Amnesty for all, even Estrada in the works–Speaker

Update: Estrada open to JDV’s amnesty plan

An “all-encompassing” amnesty for all “enemies” of the state, including deposed former president Joseph Estrada and military rebel-turned-senator Antonio Trillanes IV, is in the works.

Speaker Jose de Venecia, Jr. told the Philippine Daily Inquirer on Sunday that a bill to this effect would be filed “soon” in the House of Representatives “so that we can unify the nation.”

“I will formally write the President, so that it will be included among the first priorities of the LEDAC [Legislative-Executive Development Advisory Council],” said De Venecia, who added that President Gloria Macapagal-Arroyo earlier accepted the idea, which is similar to the general amnesty passed by Congress in 1995 during the term of President Fidel Ramos.

“She’s supportive of it as long as it is a legislated amnesty,” said De Venecia, adding that he recently consulted with Cebu Archbishop Ricardo Cardinal Vidal, Senate President Manuel Villar, leftist lawmakers and some opposition leaders.

Even Executive Secretary Eduardo Ermita, a former military officer, and hawkish members of the Cabinet like Justice Secretary Raul Gonzalez and National Security Adviser Norberto Gonzales, were supportive, he said.

“This is a wide-ranging, all-encompassing amnesty to cover all insurgents and all those who have committed political crimes against the state,” said De Venecia.

The key word is “political crimes.” Congress cannot grant amnesty for grave offenses falling under the category of heinous crimes.

Malacañang did not want to comment on the proposed amnesty as it has yet to be filed in Congress.

However, President Arroyo’s legal adviser, Sergio Apostol, admitted that the Office of the National Security Adviser was “studying” the matter.

“Ask Norberto Gonzales about that. He is the one studying it. He’s the one [in charge],” said Apostol.

Gonzales could not be contacted on Sunday for comment.

Ermita earlier told the Inquirer, parent company of INQUIRER.net, that Malacañang was putting together a general amnesty for all enemies of the state—communists, military and Moro rebels.

“In due time the amnesty proclamation will be considered by the President,” said Ermita.

Asked about the inclusion of Estrada, whom Arroyo deposed in a people power revolt in 2001, the Speaker said: “Let it come normally. Let it be a consensus of all.”

He added that Trillanes, one of the detained leaders of the Oakwood mutiny in Makati of 2003, could also be covered by the amnesty.

Trillanes won a Senate seat in the May 14 midterm elections but cannot attend sessions because he is in a military jail facing charges he plotted a coup d’etat, a non-bailable offense.

The Senate approved by a 17-4 vote in late July a resolution seeking permission from the court to allow Trillanes to participate in Senate proceedings.

De Venecia said he would continue to consult with the “chief forces” of the left and right, religious groups, labor unions, the academe and other civil society organizations.

Although an act of Congress is separate from executive decisions, De Venecia said a general amnesty could become part of the peace process with both the Moro Islamic Liberation Front and the Communist Party of the Philippines and its armed wing, the New People’s Army.

“Sen. Gregorio Honasan and more than 3,000 members of RAM (Rebolusyonaryong Alyansang Makabansa) availed themselves of (a general amnesty) in 1995 that Secretary Ermita and I had Congress approve during my second term as Speaker,” he said.

The RAM soldiers, led by then Defense Minister Juan Ponce Enrile and military Vice Chief of Staff Fidel Ramos, led the military mutiny that sparked the People Power revolt of 1986 against the dictatorship of Ferdinand Marcos. Honasan then participated in several coup attempts against Marcos’ successor, Corazon Aquino and got amnesty in signing a peace agreement with the Ramos government as one of the members of the Rebolusyonaryong Alyansang Makabansa (RAM).

He later ran for the Senate and won. But he was implicated as the mastermind of the 2003 Oakwood mutiny against President Arroyo, and then was dropped from the charge sheet shortly before he ran for and won yet another term in the Senate in the 2007 midterm elections.

In 1992, De Venecia said he, together with Ermita and then Congressman Jose Yap, shepherded the repeal of the antisubversion law. This paved the way for the legalization of the Communist Party.

The amnesty also benefited communists led by its founder, Jose Ma. Sison, who was freed from prison. But peace talks have since broken down. Sison sought political asylum in the Netherlands.

The planned amnesty would be all-encompassing compared to the 1995 amnesty which was “limited to insurgents,” said De Venecia.

“This will create the beginnings of real national unity. The next President will have less tasks in his or her hands and at the same it will complete a legacy for all of us,” De Venecia said.

The Speaker recalled a “positive response” from politicians abroad when he first raised the idea in 2006.

He said he also took the matter up with the caucus of Philippine political parties, of which he was chair in 2006. “They were all supportive,” he said

    No matter what amnesty bill he files to make her poser president looks goods before the public eyes will just be for naught, walang maniniwala sa mga mandaraya, sinungaling, magnanakaw at korap!

    Ikulong at parusahan ang mga may kasalanan, lalo na si Gloria Arroyo Pidal, at pakawalan ng walang kondisyon ang mga walang sala, ang grupo nina Col. Querubin at Trillanes!

    Ang hustisya ay nararapat ilapat sa mga kriminal na pinangungunahan ni Gloria!

    There is no need for “Amnesty for all” just getting Truth & Justice is good enough for us. IF these Leaders spent as much time and effort in being transparent to the public as they do in sitting around in tight groups thinking up ways to escape their constituted vows of serving the people there would be no need for an “Amnesty for all” and the country would not have been divided but unified already.

    “all-encompassing” na kapatawaran, ang may K lang sa mga salitang ‘yan ay ang mga banal! Tigilan nga ang pagpapapogi at pabait effect, hindi bagay sa inyo!

    Ngayon lang ako nakarinig na “enemy of the state” ay bibigyan ng amnesty. Kapag sinabing kaaway ng bansa at napatunayan ng mga ebidensya, ibig sabihin ay kriminal at traydor at dahil bansa ang pinagkasalahan ito ay walang kapatawaran kaya dapat bigyan ng karampatang parusa.

    Sa laki ng problema sa Mindanao ay ito ang pinagkakaabalahan ni Gloria at de Venecia. Guilty!

    “Amnesty for all” agreement for them is like the bank robber having robbed the banl (Treasury) beaten up all the customers on their way out (us), then ask the security guard on the entrance (congress) to call them a taxi for their escape. Hahaha unbelievable!

    Don’t…never listen to this JDV. JDV is a salesman first and foremost. He talked his way up to speakership. Amnesty should only be given to those who are guilty and proven guilty in the court of law. In the case of President Estrada, why should he be given amnesty and why should he accept it if he’s not guilty of the crime he’s accused of ?

    This Amnesty for All is is indeed Amnesty Me in so far as Gloria Macagarapal Arroyo is concerned. It is a camouflage in order to escape persecution for graft and corruption. They will float it as an act of magnanimity towards Erap and Sen. Trillanes. But we doubt of if these two will succumb because of their previous stand that accepting amnesty means accepting guilt which they professed they are not.

    There is really something brewing which make Gloria and her ilks to be in panic.

    Gloria is not unaware of a U.S. Interagency Anticorruption Team now actively working with US Treasury Department and partners in the Philippines to fight high level corruption. It is now undertaking measures in the tracing, freezing, seizure and confiscation of the proceeds of corruption mandated by the U.N. Convention Against Corruption (UNCAC). The Philippines, being one of the most corrupt countries, is high in the list.

    I don’t know if Mar Ravelo’s Comic strip’s Kenkoy,became alive again.He taking another pot shot on 2010,building his images again for another try.His proposal of amnesty to all another trick,he might be lovable to his district but not the rest of the nation,Old dirty rag should be discarded and burned,not to be use again with contaminated ideas,how much pain and suffering does he brought to the masses since he was brought to congress leads all these idiots mandated by their district.It’s countless from justices to infrastructure developements,socio-economy and rampant practices of corruptions from the lowest level to the most highest position in the government.The only one,our country afloats of the sinking economy were the remittances from OFW’s,forcible taxes of the poor,our industries barely survives due lack of support from the gov’t(exporting productive manpowers).

    This amnesty that JdV talks about is beyond my comprehension. Once this passes congress and signed by GMA it becomes a law. Amnesty is granted to one who violated a law or set of laws..one who has done something illegal.. ano ang illegal sa ginawa ni Sen. Trillanes and the others who are now in detention? I thought they were not charged and there is no verdict as of yet..so anong amnesty?..
    All they asked were reforms for the military and all they are fighting for concerns corruption of which the military and the administration seem to have a hand..so anong amnesty? Ang hirap kasi sa pang gulo na ito at ang kanyang alipores ay- “may utang ako sa inyo kaya bumayad kayo sa akin. Ibang klase talaga.

    For what? Are they going to convict him based on concocted tales by liar par excelance Chavit? Or the voluminous documents that led to nothing?

    Amnesty for Trillanes and Magdalo Group:
    For what? Will they convict them even if their acts were not in the textbook definition of “coup-d’etat”? The fact that it doesn’t, shouldn’t the cases be dismissed by now?

    Amnesty for Miranda, Querubin, Lim, etal:
    For what? Their acts don’t even meet the basic requirements to be considered rebellion, shouldn’t the cases be dismissed by now?

    Amnesty for Gloria, the Arroyos, the Generals, et al:
    Ah, that’s a different thing!

Sa amin, hindi puedeng makialam ang PM sa Ministry of Justice at lalo na sa palakad ng court. Iyong Solgen ang dapat umuusig ng mga kriminal. Hindi siya dapat kumampi sa mangdarambong, mandurugas, et al.

These people need funds to travel. You cannot expect them to organize rallies in other parts of the country or they be shot and killed like chickens by Arroyo’s military and police goons. Media is also restricted outside of Metro Manila. That’s why many crimes went unreported with some journalists getting killed by the government agents.

    AK-47, you mentioned the huge gathering of people at Edsa One.
    Let me tell you that most were from Metro Manila and a few from the provinces like Pampanga, Cory’s home province. The late Cardinal Sin was very instrumental in calling the church against Marcos using Catholic media like Radio Veritas. Together with anti-Marcos journalists and papers, they made an orchestrated move to convince people to go out in the streets. Those present at Edsa were mostly Catholic students from exclusive Catholic schools and of course UP (usual base of the militants and activists); priests, seminarians, nuns and Catholic laymen. The rest were the elite from Makati belonging to the Concepcion group who also controlled the Makati Business Club and Namfrel. A portion were curious onlookers who just went to see what was going on. With Marcos not making any move to disperse the crowd despite pressure from then Gen. Ver, the demonstrators became bolder. The rest was history.
