DOJ blocks Trillanes from performing his duties as senator

DoJ execs cite Jalosjos case to oppose Trillanes bid

Sen. Antonio Trillanes IV cannot use the more than 11 million votes he received in the May elections to seek preferential treatment, like attending Senate sessions and setting up an office in his detention cell, Department of Justice prosecutors said Monday.

The prosecutors said they represented not only those who voted for Trillanes but also the more than 85 million Filipinos.

Trillanes, charged with coup d’etat for leading the failed Oakwood mutiny in July 2003, is standing trial at the Makati Regional Trial Court.

In opposing Trillanes’ requests, which included access to the media and meetings with his staff at the Marine brig in Fort Bonifacio where he is detained, the prosecutors cited the Supreme Court ruling in the case of former lawmaker Romeo Jalosjos.

The high court said that being in an elective post was no reason to free someone from prison or give him special treatment.

Jalosjos, a convicted child rapist, served as Zamboanga del Norte representative even while serving his life terms. His sentence has since been commuted.

While in detention, Trillanes ran as a Genuine Opposition candidate and placed 11th in the senatorial race.

Non-bailable

In an opposition filed with the Makati Regional Trial Court, Assistant Chief State Prosecutor Richard Fadullon, State Prosecutor Juan Pedro Navera and Prosecution Attorney Amanda Felipe noted that Trillanes’ case was non-bailable.

The Supreme Court ruling on Jalosjos’ case said there should be no special treatment for an elected official who is a non-bailable prisoner, the prosecutors said.

“The performance of legitimate and essential duties by public officers has never been an excuse to free a person validly in prison,” the high court said, as quoted by the DoJ. “Congress continues to function well in the physical absence of one or a few of its members.”

Popular will to serve

In his motion seeking permission to attend Senate sessions and official functions, and to set up office at his detention cell, Trillanes said his 11 million votes were an expression of the “popular will and sovereign decree of the people” for him to serve them as a lawmaker even while in detention.

He also asked that a personal desktop computer and appropriate communication devices, like telephone lines and Internet access, be installed in his room so that he could work there when there are no sessions. The cost of these could be charged to his office in the Senate, he said.

Interviews

The detained senator also asked that he be allowed to give interviews and air his comments, reactions and opinions to the media about important issues that affect the country while in the Senate or performing his duties as a lawmaker.

Trillanes said the request was “to help shape public policy and in light of the important role of the Senate in maintaining the system of checks and balances between the three co-equal branches of Government.”

Trillanes also asked that, with prior notice to the court and to his custodians, he be allowed media interviews in his detention center on Tuesdays and Fridays, particularly when there are no Senate sessions and hearings.

Media access stopped

His request for media access was denied.

The prosecutors said that they, the defense lawyers and Makati RTC Judge Oscar Pimentel reached a consensus on June 7 that there be no more media access to Trillanes after his proclamation. Trillanes was proclaimed on June 15.

The prosecutors said his requests were short of stating that a senator was above the law and would render ineffective the restrictions on him as a crime suspect.

“But while the prosecution recognizes his status as senator of the republic, he should also acknowledge that his new status will not and should not affect the proceedings in this case,” the prosecutors said.

They also said the Marine brig was a high security detention facility and not a civilian government office where staff members and assistants could freely come and go.

“Being a Marine facility, it is likewise doubtful if telephone communications and working furniture can be so casually arranged for just one detention prisoner and not for other detention prisoners,” the prosecutors said.

The prosecutors said Trillanes should not have been allowed to leave his detention cell even for short periods of time. He took his oath of office in Caloocan City on Friday.

    Preferential treatment ba to allow him to do his work? The more restrictions, they will put on him the more they will get the people’s wrath. Baka hindi lang si Gloria ma-revamp – bump off na siya sa upuan niya.

  2. Ang bobo naman! Jalojos was a convicted criminal. Senator Trillanes is just a suspect since his alleged crime is yet to be established.

    The Filipinos have decided on this case of Senator Trillanes. They want him out of detention and serve them in the Philippine Senate. The stupid DOJ Secretary himself should be put in jail for violating the election code in the last election, etc. He has no right to stop the Filipinos from wanting this long-suffering gentlemen to serve them.

    This threat and intimidation by these people at the DOJ should be stopped. Lalong nakikita ang kapalpakan nila. These abusive prosecutors should be disbarred just like what happened to the disbarment of a US prosecutor who abused his position in a still unproven case. Bobo talaga!!!

    Christ only needed his apostles and converts to pass around His advocacy and going strong still as great changes for the good are made. We are all his apostles and we can contribute much thru his assigns in his office in the senate. Sincerity as we are now must prevail and Senator Trillanes will succeed.

Lots of black propaganda and mud-smearing apparently has been the tactic to destroy reputations in the philippines. ok lang kung ordinary people lang ang gumagawa but government agencies into this kind of tricks actually do not help improve the image of the philippines as the country where the presidents are conceived as robbers and thieves, and therefore, ordinary people do the same things, too, since they are just emulating the examples of the crooks in their government.

    But Senator Trillanes, we know for a fact, is different, and so are the people who helped him in his campaign that was a test of faith, trust and endurance for many. It was a good experience in fact being able to help prop up the candidacy of one propagandized as a loser, but miracle of miracles, he ended up being victorious. If that is really not a miracle, what is? Kaya ingat si Gonzales, et al. Baka magaya sila kay Wycoco, and worse.

    These crooks should not challenge God who must have made it possible for Trillanes to win so he can do what is right and led his people to righteousness. Ang tindi talaga ng mga kampon ni Satanas, no?

Filipinos who voted for Trillanes have the final say on whether or not he should be allowed to do his duties and responsibilities as a Senator, not a DOJ Secretary nor a President (kuno) who have not been approved by majority of the Filipino people. Baka gusto talaga nila ng revolution.

    Hopefully, it is not part of a scheme to use the Philippines as an open group for US military exercises re preemptive attacks on Iran, etc. and Filipinos used as guinea pigs for ready targets in this military exercises. Kundi REBOLUSYON na! PATALSIKIN NA, NOW NA!

    Like it or not, the Filipino people want change when they elected Trillanes. The idea was not to elect an aggressive military man. What people wanted was justice, including social justice, less corruption and a better government. Pinoy wanted to get rid of corrupt traditional politician that were blamed for a pitiful standard living of the people who can’t afford to have 3 meals a day and only the affluent are privilege to that luxuries who’s kid become obese eating hamburgers at Mc Donald and Jolibee.

    Gloria’s government is weak to start with anyway, a stolen presidency not once, but twice. It is a government dominated by partisan rhetoric and personal interest.

    It was possible for Trillanes to get easily elected because of the extreme poverty and injustice. When one does not have the bare essentials to be able to live decently, democracy become totally irrelevant. These is the main issue on Trillanes case, if ever these DOJ’s has a little bit of understandings. He is not a convict, he was arrested and detained. That does not barred him from holding and office and work on his crusade.

    Before we bring the 11 million to EDSA, let us first examine what is really the main problem in our government. We might be repeating the same mistakes in the past. We kicked Erap’s ass, we installed a president that’s an inch taller to a tank of Gasul, We gave her the keys to our treasury, Jose Pidal deposited the money. She rule with unknown intention, surrounded by a cabals of corrupt. There self interest needs come first and the left over small slice of the pie goes to the people that they promised to serve. Her legislatures is simply a rubber stamp photo copy, her cabinet is an appointed group of sycophants, she continue to rewards kumare and kumpares and persecute enemies and tagging them as an NPA or a destabilizers and enemy of the states, people whom they need to protect and serve are disenfranchised and some are uncircumcised.

    These are the main vocal voice it needs to be address if ever we need 11 million people in EDSA.

    with today’s technology, there should be no problem allowing trillanes to be able to do his job as a senator even as a prisoner.just in our office here, i can have meetings with people 500 kms away.one can not understand how a govt for over 80 million cannot pay for this in the name of democracy.. there is also a big difference between a convicted criminal like jalosjos and one charged for one reason or another.

    Jalosjos, a convict, was given office facilities in Muntinlupa during his term. If we want this undeserved comparison stretched further, why is it very difficult to provide these facilities for Senataor Trillanes?

  31. Senators and Congressmen in fact do not have to be lawyers to qualify for the position even if they are called “lawmakers” whose job actually differ from lawyers.

    I have friends in the UK parliament for example who are not lawyers but are there to represent the people who voted for them. They are not stupid, though, because they were in fact scholars at Oxford U. They are actually friends of my foster father, who introduced them to me when I was a student there.

    And so are a lot many dietmen in our own parliament in Japan although the head of the Socialist Party of Japan which I support is a qualified lawyer with whom I worked with on the problem of the Japayuki in Japan.

    Laws in fact are supposed to be made on and with the inspiration of God, who knows best, not by corrupt individuals like this Dayana who wants to be a Senator even with daya votes. Iyan ang nakakasuka talaga!

    The Main Actors of the 23rd Feb 2006 Group are sick..and almost at the same time, they are requesting for “sick call” or writing their respective superiors for consideration for medical check-up? Gentlemen, this is again a scenario to remind the people that it is their 1st year anniversary in military detention and another reminder for the people to do something against the Administration during the commemoration of the Feb 1986 People Power.

    These officers are simply “whiners”. In simple terms, they are not sick! What they have are sick “brains”!!! What they need is simple exercises everyday and they have to watch their diet. They need to sweat and stretch their muscles. Better yet, read the Holy Bible for enlightenment. Send them psychiatrists/guidance counselors and spiritual persons/priests!!! But the ultimate best you can give to these whining officers is SEX…hahaha! (Not necessarily with their wives).

    Bedol is suspected of committing a crime. The police are not given any order to investigate him, just staged a moro-moro arrest to bring him to Manila, put a patch over one of his eyes to gain sympathy and make him look as a victim instead of a perpetrator of a crime. Wow! Now he is released and he can go home with hotel bills, transportation, etc. charged to the Philippine government. And a lot of people do not seem to mind it because of the truth that a lot many of them evade paying taxes anyway. Sabi nila, “hindi ko naman pera ang ginagastos, anyway!” Yuck!

    Kawawang bansa! Wala na bang katapusan! On the other hand, iyong pag-asa ng bayan, hindi daw palalabasin. So what’s next?

If we have to bring the 11 million bodies to the streets and protest- the demand should be to allow Sen. Trillanes to attend the sessions. And we should give Sen. Trillanes the opportunity to investigate. Let us first hear his side and issues. And when he summons all the accused like Esperon, GMA, etc. Let us hear their side. Kung puede nga lang all over ang demonstration- here in NY, gawin sa Battery Park sa harap ng Statue of Liberty..sa NJ sa Liberty Park sa likod ng Statue of Liberty..sa LA sa MacArthur Park, London sa Freedom Park, sa Tokyo (ang alam ko lang Yuko ay Hibiya Park) etc. An Impossible Dream? I don’t think so.
