Davide can’t wait to go to New York

Retired Chief Justice Hilario Davide is moving heaven and earth to assume the post of permanent representative to the United Nations.

Like what he did on Jan. 20, 2001, when he trampled upon the Constitution to install power grabber Gloria Arroyo into the presidency, he is trashing again the law again just to be able to live it up in New York.

Last Sunday, in the margins of the East Asia summit in Cebu, Davide took his oath as Philippine permanent representative to the UN even if his nomination has not yet been confirmed by the Commission on Appointments.

The next day, Malacañang instructed the Department of Foreign Affairs to find a justification for Davide’s assumption of the UN post even without CA confirmation.

People in the DFA are aghast. “Nobody has ever left and assumed foreign assignment without confirmation,” a foreign service officer said. In fact, he said, all of them took their oath in Malacañang after CA confirmation.

The Foreign Service Act (R.A. 7157) is very clear on ambassadorial assignments: “The President shall nominate and, with the consent of the Commission on Appointments, appoint ambassadors extraordinary and plenipotentiary to head embassies and permanent missions.”

The CA bypassed Davide’s nomination last December. Without the consent of the CA, Arroyo cannot appoint Davide. But she did last Sunday.

Former Senator Francisco Tatad said if Davide assumes the UN post without CA nod, he will write the UN Secretary General about the anomaly of Davide’s presence in the prestigious international body.

Tatad, former chairman of the Senate foreign relations committee, has filed with the CA an objection to the nomination of the 71-year old Davide on the grounds that it violates the provision of the Foreign Service Act that “All officers and employees of the Department who have reached the age of sixty-five (65) shall be compulsorily and automatically retired from the Service.”

R.A. 7157, which was enacted in 1991, further provided that “All incumbent non-career chiefs of mission who are seventy (70) years old and above shall continue to hold office until June 30, 1992 unless sooner removed by the appointing authority.”

In a letter to Arroyo last Monday, Michael Macaraig, president of DFAPA (Department of Foreign Affairs Personnel Association), plaintively asked “Bakit?” (Why?). He reminded Arroyo that there are currently 78 foreign service officers with the rank of “chief of mission.” Anyone of the 78 can very well represent the country in the UN he said.

Sen. Rodolfo Biazon said Davide’s appointment is ad interim because it was done while Congress was in recess.

DFA officials said that in the foreign service, ad interim appointments are only done in the promotion of career officer. Never has it been done for a political ambassador, which Davide is.

A DFA officer said the status of one’s appointment determines what one can do and cannot do in his position. Since this is the first time that the Foreign Service will have an ad interim political ambassador, they don’t know what to make of Davide.

They are concerned that to bring Davide and his family to New York, taxpayers will have to shell out at least $20,000 or P1 million. (His compensation package is not less than $30,000 (P1.5 million) a month, representing $20,000 free housing plus some $10,000 in salary and allowances.) How can they justify to the Commission on Audit the release of such amount when the appointment papers of Davide are incomplete? What happens if the CA rejects his nomination?

That’s precisely the reason Davide wants to be in New York now. Worried that the CA would reject his nomination when Congress resumes session on Jan. 22, he and Arroyo jumped the gun on the CA.

Malacañang thinks that once Davide assumes his post at the UN, it becomes a fait accompli. The CA has no recourse but to confirm him. Tatad’s objection becomes moot. Just like what happened to the Daniel Smith case.

What is shaping up as Foreign Secretary Alberto Romulo’s justification for Davide’s assumption to the UN post without CA confirmation is that the position of UN permanent representative is not a full ambassadorial position and as such, confirmation is not necessary.

The articulate Tatad can only say, “Susmariosep!” He covered foreign affairs as a reporter and has seen all permanent representatives to the UN go through CA confirmation.

The CA is part of a system of check and balance which is a necessary in a functioning democracy. That’s enshrined in the Constitution which counts Davide as one of the authors.

On Saturday, Jan. 20, Arroyo and Davide will mark the sixth anniversary of the start of their partnership in crime against the Filipino nation. They are still at it.

    Davide still not qualified, despite GMA’s action — Tatad

    Former Senator Francisco S. Tatad, who used to be Senate Majority Leader and chairman of the Foreign Affairs Committee of the Commission on Appointments (CA), said President Arroyo might be able to invoke her constitutional right to make appointments during the recess of Congress, but Davide’s appointment would still be in gross violation of the 1991 Foreign Service Act, which prohibits the appointment of anyone who is 70 years or above as chief of mission in the foreign service.

    Tatad expressed serious doubts that cutting corners to rush Davide’s appointment would serve any useful purpose. In order for Davide to function as permanent representative, he must first be formally accepted by the U.N. , and this would require his confirmation by the Commission on Appointments, Tatad said.

    “Would the Commission now be in any mood to fast-track Davide’s confirmation after he had been sworn in by the President without such confirmation, or would the Commission react negatively to the President’s preemptive action and junk the nomination completely?” Tatad asked.

    “And what happens if and when the Court of Appeals should soon decide that the appointment of 70 year-olds and above to the foreign service is in gross violation of law?” Tatad added.

    This is probably the first time in the entire history of the Philippine foreign service that the President had sworn in an ambassadorial appointee before the Commission on Appointment could extend its concurrence. Cabinet appointees are sometimes allowed to assume their post, even before confirmation, but never ambassadors, who have to be nominated to and accepted by the receiving states, only after confirmation.

    “When the Constitution says in Article VII, Section 16 that “the President shall nominate and, with the consent of the Commission on Appointments, appoint heads of the executive departments, ambassadors, other public ministers and consults, or officers of the armed forces from the rank of colonel or naval captain, and other officers whose appointments are vested in him in this Constitution,’ what it means to say is that the President must wait for the consent of the Commission on Appointments before appointing and swearing in an ambassador,” Tatad pointed out.

    “This incident is not at all helpful to the nation’s efforts to restore the rule of law at home and regain its shattered international credibility abroad. As a former Chief Justice, Davide could have begged off and advised Mrs. Arroyo to follow the normal process. That he did not do so, but heartily cooperated in carrying out the flawed process speaks volumes about the real character of this reputed paragon of justice,” Tatad said.

    In that case, whether in NY or in Pinas, Davide’s envoyship in the UN won’t be official – should he flee to NY without CA’s approval, his status there could be revoked with a letter to the UN from the CA.

  9. Davide is a huge flight risk. Extraordinary. A man who is supposed to have stood up for the law, for justice and everything it means should continue to show disdain for proper procedures.

    And speaking of flight risk, I agree for once with Sandiganbayan when they say that Jinggoy Estrada ain’t a flight risk. Jinggoy has asked to be allowed to go to Switzerland for the WEF I suppose. I wonder what his real reason is, to taunt the worst economic failure this country has ever known, no other than Gloria?

    Ayon sa batas, without the required Commission on Appointment’s confirmation, Davide should not be sworn in.

    Ayon sa Malacanang, GMA does not need to follow the law because the position of ACTING PERMANENT representative to the UN to which Davide is sworn is in acting capacity.

    The position of Acting Permanent is one for the books.

    Correct me if I am wrong but in government service, it should be either permanent, temporary or casual appointment. The Acting Permanent position is first in the Philippines history and under GMA who wither the rule of law in every way!

I think he must be thinking that if things get from bad to worse, then he and his family can stay in New York and enjoy all the rewards for his installing the Queen to the throne, instead of going back and be hounded for his perversion of the Country’s constitution, which for a lot of people who hold the fundamental law dear and sacred is equavalent to Treason….

    I found the statement amusing, because the other day, our DI (dance instructor) played a music and we can’t make out what dance to dance with it. Some did the Rumba, some the cha-cha, me and my partner did the Mambo. At least ours, just ballroom dancing and just for fun, but Gloria and Bert and Davide are serious matters and all should have known how to dance with the music. Anyways our DI had his fun…

    To install DAVIDE in his post in New york will require P1M and plus shipment cost of approx $20K for his personal effects (incl household). A $20K is needed to repatriate BAJA back to the Phil. Wow! that’s a lot of taxpayer’s money.

    DAVIDE can assume the post and go to new york. (Like John Bolton of the US, Bolton continued to be US ambassador to the UN until he quit last DEcember because US congress never and Democrats in the CA will never confirm him). Even if DAVIDE is bypased by the CA several times over, if GMA continues to appoint him, he can still continue serve as ambassador. Afterall, he is “very-well qualified diplomat”, his latest and lone diplomatic success is the staging of ASEAN! the last episode he is remembered being diplomatically suave was when he used the good offices of the supreme court to convince the people of the philippines to accept an acting president!

    What!!! acting permrep to NY??? hmmmmm…. that’s odd, never did I herad of an acting permrep to NY, what I only know is there is a deputy and the premrep??? never did I heard of an acting permrep. heheheheheheh….. gloria thinks he can fool everybody, the ploy is for davide to be appointed permrep with the armtwisting tactics of gloria.

    The ploy will not prosper, I tell the DFA thru its rank and file led by mr. mcaraeg will not be tolerated

I have an auntie on my mother side who’s presently working in the SC, ayun inatake ng nerbiyos dahil sa sunog duon kamakalawa. Nasunog iyong ubod ng mahal na mga drapes sa hall where the magistrates are doing their sessions, damay pati zeal ng Syupreme Court (ika nga ni Miriam Santiago), na parang isang masamang pangitain na nagbabadya ng tuluyang pagkasira ng judicial system sa ating bansa. Hangga’t andyan ang salot sa Malakanyang, sangdamukal pang kaalatan ang aabutin ng ating kawawang bansa.

    This Woman has the opposite Midas touch, as I said before. Anything she touches turns to mud and turns into damaged goods. Poor Davide, poor Romulo. The list gets still longer.

    The angle of Hilarious Davide positioning himself in the US to secure his and his family’s future just in case Arroyo gets overthrown any time soon is indeed a justified reason for rushing his appointment. I doubt so much if his physical condition can withstand the harsh cold in New York. This position may very well be his punishment for fooling the Filipinos. Ibigay ang hilig. Then she came out with the whitewashed Mayuga report to clear the election rigging generals. As a gift, she gave the Undersecretary of National Defense position to Mayuga after his retirement from the military service. Then, as a gift to Assperon for playing a big role in the election cheating in 2004, he was given the Chief of Stunts(staff) position. Angie Reyes was likewise given juicy positions after he staged a coup in favor of her. Sadly, look at what she does to those who did not do as much as Davide, Angie Reyes, Mayuga and the like, she gives them insignificant positions. Senga was made the head of a company that is not as significant as the positions of the ones she favored more.

    The Philippines Government is drumming the world over that is is a Democratic Society, ruled under the constitution, but anyone in the Govertment can render his two-cents of opinion (not even worth it) to violate that constitution.

    I have never heard or seen any elected official, being forced out of his or her office without due process anywhere in any Democracy but only in the Philippines. Even our police officers suspended during duration of resolution of criminal cases are paid until the case is resolved, and no elected official is relieved until the court ordered upon conviction of charges that under the law disqualify such official for the office. And we are a Decmocracy the same as that of the Philippines, and so far I am the only one drumming it to the world.

    Also, why remove these sitting officials (from different provinces) during election time ?

    Rumour is that the reason behind these removals is obviously, what most of us already know, is political.     I read about the UN giving so much importance to Davide’s appointment. I think it has something to do with Baja’s promotion or own appointment. Ngayon pa lang, pagtatawanan na si Davide ng mga makakasama niya sa UN.
