The twin rejection by Makati RTC Judge Oscar Pimentel Court in a span of five days in cases where Sen. Antonio Trillanes IV is involved, gives credence to talks of an amnesty proclamation being worked out wherein Gloria Arroyo can ride on and ensure protection for herself for the crimes she has committed against the Filipino people.
House Speaker Jose de Venecia mentioned in one of his radio interviews last week about his plan to file a bill to grant amnesty to those who have committed political crimes. He has talked with Sen. Panfilo Lacson about filing a counterpart bill in the Senate.
Lacson’s advisers said the opposition senator is amenable to sponsoring a bill granting amnesty to those accused of political crimes but they said they would have to be careful about its coverage including the cut-off date. They said JDV and Lacson may not have the same definition of “political crimes”.
The amnesty proposal is supposed to solve the political tension that has bedeviled the Arroyo administration since its start in 2001. Amnesty is an instrument of reconciliation as it erases the political crime of the accused even before conviction. It differs from pardon, which can be granted only after conviction.
Logically, those who would likely be included would be former President Estrada, son Sen. Jinggoy Estrada and lawyer Edward Serapio who are awaiting the Sandiganbayan decision on their plunder cases; the Magdalo soldiers who staged the so-called “Oakwood Mutiny” in July 2003 that includes Trillanes; and the 28 officers led by Maj. Gen. Renato Miranda involved in the alleged aborted withdrawal of support from Arroyo in February 2006.
De Venecia has not spelled out details of his amnesty proposal but sources told us the cut-off date, presumably at the time of the filing, would in effect protect Arroyo and her associates from being charged with plunder and other crimes once she is out of office. That means she would be automatically absolved of the crime of betrayal of public trust for cheating in the 2004 elections and for diverting millions and millions of pesos for the people to her election fund. Same thing will happen to her accomplices like former Agriculture Secretary Jocelyn “Joc-Joc” Bolante.
Sources said the amnesty proposal is actually designed for Arroyo. Estrada, Miranda and Trillanes et. al. would just be collateral beneficiaries.
How does JDV sell that to the opposition, who have vowed to make Arroyo pay for her plunder of the government coffers and the destruction of the country’s political institutions? Trillanes, for one, has made it his campaign promise to work for the impeachment of Arroyo.
That is where we connect the twin rejections by the otherwise reasonable Judge Pimentel of cases involving Trillanes last week.
Last Friday, Pimentel denied the motion to dismiss by way of demurrer of members of the Magdalo group of the coup d’etat case filed against them in connection with the so-called Oakwood mutiny.
In their petition, the 31 Magdalo officers, who include six core leaders Marine Captains Nicanor Faeldon and Gary Alejano, Navy Lt (s.g.) . James Layug and Trillanes and Army Captains Gerardo Gambala and Milo Maestrecampo argued that the prosecution failed to prove three vital elements that will establish the crime of coup d’etat: that there was swift attack accompanied by violence, intimidation, threat, strategy and stealth; that the attack was directed against duly constituted authorities of the Republic or any military camp, communication networks, public utilities or other facilities needed for the exercise and continued possession of power; and that there was conspiracy among the accused.
Those who witnessed that 19-hour bloodless standoff of July 27, 2003 would agree with the accused that there was no “swift attack”. They occupied a premier hotel in the heart of a commercial center and didn’t threaten occupation of any military camp, communication network, or public utility.
Gambala and Maestrecampo, who have made peace with the Arroyo administration, also argued that the case against them should be dismissed since the DOJ has already dropped the charges, citing lack of evidence, against the Magdalos’ alleged instigator Sen. Gregorio Honasan.
Pimentel brushed aside those arguments and upheld the prosecution’s claim that “the crime of coup d’etat was committed.” Coup d’etat is punishable with life imprisonment.
Last July 30, Pimentel also denied the request of Trillanes to be allowed to attend Senate sessions, to set up a working area in his detention quarters at the Marine Brig in For Bonifacio, and to be allowed media access.
We see these judicial setbacks for Trillanes as the Arroyo administration’s strategy of softening him so that he would not block the administration’s version of the amnesty proposal.
The same pressure is being exerted on Estrada with the threat of conviction by the Sandiganbayan. Malacañang emissaries have been visiting the former president in Tanay. Sources said one of the proposals was for Estrada to support Arroyo’s presidential candidate in 2010, who would promise to quash charges against Arroyo filed once she is out of office.
There is no question about the need to free the accused military officers. They did the Filipinos a favor by exposing the crimes of Gloria Arroyo. In the case of the Magdalo, the Filipino people have given their verdict by electing Trillanes to the Senate.
Arroyo grabbed power from Estrada, the elected president. She should be in jail instead of Estrada.
If there should be an amnesty proclamation, it should not be an “Amnesty Me” by Gloria Arroyo.

The JDV amnesty proposal is self-serving. He wants to save Gloria’s ass after 2010. In fact, Magdalo soldiers are whistleblowers. Magdalo exposed to the whole world about the massive corruption in the military in connivance with bogus President Gloria Arroyo. Whistleblowers should be protected by the State. In the Philippines, some whistleblowers are deliberately fed to the crocodiles to silence them forever.

Gloria’s first three years were spent on making sure she gets elected. She couldn’t do it on her own, she had to steal plenty and had to call Garci.

The final three years will be devoted to make an easy escape route for her and her family and her minions. The person who can deliver that to her will be the heir-apparent, I’m sure.

This so called amnesty–Is a justice to injustice. The mistakes they made to improperly prosecute the accused are so blatant and stupid, you wonder why anyone would need an amnesty to uncover their screwed-up. None of this accused is interested enough in amnesty, to paper over the holes in the plot. Amnesty systems in delivery do not guarantee the elimination of corruption. The reason that Pandakikay’s minions have always been treated and rewarded so well and use brute force to retain their dominance, the judicial system have been able to achieve the same thing for their masters without force and generally with a facade of respectability.
Amazingly, many of the psychological techniques used in Gloria’s Courts to intimidate those brought before the courts,–is “Are you with me ?or against me?– You can ask Honasan and SanJuan. The wisdom of making the legal system at least appear to be independent from the power of Gloria’s ruling elite is cosmetic, the court has been able to carry out their mandate basically unchallenged. Those who attempt to challenge the authority or wisdom of the fake president can be immediately silenced, and when necessary, jailed . Of course this weapon is brought out, when required, and serves effectively to enforce the “Divine Right of The Devil Elite”
Why discuss about amnesty at this early stage? AngTenga de Venecia know deep in his heart (kung may puso pa nga siya) all the crimes that his sponsor & her minions have committed to the Filipino people since she grabbed power from the duly elected Philippine president, Erap Estrada in 2001.

MANILA, Philippines — Talking tough anew against terrorists, President Gloria Macapagal-Arroyo has warned them against attacking government personnel on medical missions in the southern Philippines.
Speaking at the 21st anniversary celebration of the St. Luke’s Heart Institute Monday, Arroyo announced that she had dispatched a team of doctors from the V. Luna Medical Center to support those at the hospital in Western Mindanao Command in Zamboanga.

Alan Cayetano elected head of Senate blue ribbon committee!
It would have been better if Senator Lacson heads the above committee; but at least it’s not given to any die-hard administration senator. Whether or not Cayetano would one day become a die-hard administration boy, it remains to be seen. But in the meantime, it is a relief to know that it’s given to
a moderate thinking guy.
Oh yeah, nakuha ni Alan ang Blue Ribbon Committee? Nothing to be elated about. Sinabi na nga niyang admin na siya ngayon e. Titular lang naman ang kunyaring Opposition niyan. Sorry, nawalan na ako at marami sa mga kaibigan ko ng tiwala sa kaniya. Anak nga siya ng tatay niya!
Nothing to be elated about? What if the Blue Ribbon Committee is retained by Joker Arroyo or given to a die hard administration guy? We may have all our doubts about Alan and might have even disowned him; but he’s better than those idiots on the administration side. As I said, I would have very much preferred it was Lacson. But in politics, there are trade offs. We don’t know the leverages and agreement among them. Let’s just cross our fingers and not react negatively to things that don’t go our way. If it’s not Cayetano, we whine, if it’s him we also whine….Who said this was long decided; that is, the chair would be given to Alan? Nothing was sure until the last minute when Lacson’s group and Jinggoy sat down and reconciled.
In politics, there are trade offs? Dirty politics ng mga kumag sa Philippines, yes, but not in more progressive countries where the voice of the people carries heavy weight. Apparently, hindi alam iyan ng maraming pilipino kaya kahit na anong kabulastugang ipalulon sa kanila, tanggap na nila with full resignation, Nakakaawa! Dapat diyan another “Cry of Balintawak!”

I got your point, ystakei. But it’s not limited to Philippine politics. Even in the US and other countries, the common practice is “give and take”. As for Cayetano, I respect your opinion about him. But to me, he’s better than Joker Arroyo.
Let’s just keep a close watch on how he performs.

Not when the general welfare and interest of the public is concerned, Goji. At least, not that I know of as far as politics in Japan is concerned.
I should know since I take active part in our local politics here as volunteer for some of our local assemblymen and women. I am not aware of any cross partying in Japan. Disillusioned politicians oftentimes just quit or form their own factions so they can carry on with what their constituents expect them to do for the people. Cooperation and this symbiotic relationship that you talk about is true only when two or more parties agree for a common goal with the welfare and interest of the public as prime consideration. Otherwise, it is just plain and simple graft and corruption.
And the difference in our situation here from that of the situation in the Philippines is that we can take our cases to the police and the police and the court will act upon our complaints, and the guilty properly prosecuted. Call that political maturity as a matter of fact.
I wish and pray for the time when Filipinos would be able to enjoy such thing that should be a right of every law-abiding Filipino citizen, not just a privilege that the crooks in the Philippines would even deny them presently. Iyong style for example ni Villar, hindi puede dito iyan. Lalo na iyong kurakot ni Unano. Sibak agad iyan. Iyong “Hello Garci!” would have sent her to hell by now. Matagal nang nagbigti iyan kung haponesa ang ungas. Maaaring hindi rin kung makapal talaga ang mukha pero for sure kulong siya. Hindi na siya makaka-SONA at makakasinungaling!
Political maturity? The Philippines has a long way to go compared to other countries like Japan (as mentioned by ystakei). Japan had nothing after World War Two and look at it right now…among the world’s most progressive nations. It’s not that the Japanese are patriotic and nationalistic (it’s a big factor) but they indeed possess the political maturity. Human beings fall into temptation and corruption; and that also happen to other nationals like Japanese. The difference is how the people respect their countries’ laws and judicial system. The Philippines has a long way to go…I’m afraid it might never reach that!

i remember my mentor in political science, di si nur ha…ah dahil na rin daw sa kalokohan ng politicians noon pa kaya gang ngayon walang political maturity sa bansa..he cited the case of those who are in legislative, that when the US asked what to give in order about sa naging kasiraan ng ww2 ang hiningi ng phil pera…pero ang japan daw ang hiningi yung development para sa bansa kaya kahit nabomba sila after pearl harbor naka-recover sila kasi di pera ang hiningi, samantala tayo daw naubos ang pera… at gang ngayon politically immatured.

…Absolutely. Since the bulk of the government budget is allocated to her defense, without it then the funds can be used for other needs. Japan’s military was restricted after the World War so they concentrated on economic development.
And you also made a good point with regards to Germany. Incidentally, the two countries (Japan and Germany) produces the world’s best cars.
Before the ww@ the brand name in Europe was ‘Made In Great Britain’ after the ww2 the barand name in Europe was “Made In Germany’ why because the British were bankrupt through having to install a British Army in Germany for more than 25 years – before ww2 the British had a very large car manufacturing industy – now the British make zero cars – all German & Japan made autos. Very true, and reason why the Japanese are not happy about Abe’s decision to create the MJinistry of Defense of Japan presently, and reason why the public’s attention is on the said ministry. Actually, Japan can very well afford to build and improve her military defense in she wants to. Of interest is China that has now close to 3 million strong army. Add to this is her economic wealth that keeps stronger. If you have a strong economy and military, what’s next? Soon, no matter how the West try to maintain a balance of power in Asia would be hard to do. And the Philippines…well, she will remain to be a pawn…by whom, depending on the circumstance.

Cotabato City – The Bangsamoro Development Agency (BDA) strongly condemns the order issued by the Task Force Thunder Chief Brig. Gen. Juancho Sabban to implement food blockade in Basilan which will inevitably put the community people into a state of hunger and starvation. The BDA is a project implementing organization tasked to determine, lead and manage relief, rehabilitation and development projects in the Conflict-Affected Areas (CAAs) of Mindanao. Its creation is a result of the Rehabilitation and Development Aspect under the Agreement on Peace of 2001 signed between the Philippines government and the Moro Islamic Liberation Front (MILF).
Therefore, BDA as development partner in PEACE calls on the Philippine government to spare the civilian populace in their attempt to put into justice the beheaders of the Marines killed in action in an encounter last July 10 at Al Barkah town in Basilan.
Last August 5, Gen. Sabban directed an order which sought to prevent the food assistance from reaching the affected communities who have fled their homes for fear of getting caught in the pending firefight between the Armed Forces of the Philippines (AFP) and the elements of the Moro Islamic Liberation Front (MILF).
BDA has been closely monitoring the plight of the Internally Displaced Persons (IDPs) in the area since last month which reached to 12,000 individuals. It also undertook series of consultation with other Non-Government Organizations (NGOs) in order to help resolve the needs of the IDPs.
“It is not correct for these people to pay for the crime they have nothing to do with”, said the BDA Executive Director Dr. Danda Jaunday. Juanday also expressed deep concern over the possible implication of this act saying that it may engender hatred among the affected populace.
He said that it may send wrong message to the people of the affected villages. “They may take this as a form of oppression. Eventually, this can inflame the animosity which has been lingering for years between the Philippine government and the Moro communities”.
Now that the possibility of war outbreak has been successfully thwarted by the strong resistance from both local and international communities, the issue of oppression perpetrated against the Bangsamoro people should find its way to closure. The Bangsamoro has strove and fought hard just to preserve its own culture and way of life in accordance with Islamic teachings.
It is just unfortunate that the Filipino people cannot understand why there is such a front designed to fight for the right of the Bangsamoro. They regard the Bangsamoro people as weak. This is the sole reason why until now the Bangsamoro communities are still in a state of war against the Philippine colonial government. (BDA News and Information Bureau)
On the contrary, sabi ng mga na-interview naming mga pilipino who survived WWII, maganda daw ang ugali ng mga pilipino before the war. Kahit mga taga-Manila, matitino—walang masyadong magnanakaw at mga putatsing, etc. Sumama daw ang ugali dahil pinawili ng mga kano, etc. Hindi puedeng isisi lahat sa mga kastila ang kasamaan ng ugali ng mga pilipino. Why mindanao is the election capital of the Philippines, mostly are illiterates doesnt know how to write, so they will not vote..board of electoral canvassers are not teachers mostly are relatives and friends of the politicians…and if there is a war against the mnlf and milf, these group will not cast their votes as well as their supporters…

Sinabi mo pa, Gokusen. I actually hate the state of illiteracy in the Philippines. It’s amazing how the Americans could leave the Filipinos without making sure first if they understood democracy or not, or if they could really run their country the way they were supposed to.
Over in Japan, the Americans actually made sure that Japan would not engage in war again, and one of the laws promulgated and passed under US supervision is on giving all Japanese ample education to be productive. A compulsory education law and a law to insure that all children in Japan are sent to school by the time they reach school age were passed in 1949. In short, education has been made mandatory.
Nur Misuari, a UP scholar, should in fact have set the example to provide education to his fellow Moslems even just in his hometown, leaving no one an illiterate like those whose votes have been tampered with in Maguindanao because they cannot read nor write. Tapos ang yabang ni Unano and Dayana Zubiri!

We could go on forever discussing this one but suffice to add that another good reason may be the difference in discipline and a sense of perfection on the part of the Japanese are unlike those of most Filipino, some describe as relaxed.

Sinabi mo pa, Gokusen, but you’ll be surprised to know that even in the Bamboo Curtain, Islam and Christianity thrived. There are indeed Moslems even in Red China.
It makes me wonder if it is just US propaganda that has made us think that there are no Christians, etc. in communist countries like China and the former USSR. Mas hindi nga religious iyong mga kano at mga ingles, sa totoo lang kahit maraming simbahan sa bansa nila.

There are Muslims in China (North Western) but are being suppressed by the Chinese government. As we speak, there’s another boiling spot going on in Tibet which has long been wanting to separate. Two Canadian activists are among those arrested.
On the contrary, there is more religious freedom now even in Beijing according to my friends there as long as they do not mingle too much with the Americans. 😛
In fact, just the other day, I met a Chinese missionary of our church in Red China at our temple in Oakland. She told me that she was baptized in Beijing and opted to study at Brigham Young University in Hawaii when she was called on a mission.
Time pa ni Mahoma ang sinasabi ninyo. Apparently, the search for truth and knowledge of God is something that evil men cannot really stop and kill. Kahit sa Japan, during the Shogunate era, bawal ang kristyano, but even after the closure of Japan to outside contact, those who were converted by Francis Xavier, et al, remained faithful and worshipped their God in secret. Mas maganda nga ang challenge nila as a matter of fact. Less hypocrisy hindi katulad noong criminal sa Malacanang who pretends to be holy pero impakta naman. Right, Chi?
