Nani Perez faces graft and extortion charges over $2 million

The graft and extortion charges to be filed by the Ombudsman against former Justice Secretary Hernando Perez is based on the claim of former Rep. Mark Jimenez that he paid Perez $2 million to stop him (Perez) from harassing him to execute an affidavit against former President Estrada.

Jimenez made this claim in 2002 at the time when he was fighting his extradition case to the US. His story didn’t help him because he was sent back to the U.S. where he served his time in jail (two years and three months) for charges of tax evasion, conspiracy, fraud and illegal campaign contributions. He returned to Manila in December 2005.

That Jimenez gave Perez $2 million is proven by the money trail. But many doubt Jimenez’ version of the origin of the $2 million and give credence to rumors that “The $2 million was alleged to have come from a $14-million bribe for the approval of the contract for the Caliraya-Botocan-Kalayaan hydroelectric plant won by Argentina’s Industrias Metalurgicas Pescarmona Sociedad Anonima (Impsa).”

It will be remembered that Jimenez’s businesses were in Latin America and he served as Estrada’s adviser on Latin American affairs.

Sen. Panfilo Lacson yesterday revived the question that was the favorite topic six years ago. “Since Perez got only $2 million, where’s the $12 million?”

There were talks that $1 million went to “the boys”, Jimenez also got some for himself and the biggest bulk went to an important resident of a big house by the Pasig river.

    It is because of the above reason that Mark Jimenez was quickly extradited to the US. The longer he stayed in the Philippines, the more trouble for Nani Perez. Kaya agad gumawa ng paraan na mapaalis si Jimenez. It was possible such quick departure was assisted by Washington. As a result, ligtas si Perez at namatay ang kaso ng ilang taon. Now, the evidences are too strong and Jimenez is already back in the country. With election a few months away, Arroyo would like to impress upon the people and voters na patas ang application niya sa batas. Pero kakagatin kaya ng mga tao ito?

    It’s about time! How long it has been now, and probably Nani Perez the crook already went through the $2 million or he hidden it in a pretty secured boxes so there won’t be no trace of the money. Anyway, here is my sure bet, the $2 million will never be found and Nani the crook will never spend a day in prison. This case like everything else when it get too uncomfortable for Gloria the Rapist, something major all a sudden will happen to distract this case and be forgotten. It always has, Gloria the Rapist didn’t get to where she is now for sleeping on the job. Nope!

    Why only now four months before midterm elections? There’s no surprise in the latest Ombudsman move or Moro-Moro. I don’t think ex-DOJ chief Nani Perez is ready to spill the beans. It may take years before final judgment of the bribery and extortion case. It’s a calculated political gambit or to gain pogi points for the discredited Arroyo administration. The issue next year’s poll is Gloria Arroyo and her inept government. It appears that Ombudsman Merceditas Gutierrez is trying to boost her big boss’ credibility in fighting graft and corruption. The midterm elections will be a referendum on usurper Gloria Arroyo and on her tyrant policy. An opposition controlled-Congress may end Gloria’s Enchanted Kingdom. How about Joc-Joc Bolante’s P728 M fertilizer scam? This case is gathering dust at Office of Ombudsman. Are they willing to sacrifice the bagman Bolante for pogi points?

    I actually could not believe that rumor because there was no reason in fact for this guy to fall for the Midget unless of course, wala talaga ka-taste-taste ang ungas!

    Anyway, if he is guilty, he should go to jail. If he is saved by the Great Switik, then we know there must be truth to the rumor! Baka nga naman mabulgar although nothing comes out of any expose on this cemented faced ogre! Tawag namin sa ganyang babae, “Onibaba”!

    BTW, over in Japan, the like of Jimenez is also liable to prosecution, because there is no such thing as plea bargaining in our judicial system. All accomplices get what they deserve. Thank to an efficient police system, no one can claim innocence or bargain for their freedom especially when they are guilty.

    Jimenez should not have paid, you see, because he could go directly to Erap or to the police to report the extortion attempt if there was one indeed. But then, of course, he had his own personal stake and vested interest that he agreed then to do as he was told.

    I think he should be prosecuted, too. Magturuan na sila!

    Jimenez, in his privileged speech at the House last year, claimed actually releasing $14 million in kickbacks in exchange for the approval of the IMPSA power deal. The Manila lawmaker was later extradited to the United States to face charges of mail fraud and illegal campaign contribution.

    The IMPSA contract was approved four days after President Arroyo assumed the presidency in January 2001.

    Of the $14-million bribe, Jimenez claimed $2 million went to Perez, $1 million “for the boys” and $4 million to Malacañang “residents.” The remaining $7 million remains unaccounted for.

    Serge hits DOJ, DFA non-cooperation in Swiss probe

    In his privileged speech Thursday, Sen. Serge Osmeña said the Senate should look into the series of omissions committed by the officials of the Department of Foreign Affairs and Department of Justice.

    He then asked the Senate leadership to refer to the report of the Department of the Public Prosecutor of Switzerland to the Senate committee on government corporation particularly on the failed response of the DFA and the DOJ to its request.

    According to Osmena, Justice Undersecretary Merceditas Gutierrez was quoted as saying that the DOJ would not provide any assistance to the Swiss investigation.

    “When we would have thought that any right-thinking God-fearing Filipino prosecutor would have jumped for joy at the gratuitous assistance given by the Swiss, I am absolutely flabbergasted. The Swiss authorities must have been floored. Here is our own justice official obstructing justice in the most arrogant manner,” Osmena said.

    In addition, Osmena questioned the DFA officials for not informing the Senate about the ongoing Swiss investigation into the Perez bribery case despite having received a copy of the report on April 15.

    “The Swiss prosecutor’s report was received by the DFA on April this year. In spite of the DFA’s knowledge of the ongoing investigation, the Senate was not notified much less given a copy of this report. It was only when the existence of the report was leaked to me that I caused the Senate to issue a subpoena duces tecum to the DFA to furnish the Senate with a copy of the report,” Osmena added.

    The Swiss government in its report particularly sought the help of the two departments to provide legal assistance especially on the pertinent documents and confirmations on the case.

Expect more beautiful things like the above to spread all over the media as the election fever starts. Malacanang is desperately doing some damage control and image building to remedy the inevitable defeat of its candidates this May. Tandaan niyo po, kung walang dayaan o walang masyadong dayaan, malalampaso ang administration ng opposition. But I’m sure these people in Malacanang have contingency plans. Huwag tayong basta maniniwala sa mga lumalabas na balita ngayon kahit na maganda basahin at pakinggan. We must be always cautios in dealing with the darkness. We might slip and fall if we don’t open our eyes.

    If small time crook Nani Perez faces graft and extortion charges for measley $2 million, how about big time crook Gloria the Rapist for subversion of President Estrada’s government, election fraud, lying, cheating and stealing of more than $2 million. We can add more to the list of Gloria the Rapist of major crimes, but it won’t do any good. Also, it would be nice to know what happen to the rest of the money, the $12 million. The way things are in the Philllipines we may never know. I even doubt if we’ll ever find out Nani’s $2 million share on Impsa deal.

    May all these immoral perveted characters rot in hell, soon! Why Gloria the rapist is above the law? When she’s just a dwarf.

    This Perez’s $2 million graft and extortion case is just another one of those many cases in the Philippines as we all know. I have yet since any real big time fish serve real time in Jail, especially when all the evidences against them are bright as the sun at noon time. Philippines justice is nothing but a big joke of how the justice dept go after these bunch crooks, nothing but a slap on the wrist. “Don’t you ever get caught anymore, you’re making our job difficult,” said the Justice Dept. What a comedy of justice!

    Prime example: GI Joe Smith. I bet Washington is laughing at us now, I can see their grin on their faces. We did it again to the Pilipinos, gotcha! May be we should let Gloria the Rapist rule the country little longer, since she starting to cooperate to our way of thinking. Amen to that Washington! Gloria the Rapist is just a puppet on the string, and Washington is holding the string. She better cooperate or those properties the Arroyo owned in San Francisco, one of the most expensive city in the whole wide world may just be investigated and published for anomaly just to shake Gloria the Rapist booties. Anyway, how many expensive real estate properties the Arroyos happen to possesed at such expensive City of San Francisco? Anyone?

Jun was appointed by Nonong Cruz. Jun, together with Rolando Golez & Helen Osias (who is currently w/ Cocochem) were notorious for charging large exspenses to Cocobank-frequent 1st Class ticket travels, representation expenses, etc. So far, only Golez has been charged. Golez went so far as to even charge his wife’s golf shoes to Cocobank !

Lumaban din kay Erap at bumaligtad din at kumampi kay Arroyo. Ngayon, nasa opposition na naman siya. But in fairness to him, this man is a good worker and leader.     Party list representative, Joel Villanueva of the Citizens’ Battle Against Corruption (CIBAC), saw the case against Perez as a ploy to improve the administration’s “corrupt and soiled image” ahead of the May elections.

    “I hope this is not one of their press releases only,” Villanueva said in a text message. “As CIBAC representative, I cannot erase from my mind doubting the motives behind this.”

    “It would be interesting of course [to see Perez prosecuted], but with this Ombudsman, everything remains to be seen,” he added.

    Just compare this: It took four long years to charge Nani Perez and only four months to build up the case against President Erap. Erap has been detained for almost six years while Perez is out playing golf.

    It’s a most welcome move from the Ombudsman. But there still is something fishy: Perez and company should be charged with PLUNDER considering the amount of US 2 Million exceeds the 50 million pesos requirement for plunder. More important, as plunder is a non-bailable offense and carries with it the capital punishment as penalty – the Ombudsman is not doing all it can by not charging Perez with plunder. The people, with the help of the media, should put more pressure on the office of the Ombudsman, to amend its charges to plunder. Then we will know that it really means business, and this is not just one of the ploys of Malacañang. This early, our “Justice” Secretary is already promising legal help to Perez, not to mention Ermita. Perhaps we should remind this two stooges of GMA, that the plaintiffs is here are the People of the Philippines, which they are supposed to represent, and not Perez.

    Reading Ms Ellen’s article above makes it clear that IMPSA has nothing to do with this case. As a matter of fact IMPSA is never mentioned in the complaint. This is a case (per Jimenez’s accusation)of extortion by Nani Perez so that Jimenez will not be badgered anymore (to testify against Estrada) by Perez. According to Jimenez, the $2M was his own money. This is nothing more than a red herring, with Perez being the herring to be swallowed if anyone will bite.

    Based on the definition of plunder and its penalty under REPUBLIC ACT NO. 7080, former Justice Secretary Nani Perez should be charge with plunder aside from extortion, bribery and falsification of public documents. I think the Ombudsman deliberately looks the other way to please Malacanang or somebody else.

    I linked the IMPSA case to the $2 million. It’s the ombudsman who did not link ito to IMPSA. They swallowed Jimenez’ version, hook, line and sinker. Because if they trace it back to IMPSA, there’s someone in Malacañang na madadawit.

    Jimenez tried to make it appear that the $2 million was his personal bribe to Perez when actually it was IMPSA’s payment ($14 million) for Perez’ signature to the government guarantee for their loan. And this happened four days after EDSA 2.

    If you take note of the division of spoils, kumita pa doon si Jimenez. Big time.

    Jimenez is a crook. His character and background should scare people away. But with his money, he’s popular and people just can’t help but to approach him. Pero saan na galing ang kanyang pera ngayon? Siguro naman na freeze o na-confiscate na ang karamihan niyang assets sa Amerika kahit na sa Pilipinas. He was convicted and served his sentence. Unless he has other or some other monkey business in the Philippines, his current source or sources of income is a big question. Iyan ang dapat natin tingnan.     The latest statements coming from Jimenez that Gloria didn’t receive a single centavo from the IMPSA deal is contrary to what he said in his privelege speech in Congress, prior to his extradition to the US.

    The Ombudsman’s investigating team said they did not find any documentary evidence linking the president to the extortion/bribery deal. I say, it’s not in papers, dumb fools, look at the tapes! Who in her right mind would document her own bribery? (Ok, change “her” to “his”.)

    This action by “Merceditas the merciless against small fish” is merely for show as many here have blogged. It’s supposed to be compliance to Uncle Sam’s $20M aid under the Millenium Challenge Account. Almost half a year has past and the money Bush’s gov’t donated to the Ombudsman may have all been spent already and no significant accomplishment can be shown.

    As I said before regarding this donation, it’s like ordering a shabu junkie to rehab and rewarding him with, well, shabu!

    It’s the legal eagles like Frank Chavez, Harry Roque and the rest of the courageous legal eagles who can put a stop or at least slow down the abuses of the DOJ’s Gonzalez.     Sorry I took so long to reply. Had to go out of town. What I meant was the case to be filed with the Sandiganbayan. OF COURSE, it has everything to do with the IMPSA deal. But everything done to connect them in the trial proper (or even in the prelims) will come to nothing unless Jimenez changes his tune, which in my opinion will never happen. So in the end, this case cannot be connected to the shit hole by the Pasig river. Unless you think the Sandiganbayan can connect that particular $2M to IMPSA, something that the Ombudsman will never try to find out.

It was probably the only evidence many thought could nail Estrada in his plunder trial but it was effectively blocked by Erap’s lawyers since it was not included in the complaints. Dennis Villa-Ignacio tried several times to show the video and the documents but the court in all instances upheld the defense’s objections. It was at this point that Villa-Ignacio finally lost his cool to heckling in media and immediately rested his case.

    Ngayon, ginagamit na naman si Chavit na tirador para maipilit ang mga argumentong di man lang nakalusot sa isang legal na paraan, dito sa media na lang ibinandera. Kesehodang peke ang kopya ng kontrata, lalo’t si Singson ang may hawak, meron bang maniniwala?

Napatunayan dito na naglahong bigla ang issue laban kay Gloria sa pagyurak sa batas sa kaso ni Smith. Pero muli namang mabubuhay pag dating ng pagdedesisyon ng Korte Suprema.

    Sigurado ako, pag dating ng araw na yan, may nakahanda na namang pantakip at panggulo sa isyu. Kung ako sa oposisyon ngayon pa lang, paghandaan na ang ganitong mangyayari, tama ba ako?
