Court denies Trillanes motion to perform duties as senator

Judge Oscar Pimentel of the Makati Regional Trial Court today junked for “lack of merit” the motion of Senator-elect Antonio Trillanes IV for leave of court to be allowed to attend Senate sessions, hearings and investigations.

Pimentel likewise denied Trillanes’ related requests to be allowed to set up a working area in his place of detention at the Marine Brig at Fort Bonifacio, Taguig, to give interviews to members of the media and to receive the press on Tuesdays and Fridays.

In his 11-page ruling, Pimentel said he was “not been persuaded by the reasons given by accused Senator Antonio Trillanes IV.

Trillanes’ lawyer, Reynaldo Robles said the young senator is “disappointed” but is “hopeful” that Pimentel would ask favorably on the motion for reconsideration that they will be filing immediately.

Robles said they will also be filing for a petition for bail that is supported by 18 senators.

In dismissing the omnibus motion filed by the detained lawmaker the court based its decision on an earlier ruling of the Supreme Court (SC) in the case of Martinez vs Morfe SCRA 37 and the recent case of People Vs Jalosjos (324 SCRAA 6890 concerning a similar petition filed by former Zamboanga Del Norte governor Romeo Jalosjos when he won a seat at the Lower House despite his conviction for statutory rape filed by a 12 year old child.

Quoting the High Bench ruling in the martinez vs Morfe case SCRA 37, Pimentel said “Allowing accused-appelant to attend congressional sessions and committee hearings five days or more in a week will virtually make him a free man with all the privileges appurtenant to his position. Such an aberrant situation not only elevates the accused-appellant status to that of a special class, it would also be a mockery pf the purposes of the correction system.”

Pimentel added that in the Jalosjos case, the High Bench ruled that the “voters in his district elected the accused-appellant to Congress, they did so with the full awareness on his freedom of action. They did so with the knowledge that he could achieve only such legislative results which he could accomplish within the confines of prison” so Trillanes cannot invoke the former in his petition.

With respect to Trillanes’ request to be allowed to set-up a working area in his detention cell and other related requests, Pimentel likewise cited the SC’s ruling on the Jalosjos case in junking the former’ petition.

The SC said then that no less than Jalosjos admits that he is, like other members of the Lower House, provided with an office at the Batasan Complex manned by a full complement of staff paid by Congress and that the prison authorities erred in providing him an extension office at the New Bilibid Prison in Muntinlupa. “Being a detainee, accused-appellant should not even have been allowed by the prison authorities at the national penitentiary to perform this acts,” said Pimentel.

He also cited a recommendation from Armed Forces chief General Hermogenes Esperon that also opposed such requests citing the need to maintain the apolitical nature of the military.

“While we have always professed non-obstruction in any manner, of the election and the actual performance by him of his duties in accordance with his popular mandate, we cannot, however, allow a political office to be established inside a military installation/detention facility as a measure to insulate the organization and its members from political partisanships,” said Esperon in his letter to the court dated July 19.

Pimentel said that the “prosecution, the accused, the Court and the defense have already reached a consensus last June 7 that the accused will only be allowed access to the media up to his proclamation by the Commission on Election (Comelec).

In his omnibus motion, Trillanes has argued that he be allowed to attend Senate sessions along with his related requests saying that the people has already spoken by electing him with 11, 138, 067 votes which landed him in the 11th place in the Senate race and that it constitute an expression of the popular will and sovereign decree of the people.

He likewise argued that allowing him to attend the session would enable him to perform his legislative function.

Trillanes also said there was “double standard” in treatment as he cited the case of former ARMM governor Nur Misuari who was allowed “house arrest” even while the trial of his rebellion case is ongoing as well as being allowed to travel to Jeddah Saudi Arabia to attend the tripartite meeting of the Philippine government, the MNLF and the Organization of Islamic Countries, the case of former President Joseph Estrada who was likewise allowed to be detained at his Tanay estate and that of Senator Gregorio Honasan who was allowed to post bail with the Department of Justice (DOJ) eventually dropping the case against him for lack of evidence.

Honasan and Trillanes were both charged with coup d”etat for their participation in the 2003 Oakwood mutiny.

The DOJ through Assistant State Prosecutors Richard Anthony Fadullon and Juan Pedro Navera said granting Trillanes’ request would smack of “preferential treatment” and that his election does not exonerate him of the crime for which he is charged. They also argued that the lawmaker is facing a non-bailable offense.

Reached for comment, Robles said they are still studying the option available to their client adding that they would appeal the ruling. Fadullon for his part reserved his comment until after they got a copy of the court’s decision.
Aside from the coup d’etat charges, Trillanes is also facing, along with 30 other junior officers, charges of violation of Articles of War 96 (Conduct Unbecoming of an Officer and Gentleman) before a military court martial

  1. Pimentel could have been talked to by the squatters in Malacanang.

    Our justice system is not exactly the most transparent or the most corruption-free justice system.

    If really, nothing can be done because some of our justices in regional trial courts are held by the “batok”, there’s still the 11 million voters who could make the difference. After all, people power seems to have been invented partly in the Philippines for the purpose of nullifying this highly unjudicious justice system as when folks trooped to Edsa (1) because they felt Marcos courts weren’t being judicious during the election pitting Cory against him.

    Time to get cracking again, I say!

    After this legal wishy-washy had been exhausted, i hope that the good Senator Trillanes will have the guts to call AGAIN the people to exercise their inherent right to remove a government that, aside from not having a clear mandate, has become too oppressive and deceptively abusive.

    Nakakainis talaga!

    As you know from the very start, I had my reservations about Trillanes because of his Gringo connection but when he decided to run for a Senate seat, I was all for it – that to me was important because a national election would be a referendum of sorts.

    I’m a strong proponent of national referenda because to me, a referendum is an ultimate gauge of people’s will re a thorny national issue.

    Trillanes was elected by a resounding, unified voice of 11 million voters. While there are certain legalities to consider, I do believe that the courts in this god-forsaken country should hugely consider the people’s will – they expressed it in a referendum of sorts. Going against that will is tantamount to violating that popular and democratic will of the Filipino voters.

    Our Davide-led SC when they pronounced that Erap had constructively resigned said they were doing it for the people – so why can’t our justices delve into that too? And to think that all in all, I would estimate the people who went to Edsa to witness the rape of the Constitution by Gloria as no more than half of the voters who voted for Trillanes!

    Consider this rough crowd estimate methodology: 3 persons per square meter… How many square meters or miles or kilometers was the Edsa perimeter….

    Hindi ba nai-cite dun sa motion nila Trillanes na until now eh ‘He is still innocent’ kumpara dun sa kaso ni Jolosjos na convicted na, which I think is very important to give merit to his request. Also aside from citing the case of Senator Montano. Kailangan siguro next time isama na yung resolution ng Senado na mabigyan ng pagkakataon na magampanan ni Trillanes ang kanyang national duty. The Senate and the Court has an equal status.

    It’s another black eye in our judiciary. I don’t think we would ever get justice under this evil regime. Trillanes could go up to the Supreme Court and hopefully get a more fair decision. I think it’s time for people to go out in the street and show their disgust over this ongoing persecution of one duly elected member of the Senate.

    Is this Pimentel eyeing a higher position- like Justice of the Supreme Court? or Court of Appeals? He has to kiss the
    — of the panggulo to get this and once appointed this is for life..and will retire as such. An 11 page decision and his signature he thinks will make him great. He has made his decision..we, Filipinos, who love the Phil. the land of our birth..the country we consider home (though we may live somewhere- our heart is still there) and we who love that country have not decided and responded to this decision..Are we just to take this without a fight? are we just to accept this quietly and say..anong magagawa ko..ang sabi ni Pimental ganoon eh? Nasa atin na iyon…pero mayroon ba tayong magagawa…we can do a lot of things…together we can pray for Sen. Trillanes to be allowed to work..after all 11 million of us voted for him..we can rally for this cause all over the world…wherever we are…calling all those who oppose this administration…let us GO together, united, man to man..shoulder to shoulder..bolder and bolder as we go to the fore…Sen. Trillanes, ask not what you can do for us, but ask (and you will receive) what we can do for you…

    Now I understand… gusto niya na magretire with a decision the people will long remember him….it will be a case to study for law students and lawyers to be…and a decision like this would be long remembered and cited in future cases..he has just planted a seed of injustice. And come to think of it one of the readings today at mass…was the parable of the mustard seed and the parable of the yeast.. this seed Judge Pimentel planted should not be allowed to germinate and grow…we should stop the growth…Judge Pimentel is the sower but we, the workers should weed it out before it grows in our dear Phil.

    I first read the line of arguments of Judge Oscar Pimentel in denying the motion of Sen. Trillanes to attend Senate session from a published statement by Sen. Miriam Santiago immediately after Sen. Trillanes was sworn in to office. This decision is largely suspect and I think the Supreme Court is again the next course. But if the Supreme Court will again deny Sen. Trillanes right to perform his duties, it will be inviting the 11 million Filipinos to seek the ultimate and last resort.

    And as Sampot says at 8:52pm,
    Lead us Senator. Call your people, Sir, and they shall come.

    The more I think about Senator Trillanes being denied to perform his duties as a Senator by the Makati RTC, the more I tend to get angry.

    I read in the web of the Philippine Daily Inquirer that Judge Oscar Pimentel said that “It’s 85M Filipinos vs Senator’s 11M votes.”

    Is there a more idiotic statement than this ?

    The logic of this Judge from the Dumps sounds like that of a Malacanan lap dog.

    Judge Idiot should be fried !

    The former President Estrada announced that he’s providing millions to the families of the slain soldiers as well as free scholarship to the children. The move came after Malacanang has not done anything to ease the plight of the families of the soldiers. Upon learning this, the Palace immediately ordered the ban and confiscation of Estrada’s cell phone to stop him from speaking to the media and helping the people. Here you see one in power not lifting a finger to help the families while the one in jail is trying so hard to help.

    In fairness to Sen. Miriam Santiago, she’s an expert in international law. Setting aside our dislike for this woman who’s very close to the evil in the Palace, it’s an honor for our country if Santiago is elected. Her resignation from the Senate once she gets the post also benefits the opposition. We may no longer see this loud mouthpiece of Malacanang.

    The announcement of Erap to help the families of the slain marines must have been prompted with the circulating text messages purportedly from the soldiers:

    When 2 Israeli soldiers were kidnapped, Israel bombed Lebanon; When Thailand soldiers were killed by militant muslims, its armed forces retaliated with full force and killed many militants. In the Philippines, when the MILF killed and beheaded the Marines, urong sulong, laban o bawi at puro porma lang si Gloria at Aspereon. At walang tulong sa mga naulila.

    much as I want for Pinas to have the higest, most distinguished honour of having a Pinay or Pinoy in the International court of justice, my worry is mapapahiya lang tayo if she keeps going balimbing on her decisions the same way she does in Pians – in the end, I don’t believe that “it’s an honor for our country if Santiago is elected”; if she becomes a sitting member and decides to push the accused in her court to suicide or if she threatens to jump out of planes if she doesn’t get her way, imagine or if she goes around plastering her office with her picture wearing shorts, gosh! That would be definitely dishonour, don’t you think.

    You do have a point, AdeBrux. But to my mind, that’s one good way of making the overly depressed Miriam to leave the Senate.
    I would prefer that she messes up in the international scene than making noise at the Senate that’s detrimental to the opposition’s cause. Likewise, if Miriam becomes the clown in the international court, that would reflect on the presidency of this country who nominated her. Then, we have two clowns being laughed at by the world.

    However, as far as “habang tumatagal si trillanes sa kulungan, lalong lumalabas na siya ay isang martyr.” it’s Gloria who should be very cautious if truly Trillanes becomes a martyr. If that becomes true, Gloria will have a serious problem – the military might be easier to cajole to join the ranks of the “revolting” civil component of the society/

    Judge Pimentel ruled that Sen. Trillanes will not be allowed to perform his duties as senator. He was jailed because he asked for reforms in the military..now they don’t want him to help the military? Kawawa naman ang mga sundalo. Hindi lang sila mamatay sa labanan pati ang familia nila ay papatayin gutom samantalang ang mga general nagpapalaki lang ng kanilang baya..d sa pag upo. Ang saklap!
    Si Erap nagbigay kaagad ng tulong para sa familia ng mga namatay na sundalo. Just because he gave his help prior to Malacanang’s help (who I don’t think is concerned at all in helping) they will confiscate his cell phones so he can’t call the media. Ano ba naman sila.
    BTW- Sen. Miriam was given a TOYM award. Ang pagkakaalam ko TOYM- is Ten Outstanding Young Men…bakit lalaki ba siya? Bakit siya nakatanggap. Baliktad na nga ang mga katwiran sa atin.

    If it’s true that Judge Oscar Pimentel said that “It’s 85M Filipinos vs Senator Triannles’ 11M votes”, he got it all wrong. The 11M votes is part of the 85M Filipinos, 45M are the supposed registered voters and less than 70% voted except in Maguindanao which was 99.9%.

    Judge Pimentel should have asked the survey makers first to come up with the people’s pulse on their perception as to whether Sen. Trillanes should be allowed to attend his Senate duties or not. Then his statement should have a some basis.

    The best solution to end,these endless suffering of the majorities,UNIFICATIONS of good civil societies and uniformed services, to tackle these ALIENS.Where in the world of vocabularies,Convicted of RAPE and alleged “Mutiny Plotters”,(not coup d etat) are similar situations in comparisons.Alleged means not proven quilty,” MUTINY” by logic definition was small rebellious act of sentiments expressing grievances against certain individuals,groups and organizations,it means not like Coup w/c a large stage of secret planning to grab of power.That’s why the court martial can’t figure it w/c of those soldiers to be charge, They can not charge “Rebellion nor Sedition”,due the soldiers does’t use forces or tried to occupied any gov’t intstrumentalities.Yet the judge basis his decision on previous SC ruling from convicted rapist and national blibid prison, compare to ‘alleged mutiny and military stockades w/c means not populated of hard core criminals. I think I have to wake up somebody to end this problem.

    To our understanding, the 11M votes for Sen. Trillanes has a multiplier effect. At first, those who voted for him believed that the charges against him are not true and he should be freed. After he was sworn in as a duly elected Senator, his followers is not only just his original 11M voters. He became on overnight sensation because of his phenomenal victory and that alone created a bandwagon effect with more believers on what he stood for during the Oakwood Mutiny. His strong statements on issues are in the news and the attention he’s getting thru media are the envy of the more popular political figures.

    We just wonder why Judge Pimentel failed to see all these.

    On the average, the Filipino household is composed of 4 members in a family. In all probability, there’s a voter in a family, the 11M votes is therefore translated to 44M Filipinos. It constitutes more than half of the entire 85M Filipinos, it’s the majority and the majority rules. It’s not just 50-50 or the 7-7 votes of the Supreme Court justices in the case of Koko Pimentel junked TRO.

    Check out this Pimentel. After retirement nasa Forbes na siya or if he has children going to school, sa Harvard at Oxford ang susunod na enrollment. It is very sad that the Philippines has gotten to a point where the judiciary and even the legislative bodies make decisions and laws backed by money or a higher position. It is soooo rotten!

    Mandela was imprisoned for 27 years and when he got out he became the President! Trillianes is still young and he has the time. This Pimentel, isang bulate na lang ang hindi pumipirma sa death certificate niya. It is so sad that people like him who can really make a difference to the country chose to follow the unpopular route.

    Pimentel should go back to school to learn math!

    1. Trillanes defense lawyer argued that Nur Misuari, charged with rebellion, was allowed to campaign and travel to the south. Judge Pimentel countered that Trillanes has no knowledge of the actual facts of the case. Is that the kind of argument a Judge could only give?

    2. While we are all discussing about Trillanes fate, Mikey and Iggy Arroyo have been given very powerful committees to lead in the Lower Chamber.

    Re; goji;About Madam BRENDA,I rather not have an HONOR in the Interanational Court,than to have UNHONORABLE PERSONALITIES,representing our country.A tainted personalities should not be nominated or appointed in the international positions.Yet she might be qualified for some extend of her experiences and interpretions of laws, but what about character and psychological evaluations.This types of appointment or nominations should never occured in any occassion,due it will drag us more embarrssment in the international limelight.The first gov’t officials I’ve heard,she would jump from the planes while 33k.ft.altitude, I’ll do believe her if she proved it,next shoot herself.Those people eager to get that post will bring it everything out in the open.There is no CA in the INTERNATIONAL COURT,to collect and appointed.

    Thanks Nick. We can cite so many cases and individuals worse than Trillanes but it all goes down to one thing: If you’re an enemy of Malacanang, you’re treated as the worst criminal.
    But if you bows down to Malacanang, you can be set free like a bird. Under this Arroyo regime, selective persecution has been the her policy from day one.

    What justice can a citizen achieve under a corrupt leadership expect although, The Constitution provides for the independence of judges, however, in practice the Pandakikay controls the courts closely at all levels, selecting judges primarily for her political reliability. Constitutional safeguards are significantly lacking.

    They are afraid of Trillanes,They maybe gave instruction to the judge how to rule on politically on his cases.   55. Wow, nag-cite ng example ang korte ng Pilipinas, mali pa. They should have compared the case of Trillanes with the criminal calling herself “President of the Philippines.” At least, Trillanes was voted by 11M Filipinos who had campaigned actively for him and on his behalf because despite the fact that Comelec approved his candidacy, he was not allowed to campaign properly to introduce himself right to the voting public. Their mandate in fact should have been given weight more by the judge.

    Jalosjos, on the other hand, won not the way Trillanes won the election but reportedly by buying votes as in the case of the victory of an incompetent candidate in Negros or even that non-native Bicolano winning in a Bicol town.

    In short, the judge of a kangaroo court in the Philippines has done the Filipinos a great disservice by not granting Senator Trillanes what he has asked the judge for to enable him to fulfill his duties and responsibilities as their senator. But what can you expect? Over in the Philippines, they have silly laws that allow a criminal to run the government like hell, including the courts that should have been dealing severely with such criminal instead of listening to her, her cahoots in the Senate, who are senior citizens who should have retired by now instead of trying hard to be niched in the hall of the infamous!!!

The election last Sunday proved to be a referendum against Abe, who wanted to militarize Japan even against the people’s will as we believe that Japan is prosperous because it has not engaged in any open fighting in any war, including the war on Iraq, since WWII.

    I voted for the Minshuto, which won the election and has promised to oppose Japan’s participation in any war instigated by the USA, etc. Yup, I was able to send my vote by mail from the USA. Absentee voting by overseas Japanese are sent by mail to the ward office or city hall where we are registered. That’s what we call Japanese efficiency. Hindi pa magulo!     If I’m not mistaken, our judiciary or court system is patterned after that of the West or the US. Canada might have patterned hers to that of the British. I’m just wondering if we could have our own system different from other countries. While admittedly other countries have better system, I think it’s the implementation that’s more important. Comparing other country’s to us is like comparing apples and oranges. What is good for another country is not necessarily good for us. Even if one is proud of his adopted land, our own system no matter how defective should be respected. It’s similar to attacking the government as an institution when the problem lies on the people running it; not the government per se. In the final analysis, we have good system and too many laws but incompetent and corrupt officials running it. A complete overhaul and a change from top to bottom is imperative. And that means the first thing to do is to remove this present illegal occupant of the Palace.

    Judge Pimentel position was law based on judicial decision and precedence rather than legal statues and on the merit of compassion. And to my opinion Here’s what a case law is and how it is formed his decision. When a person appeals his case, a judge’s decision, it sometimes will make its way to the highest court, the Supreme Court. If the Supreme Court deems the initial trial judge to have made a mistake when rendering his judgment or if they feel the defendant was not granted a fair trial the Supreme Court will overturn and reverse the initial trial judge’s decision .It isn’t a law so to speak, but rather it is a ruling a higher court has ruled upon and the lower courts must follow it. It is used as sort of a guide the lower courts will follow.

    In Trillanes case, Judge Pimentel adopted his ruling on the case of Martinez vs Morfe from the supreme court. If the judge overturned this ruling and granted Trillanes motion. What about the child rapist Jaloslos? He can appeal his case to have the same grant of motion.They have both the same appeal motion and similarities. However, If Trillanes was granted bail he can have that free will.The way I look at it, the only chance he can attend a Senate hearing is by bail, have his case withdrawn or he can prove that he is not guilty as charged.But,how long before the court will have a trial on his case? Trial date postponement kills a lot of days,months or even a year and this is allowed in court with a valid reason.The trial will be postponed if the prosecutor inform the court that he can not proceed the trial because his wife beat him badly with black eye,the court will postpone it for another date,until 6 years Trillanes term as a senator expired and he no longer a senator when he get out in the slammer.

    Honasan case was purely political maneuvered. He probably made a deal because he knew that even he win in the election his senate seat is in jeopardy. The case attributed to him was withdrawn by the prosecution. So, he is on his own free will.

    Judge Pimentel is just doing his job and I am not prejudicial with him that he is bias. It is so happened that the court is under the command of the despotic regime of Arroyo. Even Trillanes will appeal his case to the Supreme Court, the verdict will be no difference. The judge did not made any unethical behavior on this case for the reason on appeal.
