifth box arrived, the justice was absent. Thinking that the contents were perishable, she opened it and lo and behold, she saw wads of money.

She informed the justice about it. Soon after she was fired.

Newsbreak and TV Patrol reported that Delis executed an affidavit saying “I had nothing to do with, nor did I have any knowledge of such alleged attempted bribery,” Delis said.”

Macasaet said “I learned from some lawyers that the bribe money given to a lady justice came from a Chinese-Filipino businessman who has been criminally charged.

“It is funny that the delivery of five boxes of money coincided on the day the lady justice, obviously acting as ponente, acquitted the prospect.”

Supreme Court Spokesman Midas Marquez confirmed that Ynares-Santiago terminated Delis in March. He said that Delis was found out to have used the office telephone to make overseas calls, particularly to Japan. Ynares-Santiago supposedly discovered this about October last year and gave Delis until December to look for a job. However, Marquez said, Delis asked for more time thus she stayed on till March this year.

Delis, however said she voluntarily resigned.

High Court takes up reports linking member to payoff

The Supreme Court will tackle in its en banc session today reports that Associate Justice Consuelo Ynares-Santiago accepted a payoff, an allegation that the magistrate categorically denied.

The report first came out in the column last week of Malaya publisher Jake Macasaet that an unnamed lady justice at the high court allegedly fired her secretary in March after the latter mistakenly opened one of five gift boxes of money amounting to P10 million delivered to the magistrate, thinking that it contained some perishables like food.

Newsbreak yesterday named Santiago and the secretary as Daisy Cecilia Munoz-Delis. It said the alleged payoff may have to do with two cases which Santiago penned: the dismissal of the criminal case against Henry Go, former chair and president of the Philippine International Air Terminals Corp. (Piatco); and the Maysilo land dispute case.

Court sources have said Chief Justice Reynato Puno was compelled to include the report in today’s agenda upon the urging of four other lady justices in a bid to clear their names.

In a statement, Santiago said the reports that came out were “blatant lies clearly aimed at smearing and maligning my character and person, and the integrity of the judiciary, which I have been faithfully serving for 34 years now.”

“I highly suspect that these are parts of concerted attempts to influence the high court in deciding a big land dispute in Quezon City now pending before the SC. Nevertheless, I leave the determination of these to the investigation I have requested. I also reserve my right to file the appropriate criminal charges against those responsible for these malicious accusations,” she said.

SC spokesman Jose Midas Marquez said the reports were “disturbing” and “damaging the court’s relentless efforts to cleanse the judiciary.”

Marquez said Santiago felt she was the one being alluded to in the reports because she was the only lady justice who has had a secretary named “Cecilia,” so she had asked that an investigation be conducted.

“We don’t know how the en banc will react but everything will have to be taken into consideration. This is definitely very harming as it appeared in a national newspaper. This is bringing the entire SC down, which is not very good,” he said.

Marquez said the story was “unbelievable because a supposed bribe giver would not likely leave P10 million in the guard house to be picked up by a court staff.”

He said that Delis even went to see Santiago yesterday afternoon to personally belie the allegations.

The court spokesman did not say if Delis was forced to resign, but he said Delis had problems with her employment after she incurred huge telephone bills for overseas calls that she supposedly made during her employment.

Delis, a judicial staff officer of the Presidential Electoral Tribunal detailed at the office of Santiago and a niece of the late Associate Justice Cecilia Munoz-Palma, has issued an affidavit denying that she was fired for opening the gift. She said she voluntarily resigned from her post last March 15.

Delis said she felt she was the one being referred to in the articles because she is the only niece of Palma with the same first name to have worked at the SC with a lady justice as final employer.

She said she has written a letter to Macasaet dated September 21 attesting she was not fired from her job but voluntarily submitted her resignation. She did not specify in her affidavit her reason for resigning.

She said she executed the affidavit to allow Santiago to defend her honor before she was actually named in the articles of Macasaet, which appeared in Malaya from September 18 to 21.

“I had nothing to do with it, nor did I have any knowledge of such alleged attempted bribery,” she said.

In her letter to Macasaet, Delis said if the bribery attempt was made last week when Santiago did not report for work, she could not have witnessed it as she had already resigned.

Delis added that as a matter of procedure, she would not have been tasked to receive the boxes as it was the job assigned to their male utility personnel.

“It is highly unlikely for something as blatant as that bribery attempt to have been done right in the front doors or the Court, with its increased security and teeming with people – both employees and the general public. In other words, the scenario you painted and continue to print is improbable and could only have emanated from a polluted source, who unfortunately, chose me to be part of this fictional charge,” she said.

    OMG, if this is true, shame on Associate Justice Consuelo Ynares-Santiago. I’m looking up to her pa naman as one of the better SC justices…I’m soooo disappointed!

Frankly, this almost didn’t come as a surprise after what I’ve been hearing these past so many years, rumours i.e., Lucio Tan bribed his way to the SC because bribing them hundreds of millions is still cheaper than if he had to pay up his tax arrears, and also from this friend of mine who said she paid the judge 10 million so he would rule in her favour as well as Tony Leviste having paid the judge to grant him bail, (also first hand info)…

  6. This case, if true, reminds me of the textbook payola during Estrada’s time when the suppliers’ agent delivered money in Malacañang (at the Mabini bldg where the executive secretary and the budget secretary used to hold office) in SM plastic bags.

    One of my friends was a supplier for the Dept of Education – she said that she had to quit because it was getting to a point that she was losing because graft at that department had reached unheard of proportions and the ladder was from first man to the highest man.

    Finally, I’m able to post my comment here. The whole country is infested with corruption, so why be surprised if some of the SC Justices are as corrupt? Puwedeng idaan sila sa pera or some other forms of rewards. Huwag tayong magtaka kung ang dating Chief Justice Davide ay tumanggap din ng lagay. Notice that after what he did to Erap, he got lots of benefits including his current post in UN. Most of the current SC Justices are GMA appointees. Since GMA is corrupt, it’s likely some of her appointees are corrupt too.

    Well, the SC has to salvage it’s image, medyo bumabango na sana e! I won’t be surprised if nothing comes out of this investigation, sila-sila lang naman e!

  14. Yes, it was during Estrada’s time. One of those the suppliers used as middleperson was the American citizen cousin of Estrada, a certain Cecilia de Castro.

    One of those allegedly involved and later cleared was Ronnie Zamora’s deputy, Tingting de la Serna (former congressman of Cebu).

    If we talk about Supreme Court, Davide’s name will always be connected. He caused the greatest damage to that institution.
    In a way, I partly blame Erap for appointing him as SC Chief. Ironically, the same Davide stamped Erap’s ouster. Balita ko ang padrino noon ni Davide si Lucio Tan. Si Tan ang nakiusap kay Erap na gawing SC Chief si Davide. Kaya pala during Davide’s term, hindi sumulong ang mga tax cases ni Tan. How many boxes of millions of money did Davide receive from Tan? Unfortunately, there was no Delis to open the box. We’ll never know how much.

They are Independent (supposed to be) from one another, but they all have one thing in common, they are the weakest of all humans. Easily tempted with a few millions there and here and now not only lost their dignities, but their souls and along the sufferings of Millions. Beyond redemption..

    I recall that during the early days of the Estrada presidency, binanatan niya ang judiciary and called some judges “Hoodlum in Robe” dahil nagkakabayaran daw. He got the ire of the Supreme Court justices then.

I guess it’s time we ask for the names of the Arroyo appointees in the SC and see who among them do NOT receive this kind of boxes, and check if this is exactly what they were promised they would get when they were approached to be in the SC to help the kwin korap stay in power.   30. Where was the Rule of Law when Erap was deemed to have “Constructively resigned”? It was whelmed by the ubiquitous rule of “for the boys”. Smart lawyers are made not because they know the law but because they know the judge.
    For all his faults, Estrada (Erap, if you will) had the guts to defy the “hoodlums in robes” a major factor that sealed his fate. The excruciatingly painful irony: Erap appoints Davide Chief of SC and is reciprocated with the “Constructively resigned” verdict.

    These hoodlum in robes must completely stop. Everyone loses when justice is corrupted, in particular the poor. If money and influence are the basis of justice, the poor cannot compete for sure.

    There has been a sharp decline in the public interest in the Supreme court over the years.
    These cartons of butter for Santiago reveals the incapacity of our justice system. Hope it bring any powerful and influential person to book of a precedence for atty: wannabe to debate in law school.

  34. In short, Ellen, hindi pa rin natapos, and it was extended up to the time of Rocco because I remember the textbook scam being still talked about during Rocco’s tenure as Sec. of Ed. Kaya poor fellow, sick as he was had, had to quit before he could really make any improvement in his department.

    I guess Jesli Lapus is having the same problems, but unlike Rocco, he must have felt wiser to follow the adage, “If you can’t lick ’em, join ’em” crooks!!! Sayang, pati idealism, nasira!!!

    BTW, Fukuda became officially the PM of Japan today. They are not talking of who will be in his cabinet. Abe came out yesterday and told the real reason why he quit.     That is the fuss with our justice system, if someone is accused of a crime even they didn’t commit and they could not afford to pay for a lucrative lawyer to defend them, maybe they are lucky if a public defender comes to their rescue. Unfortunately, the reality for defense attorneys is bleak.

    Lawyers in the public defender’s office are typically young, the ink was not dried on their bar card. They use this experience as a stepping stone to advance their careers where they will make more money, which is where novices in this position to start. Their first experience is that the bar exam plus death penalty certification for trying such a case even their client is innocent.

    Public defenders handle more than double the cases a private attorney would take. Public Attorney may not be the answer they always plea bargain but, no choice, but could certainly improve their mental anguish. And most certainly no other way out and they would agree that when it comes to saving lives, lives of people that are possibly innocent or dealt with unjustly. Another innocent person sleeping on a cement in a crowded cell. When the convict is parole, the public defender who practiced his case in court his name is the forgotten one, He is already a congressman.

    Journalistic ethics and standards where are thee. Some possible scenarios: The mentioned SC justice is taking bribes or the journalist is lying or taking bribes.

    Pero kung tutuusin, sino ba ang mas kapanipaniwala? The judge who spent her life defending the constitution, or the journalist na puro chismis na wala namang ebidensya.

    tama po kabayan, subalit ang punto natin dito, ay hindi natin maitatago ang katotohanan na ang tao ay likas na mahina pagdating na sa pinansiya. kaya ang argumento natin ay kung ang aregluhan sa mga kaso ay nagagawa, ano pa baga ang suhulan. nandoon ang merito ng argumento, hindi dahil sa ang isang huwes ay ginugol na niya ang buong buhay niya sa pagtatanggol sa konstitusyon ay hindi na masisilaw sa kinang ng salapi… Ang naging amo ko sa law office na pinagtrabahuhan ko taong 1995 hanggang Dec 1999 ay muntik ng madisbar, ang kaso niya, pinagbintangan siyang tumanggap ng suhol mula sa panig ng akusado, na naareglo naman sa kabila ng matitibay na ebidensiya at mga saksi, ang suhol na ito ay may kasama pang babae, matindi ang kaso ng amo ko, mawawalan yata ako ng trabaho, sabi ko sarili ko , siyempre pag na disbar siya,sara yung law office niya, pero himala ng mga himala, nalusutan po niya ito,,, Entonses, kung naging karanasan ko ito, hindi ba posible na naranasan din ng iba ito… Iyang mga peryodista ganon din po, may mga pagkakataon na ilan sa kanila ay nahuhulog din sa kaway ng maruming salapi. Minsan yung bulati ay nagiging sawa… kaya tama ka kabayan, isip muna bago salita,,, Pero ang mga karanasan ko ay hindi ko lamang nakuha sa salita, ito ay karanasan ko nakuha ko ng makahalubilo ko ang tribo ng mga companero y companera.

    Tama naman di ba? The Constitution is founded on the right to life, liberty and the pursuit of happiness.

    Kaya lang, iba-iba ang definition ng happiness. For some, it is a good name; for others, it is a good brand name. Yung huli ang tumatanggap ng bribe.

    Marami ang tumatamasa ng pera na hindi pinagpawisan. So this is the land of the free and home of the bribed.

    Kung ika nga, you make presumptions and assumptions based on what you see, what you read and what you hear (as you are doing now), and it’s all in your honour because God gave you the brain to do that (hope you continue to use it wisely and intelligently) why can’t or shouldn’t journalists do the same who, like you, are gifted with a thinking process?

    I found that out when I worked briefly as a special correspondent for a Philippine news agency. When I asked for a raise, I was told that I should count myself lucky that I was paid a salary (minimal in fact compared to what I receive from a Japanese company I also accepted some jobs) whereas most of them writing for some politicians in the Philippines were nothing but paid ads agents—writing publicity materials to make the payees good to the public like those written on the Dorobo squatting at the palace by the murky river.

    Mr. Macasaet should make sure that his source is telling the truth. The source maybe just trying to feed information just to implicate a justice, for a reason he is the only one who knows. It needs proof. If the money is delivered 5 times meaning 5 boxes, that means about 2 million pesos is inside the box. That also means about 20 bundles of 1000 bills every delivery. But one question is, why would the bribe-giver risk delivering bribes for 5 risky times? Would the story of the source be verified by the guards assigned on those dates? Mr. Macasaet’s reputation is also at stake here. So he better confront his source.

    I’ve had first-hand experience when you speak of high-profile kickbacks/bribery. One person very close to me in fact asked me to accompany him during some of the “deliveries” since I carried a licensed firearm and he didn’t trust the security guards the banks were lending him.

    After withdrawing the 8-digit “payroll” from the bank, a bank clerk had divided the loot into small and big envelops per our list and a thick bundle of “loose change” in P100 denominations (ice cream money, he calls it, for merienda of clerks, even janitors, and other non-critical staff; he says the next time around, the processing of papers gets faster). We proceeded to the gov’t office.

    Everyone greeted us with smiles and “Good afternoon, boss!” Absolutely everyone, from messenger to Chief went home happy that day.

    The person told me that there are “5 Commandments” in grease:

    1. Never, never issue a check. Neither should you insist that the recipient sign a voucher/receipt or risk being shot between the eyes, no one wants a paper trail.

    2. Never hand it to underlings, some secretaries are authorized to open all incoming parcels and mails. Some accidents do happen.

    3. Make sure everybody is happy with his share, prior agreement, even just implied or in passing, as to amount is extremely necessary. Noise is the last thing anyone would want after a successful deal. A postulate to this rule could be: never discuss with the others how much someone else is getting.

    4. When speaking of percentages, always make sure you deliver to the last centavo, it’s “professional”.

    5. Whenever possible, absolutely everyone gets a share. No one complains.

    That’s the reason I’m uncomfortable with believing this SC bribery at the moment. People who are used to bribing do not just leave the evidence lying under the secretary’s desk, much more with the guard who, on any kind of suspicion (bomb, drugs, etc.), may justify opening the box at any time!

    Money this big (was it ten million per box?) are either delivered in neutral territory (restaurant, parking lot, blind alley, etc.) or directly to the recipient’s house.

    Thirdly, you are courting trouble when you do this under the very noses of the recipient’s colleagues. Suspicion opens cans of worms, nay, sewage tanks!

    If this bribery story is real, I can only think of the following scenarios:

    A. The bribe-giver intentionally wants a sting, if this was the last “installment” and he had already received the favors he sought for.

    B. Justice Yñares-Santiago is so stupid and gullible she allowed the previous deliveries in the same mode.

    C. The justices are so brazen they don’t care who gets to know or see such activities as long as it didn’t reach media.

    D. Everybody else is part of it.

    Would the last one, “D”, be the most appropriate one, in this case?

    But corruption comes in many forms. When you succumb to that is corruption. Sabi nga nila “ang lalake daw ay natural lang na mambabae”. Totoo iyon KUNG pinapayagan ng may katawan na mangyari iyon. The same is true with corruption. Hindi lang naman sa pera ang tao nagiging corrupt. Ang mga kabataan natin na nalululon sa mga masasamang bisyo, pangungurakot sa gobyerno, breakdown of the most basic value, of self-respect. Ang mga taong gumagawa ng labag sa tamang prinsipyo, sa tungkulin sinumpaan (may bible pa sa ilalim ng kamay, sus’ hindi na mga kinilabutan) ay corrupted din. Hangga’t walang renewal of values, kulelat lagi tayo. There are still good natured people in government even in the NGO. Bakit sa ibang bansa, pag may nagawang pagkakamali sila or involved in anomalies, they resign and accept defeat. Does it mean that their morals are far superior than ours. I find it hard to accept even being a Fil-Am that not only that we are kulelat economically compared to our neighbors, but are we also heeded to moral bankruptcy? Who is going to save the Filipino people? Not the United Nations or Uncle Sam for sure. Pinoy pa rin ang magbibigay ng solusyon sa Pinoy na problema. Ang tanong: Kailan pa?

    I would take D. The delivery was made to the Offices to make sure if every shipment has to be divided among the apostles, everyone will get it. If it is delivered at a specific home, some others may find out and start the backstabbing. I also opined that The Lady Justice is not an exception to the rule, if it is true, everyone in the Game..

    Hindi kaya naman intriga lang ito kay Justice Santiago? I agree with Tongue, money this big should not be left on someone’s desk. Di ba dalawa ang gustong ipwesto ni tiyanak from the Sandigan Bayan justices( those who convicted Erap)? Based on the justices votes, there are 8 anti tiyanak and 7 for the tiyanak in key cases. If Santiago is one of the 8, it is no brainer, tiyanak has to replace two of these anti tiyanak justices so the scale will tip to the other side. The money may have been planted by no other than the mafia running our government right now. Maybe the secretary was even told by the delivery guy to open the box and so she did.

    I would give Santiago the benefit of the doubt. This may again be one planted evidence to discredit an anti tiyanak justice( if she is one). And if she is one of tiyanak’s justices, I would say, what do we expect, kung sino ang puno, siya ang bunga! Tiyanak’s justices can be as corrupt as she is! It is SOP(standard operating procedure) in tiyanak’s kingdom!

  118. How about a background check on this judge? If she has been in conflict with the Fatso family, then, she deserves the benefit of the doubt.

    If not, I want to believe what my friend told me about the judges of the Philippine SC (the folly of leaving the appointments there in fact to the members of the most corrupt Philippine government as a a matter of fact), and that is, that ALL, and no exception to the rule, are corrupt, and accept bribes from those who want to go scotfree!!!

    And if she is, she should go to jail, and maybe, we’ll see her paying her fellow judge(s) with the bribes that she has been reported to have received!!!

    “Judge not that thou shalt not be judge,” so says the Holy Scriptures, but it is not judging that we do here. It is more an attempt to expose these crooks and let the Filipino people judge with perhaps some inspiration and promptings from Up Above.

    Frankly, I believe Ellen to be heaven-sent. It’s her gift in fact for actually coming near to meeting her Maker, and I’m grateful that she is using her gift well and good.

    Good observation, PSB. I remember now, it was Erap, a close friend of the Yñareses of Binangonan, Rizal who appointed Yñares-Santiago to the Court. Yñares-Santiago consistently decided against Malacañang on EO 464, PP1017, and Calibrated Preemptive Response. So with Piatco and Comelec.
