Isinalang si Mike Arroyo kahapon sa witness stand sa kasong libel na kanyang isinampa laban kay Jake Macasaet, publisher ng Malaya at business editor Rosario Galang.
“Ang yabang ng dating,” sabi ng isang reporter na nandun sa hearing. Tatlo at kalahating oras sa witness stand si Arroyo.
Nagsisimula pa lang ang hearing, mainit na ang ulo ni Arroyo at may pagka-siga ang sagot sa mga tanong ng abogado ni Macasaet na si Atty. Paul Arias. Nakipagdebate sa abogado kaya sinabi sa kanya ni Arias, “Sagutin mo ang aking tanong. Hindi ka dapat nakiki-pagdebate sa counsel.”
Aba, napikon si Arroyo, tumayo at hinamon si Arias, “If you want, let’s settle this outside.” (Kung gusto mo sa labas na lang natin ito lutasin).
Hindi siya inurungan ni Arias na sumagot, “Alright, let’s settle this outside.” (Halika, doon tayo sa labas.)
Biglang nahimasmasan si Arroyo at humingi ng paumanhin sa korte sa kanyang asta. “I’m sorry Your Honor, it will not happen again,” sabi niya.
Ang kanya namang chief of staff na si Juris Soliman ang dakdak ng dakdak. Nagku-komento siya ng malakas kapag hindi niya nagugustuhan ang tanong ni Arias sa kanyang amo.
Hiningi ni Arias na palabasin si Soliman sa courtroom. Pinalabas nga.
Ang kasong ito, isa sa dalawang libel suit na isinampa ni Arroyo laban sa Malaya, ay tungkol sa artikulong sinulat ni Macasaet sa kanyang kolum na Business Circuit noong July 9 at July 13, 2004.
Tinanong ni Macasaet bakit hindi natulungan ni Arroyo ang kapatid na babae, si Rowena Junio, ng isang miyembro ng Presidential Security Group na may sakit na brain tumor na naka-confine noon sa V. Luna Hospital. Katatapos lang ng eleksyon noon. Di ba namamayagpag palagi si Arroyo na marami raw siyang charity projects.
Ikinuwento ni Macasaet na ng humingi ng tulong sina Junio sa Malacañang, itinuro lang sila sa Philippine Charity Sweeepstakes.
Nang lumabas ang kolum ni Macasaet July 9, kaagad may pinapunta si Mike Arroyo sa V. Luna para tumulong sa gastusin ni Junio. Sinulat rin ito ni Jake. Ang title ng kanyang kolum ay, “Thank you. Mr. Arroyo”
Sinabi ni Jake na ang askyon ni Arroyo ay pagkatapos lumabas sa diyaryo ang kaso. Sabi ni Jake, kung hindi kaya isinulat, magbibigay ba ng tulong si Arroyo? Sinabi pa ni Jake na sana matulungan pa ang ibang nangangai-langan kahit hindi maisulat sa diyaryo.
Aba, libelous raw yun, sabi ni Arroyo.

Arroyo also said that he gave P30,000 to then PSG Chief Delfin Banggit to belie Jakes’s first story that he didn’t extend assistance to the sister of Freddie Juno, the PSG.
He said that it was before the publication of Jake’s column. Yet upon cross examination, he said he didn’t specify for whom was the money.
In last month’s hearing the Junio testified that they didn’t receive cash for his sister, who has recovered from her brain tumor. All they got were medicines mostly from PCSO.

Absurd it really is. Puro pa-pogi lang and no action. Kapag napahiya na, that’s when they make their move. Charity comes from the heart, you don’t wait for people to beg but you give outright. I suppose Mike thought that its the PSG’s duty to protect them but what he missed or refused to understand is they owe the PSGs their lives.
To extend help to the one you owe your life to comes naturally. Its a small amount to shell out considering that they are not spending their own money anyway. In effect, they are like those congressmen who take credit for a new road or bridge which was actually built with the people’s taxes.

Seriously, I am so impressed by Atty Arias.
He was right to tell witness Pidal who is testifying and is on the wintness stand to answer his questions and not to argue with counsel.
That Pidal stood up to challenge Mr Macasaet’s counsel, an officer of the court right there in court in full view of other witnesses and before the magistrate is absolutely unbelievable.
But what does this Pidal think he is? That he owns the Philippines? Put***************na niya!

Speaking of Cesar Montano, the wind is now blowing in a different direction. I’m talking about Abalos who has given Montano an order to explain why he shouldn’t be disqualified for allowing the showing of the EDSA I documentary wherein he was narrator for the whole 3-hrs(?) length. It was shown for the THIRD TIME last Sunday, that after Comelec already said last week it was against the Election Code!
It comes to me as a surprise since Abalos has earlier given a 3-day deadline for Montano/Manhilot to tear down his giant billboards of product endorsements in the metropolis. It seems Montano will be a sacrificial lamb in case T.U.T.A. finally takes Kiko Cuneta into its ticket. Montano has become a nuisance of sorts, from his late filing/substitution, billboards, now this docu issue.
Ellen, it was Living Asia, the cable channel, which produced and broadcast the docu. Isn’t Living Asia a subsidiary of ABS-CBN? Maybe you can get us some inside info. Thanks.

Irked at being asked questions in the courtroom by the defense counsel of the Malaya newspaper publisher, Jake Macasaet, and Business editor Rosario Galang, during a hearing of the libel suit filed by the presidential spouse, First Gentleman Jose Miguel “Mike” Arroyo, under cross-examination yesterday challenged Malaya’s libel lawyer to a fistfight, instead of replying to the questions asked of him by the lawyer in a Manila courtroom.
Despite the presidential spouse’s uncouth behavior in court, the hearing judge failed to reprimand him, or even hold him in contempt.
Arroyo has always claimed, while filing numerous libel suits against journalists critical of him, that he is a private citizen, not a public figure. This claim is continuously made despite the fact that the courts generally defer to him, and treat him with kid gloves, and despite the fact that at least 100 presidential guards were in the courthouse and barred people from entering the courtroom, with the security making the decision on who can enter the courtoom.
In an earlier incident where Arroyo was also slated to take the witness stand on a case of libel he had lodged against reporters and columnists of the same newspaper, not even the respondents were allowed entry by the Presidential Security Group (PSG), blocking even the defense counsel’s entry into the courtroom.
After the presidential spouse’s direct testimony, he rejected the defense counsel’s move to cross-examine him, saying he was a busy man. The hearing judge ruled in Arroyo’s favor, dispensing with the cross-examination.
In challenging the libel lawyer to a fistfight outside the courtroom, the presidential spouse, irritated at being asked several questions by the defense counsel such as what Arroyo’s interpretation of malice and rumors is, among other questions, including arguing over the amount of money turned over to the PSG chief, Gen. Delfin Bangit.
The case stemmed from a column written by Macasaet on the First Gentleman’s inability to be concerned over the medical problems of PSG’s sister.
The hearing was held before the Manila Regional Trial Court branch 173 of Judge Rosario Cruz.
Less than five minutes into the presidential spouse’s testimony when he and defense counsel Paul Arias argued over the money that the First Gentleman turned over to former PSG chief Bangit, for the medical needs of his PSG.
Arias had warned the presidential spouse not to raise his voice or argue with counsel. But Arroyo, who appeared not to want to have him spoken to in this manner of questioning by the Arias, stood up from the witness stand seat, shouted at the defense counsel, and pointed a finger at Arias, and in a loud voice, threatened him, saying: “You cannot do this to me. If you want, we can settle this outside,” while starting to roll up his sleeves. Arias told him he was willing to oblige.

With a string of killings having journalists as victims, it makes one think that luck is on the side of journalists who are at the receiving end of libel suits. If it were not for luck, they’d be dead by now. Could it be that these dead journalists were also given the same challenge to “settle it outside”? I read an excerpt of Nick Joaquin’s account on the role of Mr. Arroyo in what we now know as EDSA II. He sounded so arrogant as if, EDSA II would not have succeeded had he not played his role. Shouldn’t he be charged of conspiracy to commit mutiny for his role?

This is the action of a person who’s lost his marbles. A lawyer called on the witness stand acting and speaking that way, challenging the defence counsel to a fight clearly shows that Arroyo the fat pig is on the brink of dementia – no more self control.
It seems the arrogant sod has become a victim of his own delusions of grandeur (figuratively and literally).

These lawsuits may be intended to create the chilling effect. We hope that Atty. Arias, and all the other lawyers, journalists (who manage to stay alive) will have enough strength to fight this (been trying to be respectful, he’s older than me, but I just can’t help it) PIG (my apologies to real pigs). I am convinced that these lawsuits are intended to create a chilling effect on journalists.
The First Pig has all the rights in the world to file lawsuits after lawsuits against anybody (even against a blogger, i.e., me) but he should make sure that (1) he is not spending people’s money to file those lawsuits nor waste the precious time of judges to hear his rants (2) he does not use the tools of state to achieve that (3) he does not cajole, influence, threaten, the law courts to give him an iota of advantage.

One trickk that the Pidals are playing on Filipino voters now apparently is to confuse them as when they make announcements of withdrawals of their pet candidates like the news on Pacman quitting the race even before the Comelec makes such official announcements. This is done to give Pacman the chance to go one with his fight this April and have it broadcasted even against the rule set by the Election Code of the Philippines. Tongue, yes Asian hospital is good. I was once confined there when I had diarrhea while I was undergoing chemo. Even their blanket is warm! I go there for my check up with my oncologist, Dr. Cecilia Llave. She is chairman of the PGH Cancer Institute. She is also accredited at Asian Hospital. Since I live in Las Piñas, it’s more convenient for me to go there.
It’s just unfortunate that Medicard, our company HMO, does not include Asian Hospital.

While logging into Ellen’s blog today, I experienced the same difficulty I had before when I would be totally prevented from getting in. May napansin akong URL (tecnorati.com) trying to monitor my logging in when it should have been just Ellen’s adminitrator. My adware is registering something and sending me some warning as a matter of fact that I never experienced before, so I guess the group or groups ordered by the Pidals to monitor loggers here must have upgraded their techonologies and try how to stop people from coming here or how to track them down even when they use aliases.
This is what we call hitting below the belt. Will check on the URL I was able to monitor, and give my report to Ellen later.

I’m not a lawyer and I have never been involved in any court battle before so, I’m not familiar with the court procedures but I think we can compare this to some hospitals who asks for deposit first before accepting a patient even if the patient happens to be just a breath away from dying. So, what’s the score here? Why is the PIG exempted from this, was it because according to Mon Tulfo’s article before, the registered address of the complainant is Malacanang?

But, if he files his candidacy before his scheduled fight, then he’s already a candidate and showing his fight on TV and elsewhere would now constitute such violation of the Election Code. So, let’s all keep a closeful watch on this one. Anything can happen, like when the Tongressmen rammed the Con-Ass while we were sleeping and dreaming that the Philippines is one of the first world countries already.
