The military has rejected ex-Marine commandant Major General Renato Miranda’s appeal to release eight of his men co-accused with him for mutiny and leave him to stand trial alone.
“That is not possible because the criminal and administrative liability of one person cannot be absorbed by just one person,” Armed Forces of the Philippines (AFP) public information officer Lieutenant Colonel Bartolome Bacarro said on Monday.
“They are charged with conspiracy, for violating the Articles of War. They have to face this,” told reporters in Camp Aguinaldo.
Miranda and his men, along with 19 Army Scout Ranger officers, are facing several charges, including mutiny, before a court martial for allegedly seeking to overthrow President Gloria Macapagal-Arroyo in February 2006.
In a statement released on Sunday, Miranda said the military leadership should consider the “common good” and release his men so that their “talents” could be used in the battlefield.
Bacarro acknowledged that the incarcerated Marines were “talented,” but he said: “The inventory of officers outside [detention] are [composed of] equally competent officers. There are more competent officers outside.”
The detained Marines include two recipients of the Medal of Valor, the military’s highest honor, Colonel Ariel Querubin and Lieutenant Colonel Custodio Parcon.
Querubin and his co-accused, ex-Scout Rangers chief Brigadier General Danilo Lim, allegedly planned to lead a mass withdrawal of support from Arroyo on February 24, 2006, to coincide with protest marches for the 20th anniversary of the 1986 People Power uprising.
Miranda allegedly knew of the plot. On February 26, 2006, his sudden relief as Marine commandant prompted Querubin to lead a nigh-long standoff at their Fort Bonifacio headquarters.

The problem with these Gloria’s goons is that they don’t know what “love” is. While legally and technically, one cannot represent and make to suffer for the rest, if one admits to the crime or mistake, the rest of the accused are free of charges. The worst that they can be accused of is accessory to the crime. Para sa akin, maganda man ang layunin ni Miranda, may puntong legal si Bakero este Bacarro. But so what? where is the crime? what is the charge? it’s been four long years but still gloria’s bunch of hoodwinks cannot come up with proper charges to be filed in court.
don’t be so carried away by the articulated releases of bacarro. please bear in your memory that it was only esPWEron who wanted to pin them down due to his head-over-heels fear that if these gallant officials would be cleared of fabricated charges and get back at him, he will never be able to defend himself.
also, don’t ever forget that the content of the pre-trial investigation report was kept by esPWEron himself and always insisted that being the shit-of-staff, he has all the authority to charge, prosecute and punish whoever he wants and whenever he wants.

Perhaps, it would be a good idea if the Rt Honourable Pong Biazon, himself a former marine and CSAFP could perform an inspection check on the conditions of incarceration of the accused officers, if not for anything, for humanitarian purposes…

First of all, why should he say that? Is he trying to divide the sentiments of the men and officers in the military?
How dare he judge that “There are more competent officers outside.”?
That comparative degree prouncement is uncalled for; Bacero has no right to make that comparisson, not today when the entire military is under a huge microscope for the ineptitude, the cowardice and the human rights abuse of his direct boss, Esperon!
Bacarro is forgetting that they in the military has got but one life to give and those incarcerated today have given more than their just one life; that he says “There are more competent officers outside.”” is synonimous to his ignorance of the military code of ethics.

Mr. Bacarro… what conspiracy are you talking about? Did you read the PTI Report? Based on the findings of three (3) military lawyers: THERE IS NO PROBABLE CAUSE TO CHARGE THE DETAINED OFFICERS WITH MUTINY. So how could you say there was conspiracy? The reason why Gen Esperon delayed the release of the PTI Report for five months was because he wanted Col Perreras, the JAGO lawyer to change his report. Fortunately, Col Perreras is a principled man, he did not agree to change the PTI Report. On the other hand, the Staff Judge Advocate, Col Pedro Davila, was not that principled. Col Davila, long before the PTI Report was released, told some detained officers and lawyers that his findings and recommendations were the same as the PTI Report. But when the Pre Trial Advise (PTA) came out after seven months, it was the opposite of what he said. But the Lord is still good. When the PTA was released, the wife of one detained officer, overheard Col Davila scolding Capt Peel, a member of the secretariat, for releasing the PTA without changing first the ———— then he saw the wife so he stopped. So if you go over the PTA, 38 officers were recommended to be charged with mutiny but Esperon only charged 30 officers then dropped two more on the first day of the hearing. So now only 28 officers are detained.
Maybe the conspiracy that Bacarro is referring to is “OPLAN HACKLE” which is the result of the computer work of the desk intelligence officers in the AFP. Since it was in their intelligence report that there was such a thing as OPLAN HACKLE they had to do something to make it true like put a bomb here or make chaos there just as they had imagined. Gen Esperon is very good at it. He spent most of his time doing intelligence work and maybe 75% of it was done on his desk.
Esperon, ever the “expert” in production (intel term), the only thing he’s actually good at, must be soooooo proud of himself for having come up with Oplan Hackle. But since
Esperon is incapable of dabbing in truth, the result was as convoluted as his brain’s thinking capability.
How could the marines and rangers conspire, when most of them only met during the hearing. I met the rangers for the first time on December 14, 2006 during the first court martial hearing except for Gen Lim. There are some detained officers who were not even investigated. They were not even allowed to submit a counter affidavit. They just found out that their names were in the list and so they were detained.
Real stories can only come from real people. That’s what you are Marine Wife.

Marine wife’s posts are very telling – they give us additional, crucial info on how Esperon conducts his court of unggoys:

Was it through these illegal measures that gave Esperon the right to assmeble his kangaroo court?

Talking about competency… Three marine detainees are all ready to be Brigade Commanders but two of the present marine brigade commanders did not become deputy brigade commanders yet which was a pre requisite to becoming a Brigade Commander before. But just recently to suit their qualifications only, they changed the policy. So these are the more competent officers outside.
One of the highest ranking officers in the land (or ex-highest ranking), who should be put in the docks for having manipulated a what could have been reasonably orderly outcome of the Feb 2006 debacle was Senga.
He was chief of staff at the time to whom Gen Lim confided. Senga should have taken command responsibility then to either place Lim under arrest and hauled before a court martial if truly Lim had organized a move aimed at toppling Gloria and her government. But Senga didn’t! The mere fact that he simply acquiesced to the demand of Lim to be put under arrest, sending Lim back to his quarters proved that at that point in time, there was no fundamental basis for a charge or charges that are now being cooked up by Esperon and his cohorts.
What also strikes me as odd is why did Senga pass the buck to Esperon, i.e., instead of making a military decision on the matter during his term? What has Esperon got that he doesn’t? Was he afraid of Esperon who, we must remember, was Senga’s subordinate at the time?

If government is serious:
1. the Office of JAG AFP should convene a court martial very soon.
2. we can safely assume that since/because government has publicly declared that certain officers committed an act of mutiny, military prosecutors are therefore prepared to ask for the DEATH penalty which is the punishment meted on proven mutineers under the Articles of War.
But since this government is NOT serious at all and may be considered amateurish at best in handling our military institution, we can only expect a monkey trial of the “accused” officers who are far more professional than Gloria and her government could ever be. Remember, UNTIL TODAY, this STUPID government has not concluded its case against the OAKWOOD so-called mutineers.
Technically those OAKWOOD so called mutineers committed rebellion and attempted a violent coup d’état for which they should face military execution but because Gloria and her dumb, coward GOVERNMENT know they have NO MORAL leg to stand on, they cannot do anything.
I say to our brave officers and men (but not to those conniving, collaborating, immoral Gloria generals who have forfeited their right to time-honored military officer’s courage and honor):
KEEP UP THE GOOD WORK. You have the moral and physical courage of your convictions. You will inevitably defeat this illegitimate, immoral, corrupt government.
Another competent officer outside is an officer who was on AWOL for more than a year while still receiving salary then he was promoted to BGEN because he fabricated stories to implicate the detained marine officers. He will be a witnes against the detained officers in the court martial. But the detained officers are looking forward to the day when he is on the witness stand. He is even convincing a detained Lt. to be a state witness so she will be released. So these are the more competent officers outside.
In the same vein, the botched proceedings against the Oakwood officers are being re-hashed against the officers of honour led by Miranda, Lim, Querubin, Parcon, Aquino, Langkit, and the many other incarcerated officers.

The court martial of Lim should be a very good watch. (Would be excellent if you could interview Lim prior to his court martial…)
Based on Gloria’s proclamation of the SOE, the government unequivocally pronounced that there was a coup d’état conspiracy, plot between Lim and NPA-CPP elements to overthrow the government; the charge of whether the act is rebellion or insubordination makes it irrelevant now… Esperon’s formal recommendation for a court martial means that the government is already prepared, paperwork and all to proceed with the court martial without delay; what is relevant today is that under articles of war, the government will technically NOT need a lot of time to conclude the court martical. In other words, Lim’s court martial could be between 30 and 60 days at most.
If they cannot do this during this time, then the government is not serious; either that or they have no concrete evidence to back up their charges. If the charge is act of insubordination, it should make it very easy for both government and accused to debate the issue because government’s case is clear cut in an act of military insubordination.
I’m interested in Lim’s case because it should be a test case… he can even call retired generals as his witnesses, etc which will inevitably open a can of worms. Besides, even if government has upper hand in a charge involving an act of insubordination, it will be the word of Senga against Lim.
I will inform Major Aquino next time I visit. Capt Langkit is in Fort Bonifacio and I only see him during the hearings. I am banned from visiting him, so I can not even bring food to him anymore. He has a very interesting story to tell, good enough for a book. He is still single and very handsome… A fine gentleman.
What surprised me was that Gloria who declared her emergency rule ON TV based on the notion that there were threats against her govt by the military, DID NOT even announce the names of the culprit of the highest rank.
I suspect that she didn’t because Esperon was still busy making mashed potatoes of his purported OPLAN HACKLE to sell to the public!

Did you notice that Gloria, commander-in-chief (daw) has not said a word on the military future of BGen Lim?
Traditionally, an officer of that rank who’s committed such military offence (inciting to mutiny), would have been immediately ordered arrested under Article of War.
Gen Senga has a heart unlike Esperon who is made of stone. Gen Senga admits he is not clean unlike Esperon who even dares anyone to say that he cheated. What transpired on February 23, 2006 inside the office of Gen Senga will be revealed one day. Gen Lim and Col Querubin talked to Gen Senga and whatever Esperon says is hearsay.
As for Baccaro’s coup conspiracy, here’s my thoughts on the matter – more than a year before he uttered his inanities; this also follows Marine Wife’s posts questioning the validity of the charges against the incarcerated military officers (posted it under www. philippinecommentary.blogspot.com/2006/03/thanks-lot-comrade-gloria.html ):

My reading: It was a load of political gobbledygook rubbish. There’s no meat in that report. A relatively juinor military officer does not make up a powerful component of the AFP able to topple a regime! The only more sernior officers that figure in that report were 2 RETIRED & VERY OLD military officers. Never mind the leftist elements – we know what they’ve been trying to do.

In other words, this AFP power point presentation did not show any evidence of a failed coup d’état conspiracy between the military and the commies; moreover, it confirmed that the guys have absolutely no serious basis for crying coup d’état conspiracy, assination attempt, etc.
Come on! SOE on the basis of some gibberish documents and a meeting of retired officers wit a bunch of suspected leftists? And that’s the military-commie thingy? WHOA!

If you remember, on Feb 24, 2006, Gen Senga, during a press conference on national TV, said that Gen lim was under his custody and Col Querubin was not relieved and was not in hiding. So if the AFP Chief of Staff then said those words just a few hours after he had a discussion with the two officers, how come that after a few months they were charged with mutiny?

Absolutely, Marine Wife! That’s precisely what I was getting at.
When you have a chief of staff, Gen Senga in this case, who is no coward nor a mushy mush like Esperon who did not ARREST Lim and Querubin and hauled to before a military court, what right has Esperon to circumvent an earlier decision or for the sake of reality, NON-DECISION to charge these officers?
That’s why, I was a bit peeved by Senga too – because he HAD FULL POWERS to make a decision at the time but didn’t, effectively leaving command responsibility to Esperon for something that he had not seen fit to put in order.
It doesn’t take months to come up with a pre-trial investigation report and to act accordingly, i.e., recommend a court martial or not and Senga had all the time to do so, so why didn’t he?
If I am maligning Senga here is because I too want to know the truth and he must come out and speak! He who was a Mindanao veteran, known as no-nonsense general, he should have taken the bull by the horns and decided.
Or did he? Did he write a report (he must have written one) following a real PTI and submitted it to Gloria recommeding for the dismissal of the accused but Gloria didn’t want it or Esperon must have made sipsip to Gloria and said, “Wait na lang Ma’am, when I replace Senga, I will overturn his recommendations.”
I’m positive Senga submitted a report to Gloria (even before the Mayuga committee was tasked to investigate and which, by the way, did not come up with a report as far as public is concerned.)
Where is the Senga report? Will his report acquit the officers? That’s why Gloria and Esperon are hiding it?

I am familiar with the tons and volumes and volumes of paperwork that AFP and staff submit widely and I am surprised that the so-called coup conspîracy under Senga should not have a report signed and sealed by Senga to the attention of Gloria.
Just doesn’t make sense… I’m positive that there is a secret report by Senga addressed to his president re the February stand off and the brou-haha but which report, I believe, has now been either burnt by Esperon or burried in the depths of his bowels.
Find that report and we will know the truth.
The liberty of this men hinges on several factors, one of them is the truth and that truth could either be contained in a report by Senga to his president.

If Gen Lim and Col Querubin did not inform Gen Senga about the plans and the restlessness of the junior officers then the AFP would not have known anything. The reason why Gen Lim and Col Querubin decided to inform Gen Senga was primarily because they did not want any bloodshed nor violence. They wanted a unified not a divided Armed Forces. They have been incarcerated before and they do not want the other officers and men to experience what they went through in the past. Gen Senga understood their plight and they discussed the problems in the AFP. Gen Senga told them to pacify and inform the junior officers not to push thru with their plans and they obeyed that is why no member of the AFP was in the rally. But incarceration is what they got for obeying orders of the Chief of Staff then.. . all these charges and detention was orchestrated by Esperon or under his strict orders…
Will try to find out if that report still exists… even the original Mayuga Report can’t be found.

Related to that is (was) the case filed against these same officers before the Department of Justice plus a number of civilian personalities, one of them former UP President Francisco “Dodong” Nemenzo, whose name the NBI mixed up with Nemesio Pridente of PUP.
The case against them is titled “Maj. Gen. Renato Miranda et al”
During the break in the hearing, Gen. Miranda approached Nemenzo and said, “Oh, so you are the “et al”

At least, my mother’s nephew got his position the ordinary way, no sipsip! That’s exactly what they did in Basilan. Asspweron et al just listed the names of whoever were available in the rooster of whatever. Pinupulot lang ang mga pangalan kahit saan, ayon kay Gokusen. Kaya hangga ngayon ay naggo-Google pa sila dahil ang 300 suspects sa Basilan massacre ay phantoms lahat.

What does these leave us in the context of eliminating evil in our society, especially in the government? Is it not a practical approach to eliminate evil by being a harder evil ourselves?

Besides would be a waste of important time, precious rations, determined efforts, good heart, and even of our meager space, not to speak of money or the lil that’s left after Gloria and her govt have looted the treasury, to even begin to try to rehabilitate these corruption addicts – we need to use the resources (heart, mind, money, understanding, etc.) for those who have less in life.

Ma’am Ellen… you are right. The Marine General is BGen Jonathan C. Martir. He is the present Brigade Commander of the CSSB – Combat Service Support Brigade based in Bonifacio Naval Station, Fort Bonifacio.
In Camp Capinpin at around 9PM tonight, over a hundred soldiers where assembled in front of the 2nd Infantry Division Headquaters. They are preparing for any eventuality… I am not sure what they are expecting. Maybe their intelligence reports revealed that the detained officers plan to escape tonight.
Just like last December 2006 when the detained marine officers were still in Cavite City, their desk intelligence report revealed that Col Querubin will escape with the help of Australian forces. Their story was that a helicopter will get Col Querubin in Cavite and will bring him to the international airport to board QANTAS Airways bound for Australia….
Intel men were stationed in Naval Base Cavite to guard the guards of the Marine detained officers.
While Col Querubin was under house arrest, he had two Marine guards on duty 24 hours a day and at the of the road a group of INTEL men from ISAFP, ISG and AFPCIG where also guarding the Marine security.
Even in Tanay, there are INTEL personnel monitoring the activities of the guards and detainess…

While Gen Lim was under house arrest, he had a lot of security around his house, near and far… he can not even go to church even if the church was walking distance from his quarters. Actually gen lim can see the church and hear the singing in the church but because of INTEL reports that said… there were groups ready to rescue him… so the whole time he was under house arrest, Gen Lim was not able to hear mass except for the mass that was said inside his house
What is their criminal or administrative liability?
During the Marine stand off, Col Querubin was not armed. He only asked the people to pray and support them.
Whatever their plans are, if they have plans… I am not privy to it..
But i just hope and pray that one day I will wake up wtih a new AFP Chief of Staff and a new President… then and only then can I rest.

Tama si Marine Wife, talks of springing out these detained officers are everywhere. I think it’s the reason they changed plans of using fully armed soldiers to guard the street rallies.
These soldiers take their direct orders from junior officers who may be sympathetic to someone else’s cause. And if their men are fully armed, it will be dangerous for the bootlicking military leaders. Don’t be surprised if you see generals in the frontlines in today’s activities.
The military backup support for the PNP will not be in the streets unless its very very necessary. They will be staying in the camps, I’m sure. Maybe gathered in the parade grounds where everyone can see them. Tsk tsk tsk. This is what we get for having crooks in the military, and the good ones are in jail!
