Scenes from last Friday’s hearing in Tanay
Nang paiba-iba na ang desisyon ng court martial panel sa hearing noong Biyernes ng kaso nina Maj. Gen. Miranda at 27 pang mga magigiting na opisyal ng military na sangkot sa Feb.2006 withdrawal of support kuno kay Gloria Arroyo, sabi ni Ces Drilon ng ABS-CBN, “para palang lastiko ito.”
Sabi naman ng isang reporter,”Laban-bawi nga e.”
Mula naman talaga ng simula, nakakalito na ang interpretasyon ng batas ng mga miyembro ng court martial panel. Ngunit ang pinakagulo ay nang dumating na sa punto na si Lt. Col. Custodio Parcon na ang may oportunidad mag-challenge ng korte.
Sa court martial kasi, dalawang klaseng challenge ang binibigay sa akusado. Isa ay ang tinatawag na “peremptory” challenge. Ang isa naman ay “challenge for cause” o kailangan ka magbigay ng rason.
Ang peremptory challenge ay minsan lamang magagamit ng akusado samantalang ang challenge for cause ay maa-aring gamitin ng ilang beses habang dinidinig ang kaso.
Nakalagay sa manual ng Articles of War na maaaring gamitin ang dalawang challenge kahit kailan sa trial. Maaaring sa simula, sa gitna o sa panghuli ng trial. Nang tinawag si Parcon, sinabi niya na gusto niyang gamitin ang kanyang peremptory challenge kay Rear Admiral Emilio C. Marayag na dapat ay kasama sa panel.
Ang pangalan kasi ni Marayag ay nakasama sa letter-order ni AFP Chief-of-Staff Hermogenes Esperon kung sino ang naka-assign na mga alternates sa court martial nina Gen. Miranda et al.
Ngunit wala si Marayag sa trial noong Biyernes sa Camp Capinpin siya ang commander ng Naval Forces sa Western Mindanao. Kailangan siya sa Zamboanga dahil pumunta doon si Gloria Arroyo.
Pumayag naman ang korte .
Nag-recess sila. Nang bumalik, iba na ang opinyun ng panel. Kapag hindi raw ginamit ang peremptory challenge ngayon, ibig sabihin “waived” na o ayaw na ng akusado ang kanyang karapatan. Balitaktakan ng mga magagaling na abogado ng mga akusado.
Ngunit walang paki-alam ang panel. May sarili silang interpretasyon ng batas. Kahit despalinghado, pinipilit nila. Denied ng denied.
Pina-alaala sa panel ng abogado ni Parcon na pumayag sila bago mag-recess. Sinabi ng panel, nag-iba na raw ang isip nila. Overuled raw ng nakakarami ang desisyon ng miyembro nilang abogado bago mag-recess. Ganun lang.
Napilitan tuloy si Parcon na gamitin ang kanyang peremptopry challenge laban kay Sodusta.
Habang nagsasalita pa si Frank Chavez, abogado ni Miranda, pabastos na nag adjourn ang panel at umalis na. Pahabol ni Frank Chavez, “Hindi ko alam kong nararapat kayong tawagin na ‘kagalang-galang.’”

Those guys should be charged for violating Articles of War re conduct unbecoming an officer and a gentleman, not only for making bastos to Mr Chavez but also for changing their mind in such ungentleman and un-officer like fashion.
Sila ang dapat ma-charge! Mga BASTOS!

I understand he does his daily exercise. But I can imagine the mental and emotional that they have to carry.
There were several changes in the composition of the panel in that one morning last Friday.
The first line up were Lt. Gen.Cardozo M. Luna, Col. Maria Aleido (law member), Brig. Gen. Salvador Collantes,Brig. Gen. Rolando Capacia, Commodore Fortunato R. Sagudo, Jr. and Col. Manuelito G. Dahan.
When Luna was challenged by Querubin, he was replaced by Maj. Gen. Michael Mendoza, who was challenged by Col. Januario Caringal.
Next was Maj. Gen. Cyrano Austria who was challenged by Col. Armando Bañez. Next was Maj. Gen. Jeffrey Sodusta, who was challenged by Col. Custodio Parcon.
When it adjourned, the one who was acting as president was Brig. Gen. Collantes.

Meanwhile, sabi mo, “Sinabi ng panel, nag-iba na raw ang isip nila. Overuled raw ng nakakarami ang desisyon ng miyembro nilang abogado bago mag-recess. Ganun lang.”
Anong klaseng court yan? At iyang mga walanghiyang miyembro ng panel ni Esperon ang may say sa life and death ng mga outstanding officers natin na nakakulong?
Anong namana kagaguhan ang iniimbento ni Esperon?
Kaya siguro nag panic ang panel at nag sommersault sa desisyon nila ay dahil may tumawag kay Esperon para hingin ang payo nitong gunggong na general na pipitchugin!
Sige lang, mga defence lawyers, throw all the monkey wrenches in Esperon’s monkey court!
When a bit of order is finally established in this monkey court, dapat tawagin ng defence si Esperon par tumestigo tapos prituhin nila!
At kung hindi talaga duwag si Esperon, he will rise to the challenge and be called in to testify.
At ang miyembro ng panel, dapat mag file si BGen Lim at si MGen Miranda ng counter-charge for conduct unbecoming an officer and a gentleman.

It was really frustrating, Anna. I can imagine how it was with the wives and family members of the accused who were present.
In fact, so as not to be provoked, most of the officers read books during the trial or put on their I-pod.
That’s because in the hearing last July 17, there were two instances when some of the officers couldn’t contain their irritation, they were heard cursing. One said “P..I.” The trial judge advocate heard it and complained. The officer said, “It was not directed to you. I was talking to Col. Parcon about something.”
Hah!
Mas senior ba iyang trial judge advocate doon sa nagmura?
If not, ok lang yan. Turuan mo na lang ng Frances na mura ang mga officers para di malaman ng panel kung ano ang sinasabi.

Ay sus, madadagukan mo talaga ng mga miembro ng kangaroo court ni Asspweron! Masyado ng kawalanghiyaan sa batas iyang pabago-bago nila ng desisyon to suit the caprices of Gloria and Asspweron!
Suntukan na lang kaya, tutal ay wala ng kwentang dumalo pa sa hearing dahil may utos na hindi mababali buhat kay Gloria at Asspweron ang mga miembrong walang sariling paninindigan!
Sigurado ako na may utos sila na kung gumamit na ng salita appealing to emotions ang mga abugado ng accused “men of honor” ay magtayuan na. Iba ang emosyon pag nagsalita at pinakinggan sa ganyang klaseng hearing.
Sige, suntukan na lang baka meron pang mangyari!

They are both colonels but I think the officer is more senior than the TJA.
Ah, dapat pinaalala nitong officer na nagmura sa TJA to straighten up and to stop whining or leave the court na lang! Mura lang di niya masikmura?
The wives of these incarcerated officers, and I met some of them, should really be commended for taking all the beatings for the spouses. Talaga naman! this whole ordeal of being tried for no justifiable reason and worst, tried by no other than the worst cheats and murderers of the country really is more than a death sentence to these spouses! Imagine having to visit their spouses on a regular basis, coordinating the lawyers’ preparation for the hearings, finding the money to pay for the lawyers(although some of them may be pro bono), for fare or gas, tending to their families daily. It pains them to see their principled husbands rot in jail.
Keep fighting my dears! Yes, miracles do happen and I praying that your husbands will be free soon. The truth of the matter is, takot na takot talaga yang supot na asspweron sa mga nakakulong kasi alam nilang lahat ang baho ni asspweron! From aspweron’s election cheating operations to his death camps! This is the reason why aspweron is moving mountains to put these officers away so that he will not be judged harshly when the tide turns. Afterall asspweron wants to enjoy the ranches he acquired in Australia!
Why Peremptory Challenge plays an important role in court martial proceedings, the jurors who hear the case will be the one who render a guilty and non-guilty verdict to the accused. Court-martial members must be impartial and may make no decisions about a case until the military judge directs them to begin deliberations. Each side — prosecution and defense — gets a chance to ask the court-martial members questions to ensure that members are impartial. If a court-martial member’s impartiality is brought into question, or if it is otherwise inappropriate for that member to serve on the court-martial, the military judge will dismiss him or her. The prosecution or defense may also remove a court-martial member (peremptorily,) meaning without a stated reason. In military practice, both the prosecution and defense are afforded one peremptory challenge. A servicemember on trial may decide to have the judge decide his guilt or innocence, rather than court-martial members.
Once the court-martial members are selected, the case is ready to proceed on the merits, that is, evidence will be presented about the guilt or innocence of the servicemember. As with any civilian case, the military prosecutor (called a “trial counsel”) presents evidence on the charges. The accused on trial may confront this evidence and cross-examine any witnesses. They may also present evidence and, through the court-martial, compel witnesses to appear.
Matagal pa bago magkaroon ng linaw ang kasong ito,hindi pa pala nabuo ang court martial members to proceed. Hindi pa pala nabibistahan.
I wouldn’t want to imagine if the real terrorists, aside from Gloria, attacked?! Lahat ng magagaling, matatapang and experienced military officers and soldiers are encarcerated? Who would make them win?

grd here may have misled you! Ellen’s blog is in no way “nilalangaw”.
Hardly the truth.
Ellen’s blog is anti-Gloria through and through and those who are pro-Gloria or who believe that posters there (who include yours truly) are left-wing, NPA sympathizers or commies had better change tune before they start spewing pro-Gloria rhetorics or branding folks who comment there as NPA sympathizers, islamofanatics, etc.
Ellen has long laid down the rules of engagement in her blog. Those who cannot respect her rules are free not to join and not to post comment. Nothing wrong with that.
Needless to say, Ellen’s right to publish her thoughts, comments and whatever opinion in her blog, on which posters comment, who, btw, are far from being “idiots” as some people would like to think, is covered by the Bill of Rights.

The trite adage, “The road to hell is paved with good intensions” is beginning to surface here in Ellenville. The Trillanes phenomenon is being transformed into something that is not just a miracle but into the proportions of a myth. The Senator is becoming an idealized conception, being venerated and glamorized.
A classic example of this metamorphosis is Kung Fuzi (now called Confucius) Chinese philosopher whose Analects contain a collection of his sayings and dialogues compiled by disciples after his death. The sayings of Confucius show the principles and beliefs of Confusianism. Confucius was only concerned with man’s actions on earth — he did not believe in an afterlife. His basic rule was, “What you do not want done to yourself do not do to others.” (He predated Christianity) Positive that man was basically good, Confucius believed that men were led by example. In this situation, even defense attorneys find it difficult to measure up to the challenge of a seemingly “guilty-until-proven-innocent” standard. The rights of the accused at times seem secondary to everything else to Marayag. These court martial proceedings discussed the need to deal with serious emergency situations threatening prisoner soldier’s’ lives and their families’ sanity, with correcting some chronic wrongs within the dysfunctional, corrupt, and nearly paralyzed kangaroo court system of Esperon. This blatant tolerance by handpicked judges, will robs defendants of their right to a fair trial and worse has caused them to be wrongly convicted and sentenced to long prison terms.

A wide range of prosecutorial misconduct occurs: telling defense lawyer and denied his motion is, misstating the law, disparaging the defendant and his attorney, defying court procedure, and misleading. It is more likely intentional. Judges who turn a blind eye to their own misconduct should be held responsible for a practice with its own problems. Most defendants on this Kangaroo court are confused, fearful, and gullible. The charges against them are often frivolous or overblown through the false confession of San Juan and the rest of dirty dozen who saved own skin. The members of this court martial proceedings who typically are focused on mindless punishing these soldiers–which never has been a solution to their grievance — should not qualify and inhibit themselves to hear the case if they have some Delicadesa para walang disgrasya.
Ang langaw ay pumupunta kung saan mayroon pwedeng dapuan at kainin. Kung saan may pagkain na masarap ang lasa dahil sa iba-ibang rekado, tiyak nandoon ang mga langaw.

Please don’t confuse the case of Miranda, Lim, Querubin, et al with Oakwood. Miranda et al are being accused of attempting to withdraw support from Gloria on February 2006. Oakwood happened in July 2003.
Marayag will not be the defense lawyer.

Marayag will sit as a judge on the Kangaroo Court of Esperon to hear the case. He is not nether for the prosecution nor for the defense, he will sit as a juror. He need to realize that this is an important case for the accused, his presence in court is very essential to the ongoing case.He need to give a priority to serve on that purpose.
I am sorry! I come to realized after reading it twice that the case of Gen.Lim and the Oakwood were different ,my sincere apology. San Juan is with Magdalo. It is my mistakes and not to mislead.

Had it not for the media coverage particularly the continuing account of our gracious host/owner of this blog, the public will not be informed on what’s really going behind the trial of our brave but continuously incarcerated soldiers.

While it could be too much mulistiya from you, we would like to request if you can also post the pictures of the members of the court martial panel. Mabuti na rin yong kilala natin ang kanilang karakas. We will be able to recognize them when they go around at makasalubong natin minsan. We could tell them that we know who they are and the shameful roles they played just to please their bosses, Gloria Arroyo and Asperon.
I’ll try to see if we have that in earlier hearings. Cameras are not allowed once the hearing starts. That’s why if you notice the pictures we have were taken as they arrive in the trial venue, during breaks or after the trial.

Chabeli, it’s not true that Frank Chavez has not won a case. I know of two cases that he has won: one is the PEA-Amari case, otherwise known as the grandmother of all scams. He succeeded in having that anomalous contract declared illegal by the Supreme Court.
The other one is having court declare Mike Arroyo as “public figure”, not as a private person as Arroyo insists.
That’s only two that I know of. There could be others.

There are military lawyers standing ready for the accused. But so far the accused officers prefer counsels of their choice.

The incarcerated officers pay their own lawyers. Some lawyers are pro bono (not charging for even a penny) just because they believe in the cause of the incarcerated soldiers. But for the other lawyers, some of them have to even shell out 40,000 pesos for just the initial consultation. Then for every meeting and court appearances, anywhere from 3,000 or up just for their gas and time only. Some of the accused have four lawyers to cover all the aspects of their case although only one or two sit at the hearing. The preparation for each of the hearing is very involved. A lot of research go into these hearings.
So, the financial toll is high for these incarcerated officers. Some of their children have to even stop going to school. Although some help come from donors, it is never enough to pay for all the expenses incurred in this kangaroo court. Unlike the US and EU and some of the first world countries, most accused pay for their own legal fees in the Philippines.
If these accused military officers have their own private lawyers, where do they get the money to pay for the latter’s legal services. As parasabayan pointed out unless it’s pro-bono, the legal fees are huge. Atty. Chavez being an “abogado de camapanilla” usually charges high fees. Is he taking his military client’s case for free? Chavez did represent some controversial figures in the past. As lawyer, one is bound by his profession to take a case whether as private prosecutor or defendant. So, even if a lawyer knows the accused is clearly guilty of the crime he committed, the lawyer is obliged to defend this client but the fee could be very high. It reminds me of this Canadian Black who was recently convicted in the US. He has hired a very good expensive lawyer with a reputation of defending clients on appeal. He is described as the appeal expert lawyer in the US.

In some of the news reports, it was Wahab Akbar who seved kuno as negotiator for the ceasefire during that 9-hour seige. Accounts of some of the survivors said during lulls in the fighting, they thought a ceasefire had already been forged only to be confronted with more attacks from the MILF.
It was Akbar who retrieved the dead,mutilated bodies for the military. Di ba pasalamat ng husto ang gobyerno?
Atty. Chavez is a good lawyer and handsome (except for his not so smooth facial skin). BTW, I think he was rumored to have an affair with former actress Alice Dixon. If Chavez in single, who cares. I notice that he usually takes difficult and complicated cases especially involving human rights issues. He’s on the side of the aggrieved. I really wish he would run again for public office. He needs to make sure he belongs a credible and stable political party.
More on Chavez, if I’m not mistaken, I think he represented jueteng whistleblower Sandra Cam. I recall Chavez losing his temper during his argument with Sen. Gordon in one senate hearing. Chavez is like Rene Saguisag, combative and fearless. I think both served under the Cory Aquino administration.

Miranda Doctrine is the right of a person who is being arrested to remain silent, to legal representation and not to be compelled to say anything that would be self-incriminating.
Miranda doctrine does not apply in this court martial trial.
