Smith and Garci

As usual, Gloria Arroyo was lying when she said the decision to spring convicted American serviceman Daniel Smith from the Makati jail midnight of Dec. 29 was ” taken with only the best interests of the Philippines in mind.”

The truth is that it was taken with only her political survival in mind.

She will do anything, even sell the country down the river, to get the support of George Bush to her shaky presidency.

We all know that the root of the instability Arroyo’s presidency is her cheating in the 2004 elections. It all goes back to the “Hello Garci” tapes.

It will be recalled that in the July 4, 2005 US Embassy national day reception, Arroyo surprised embassy officials when she informed them that she was attending the event which was to be held at the embassy.

That was some three weeks after her press secretary Ignacio Bunye held up the two discs, one of them exposing her masterminding the thwarting of the will of the people in the 2004 elections.

Presidents usually do not attend national day receptions. It’s the foreign secretary or any of the top officials of the department of foreign affairs who represent the country in those social events.

That particular reception was a little bit complicated because it was held at the US embassy building, which under the Vienna Convention of diplomatic relations, is American territory. A head of state going to another country’s premises is tantamount to a state visit.

Malacañang insiders said her political advisers told her to make her presence at the US embassy event as a message to the public that America is on her side in her moments of crisis.

They learned that Susan Roces, the widow of the man Arroyo cheated, would be in the reception and they dreaded to see a picture of Susan and Joseph Mussomeli, the charge d’affaires of the US Embassy in the front pages of newspapers the next day.

It was obvious that she was just there for the photo opportunity. She just stood beside Mussomeli as the latter and Foreign Secretary Alberto Romulo did the traditional toasts. After that, she left. (Roces decided not to attend and sent her daughter Mary Grace instead.)

Arroyo that night was a picture of a groveling head of state. It was so embarrassing.

To be back in the good graces of Bush has been Arroyo’s obsession after she proved herself an unreliable ally when she withdrew the Philippine contingent in Iraq when she was threatened with protests over the kidnapping of truck driver Angelo de la Cruz.

The US state department had shown her that she has not been forgiven by its continued refusal to grant her requests for an invitation for another White House visit.

Although the Daniel Smith rape case was seen as a problem that could strain RP-US relations, the Machiavellists in Malacañang saw it as an opportunity to make Arroyo valuable to Bush.

A source close to Arroyo said she was not exactly unhappy over the conviction of Smith by Makati Judge Benjamin Pozon not because she sympathized with the Filipina rape victim, but she knew the Americans would need her to help Smith.

She did not reckon, however, with the public outrage that followed the brazen railroading of the Con-Ass by Speaker Jose de Venecia and his gang. With all the religious groups ranged against her, her fragile hold on power was again being shaken she had to even postpone the 12th Asean summit in Cebu which “surely lowered the credibility of the Philippine government”, in the words of Japanese Trade Minister Akira Amari.

Arroyo couldn’t do much about Smith at that time as she was pre-occupied with putting off the fire ignited by Con-Ass which was her payment to the congressmen for blocking the two impeachment complaints against her. Thus, the US had to use the stick which was the cancellation of the Balikatan exercises.

Arroyo and her security advisers were startled.There was a meeting of the cabinet cluster on national security before Christmas. A source said there was concern that the US might be seeing Arroyo not only as an untrustworthy ally but worse, a spent and useless asset in Asia. They were worried of American non-support for Arroyo if they did something drastic to forestall her downfall.

Thus, the springing of Smith by the Philippine National Police from Makati City jail midnight of Dec. 29.

Now, Malacañang is calling for a review of the Visiting Forces Agreement. It’s like telling Uncle Sam, “If you don’t support me, the leftist opposition will junk the VFA. I’ve proven I can deliver the country to you. You need me more than ever.”

    Next to the “Hello..Garci” scandal, “the springing of Smith by the Philippine National Police from Makati City jail midnight of Dec. 29” has strongly affirmed the WEAKNESS & DISASTROUS EMPIRE OF GLORIA, not to mention the political nature of this administration. They will do whatever is politically expedient and not what is legal. Forget honour & integrity.

    Come to think of it, what the U.S. did was to actually unmask the frailty of Gloria’s government.

    However,going back to Smith. I think he was walking right into the harms way.and what is not good for him, ginamit lang siya politically between the dirty games of politics.

    Hindi ako naniniwala na “Smith raped “Nicole” kahit isa akong Pilipina.tama babae ako tapos ako sa UP at may magandang trabaho.

    so alam natin na gagamitin lang siya politically.I pity Smith for “changing oil” in a wrong place and wrong time.

    Yes, Anna de Brux, “the US reinforced that frailty.” Today we see a WEAKER Gloria.

    It could be possible that the US INFORMED (not asked) Gloria they would transfer Smith to the US Embassy, with or without her consent. This could explain why there were two conflicting reports regarding Gloria’s knowledge on Smith’s transfer to U.S. custody-one report says that Gloria was aware of it & another report says she wasn’t aware-whatever it is, this has only placed her in a Catch 22. Either way, she got the ire of the people, & even worse, she is even more disrespected then ever. Maybe the US wants her O-U-T.

    The Court of Appeals (CA) decision on the Smith custody case is one for the books. I think it is one of fastest decisions ever made by a judicial body that has so far already acquired a reputation for resolving cases at snail’s pace. It is also rare because usual court decisions somehow plainly determine the winning and the losing party. In this case all parties involved are claiming victory. A clear sign indeed that the issues raised have not been conclusively and satisfactorily settled.

    The camp of the alleged rape victim who wants Smith held in the Makati jail claims victory because Smith’s petition questioning the RTC order of confinement in said jail has been dismissed by the CA. The CA said RTC Judge Pozon did not commit a grave abuse of discretion in issuing such order. But to Smith the dismissal of his petition does not matter anymore because he already got what he was asking for in said petition even before the CA ruling.

    The CA cannot really be faulted for declaring Smith’s petition as “moot and academic”. It has to recognize a fait accompli, a reality that has already happened and could not be undone by mere stroke of its pen. It is fully aware that if one of the parties involved in the case could get what they are asking for without awaiting its ruling on the matter, then it is futile and impractical to require them to revert back to the status quo ante. In all probability the CA could even be said to have been “pressured” by the adverse and serious repercussions on our country’s relations with the US and on our credibility in the international community if it ruled otherwise.

    The CA situation is reminiscent of the situation faced by the Supreme Court in 1973 in the case of Javellana vs. Executive Secretary (50 SCRA 30) regarding the issue of whether the 1973 Constitution has already been ratified by the raising of hands of the people herded by the Marcos Regime in various “Citizens Assemblies”. In said case, the SC was told that that the Government was already being run under the new Constitution since January 17, 1973; that the political department of the government has recognized said Constitution; that our foreign relations were being conducted under such new Constitution; that the Legislative Department has recognized the same; and that the people in general have by “their acts or omissions indicated their conformity thereto.” Confronted with such reality, the SC was constrained to declare that “there is no further judicial obstacle to the new Constitution being considered in force and effect”.

    While the parties involved in this Smith case both claimed victory, it cannot be said that there is no loser here; in fact it is the biggest loser. And this is no less than the Judiciary itself through the exacerbation of its judicial power.

    Judicial power includes the duty of the courts of justice to settle actual controversies involving rights which are legally demandable and enforceable and to determine whether there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of any branch or instrumentality of the government (Art. VIII Section, Constitution). The essence of judicial power is the power of a court to hear and pronounce a judgment upon controversies presented to it and implies the construction of law and the adjudication of legal rights (The Attorney’s Pocket Dictionary). During the early years in law school one of the first basic principles we learned is the delineation of the different powers of the Executive, Legislative and Judicial Branches of the government so as to distinguish one from the other. Thus Legislative power refers to the power to enact laws or to declare what the law shall be, whereas Judicial power is the power to construe and apply said laws as it adjudicates the rights of citizens, while Executive power is the power to enforce and implement the laws enacted by the Legislature as construed and applied by the Judiciary.

    In the Smith case, it is very obvious that the Executive Branch has intruded into or even usurped the judicial function. It interpreted, applied, and implemented the law or the VFA supposedly for the preservation of our international relations in the best interest of the country. In so doing the Executive Department has demonstrated a new mode of winning a case it has filed in court – by a “calibrated” preemptive move that will render the case moot and academic. The President may mean well and only has the best interest of the country in mind, but the end still does not justify the means.

    Now at its WEAKEST point ever, the only recourse Gloria has is to revive the People’s Initiative ONCE AGAIN. In a recent article from the Philippine Star, Mayen Jaymalin reports that the “Comelec commissioners approved last Tuesday the new guidelines for the conduct of a people’s initiative for Charter change (Cha-cha). Comelec Commissioner Rene Sarmiento said the poll body approved Resolution No. 7796 in preparation for a possible plebiscite on whether or not to amend the Constitution. “Now that we have already laid down the rules at least there is now a process that can be followed in case a new petition for people’s initiative is filed before the Commission,” Sarmiento said.”

Pero pareho silang ginamit ni aleng Gloria para sa kanyang panatiling pagkapit sa kapangyarihan. Mabuti na lang, wala na syang Nanay na maibinta, at iwan ko kung mayron pang naiwan kaluluwa para ipag tawad kay Satanas kung sakali, sakali kailangan.

    At ikaw Garci, sa-an ka pa nang i-ispiya na marami ka na nanam na lalaman? O kaya napahaba lang nang tulog mo, napaniginipan mo lang yon manga kuro-kuro mo tungkol kay Garci at Smith?

    Any foreign observer worth his gourd, especially the denizens of the US embassy, can see through the facade of the pretender that she is a fake 2 dollar bill. What is lamentable is the despicable motions glueria is going thru by which she is prostituting her office and the country as well when she sprung Smith in the middle of the night making a mockery of the courts and if only to show uncle sam that she can also lick his boots. It is evident that her personal ambitions to stay in malacanang at ANY cost, are throwing her off the rocker. She is no longer capable of making SANE decisions. The PEOPLE must make their move.

    Like I said in a previous thread, its either Glueria springs Smith before the new year or she’ll be out by the end of the month. This is the reason why she had to get Smith out no matter what the cost would be.

    The new tactic of the administration is to make the elections a face-off between GMA and Erap. Her advisers think that voters will be turned off by this and vote for the administration slate instead. Magaling talaga mag-isip ang mga loko. The people should know that this is not true and should see clearly what the administration is up to.

    I don’t see it this way, what I’m after is honesty, good governance and accountability. I want Glueria to account for the sins she had committed against the Filipino people.

  15. Sergio Apostol has admitted that the VFA was not ratified by the US senate. I do not know where the SC based its ruling that it is binding. If it was never ratified, we are not bound by its provisions. GMA knew this and yet sprang Smith. It is then purely political survival and not the interest of the Philippines that drove her to do this.

    How I miss the arrogance of a Pichay and his ultra-hambog-ness. Last time I saw him, he was telling media that he would only run as senator if he wouldn’t spend his own money in the campaign. Eeeew! Nagpaparinig na naman. At pakiramdam yata e malaki ang tsansa niya, sige nga, isama ninyo sa tiket, puh-leeze! Bayaran mo na Gloria, para may nagtatanggol naman sa iyo!

    I miss, too, the insipid De Venecia whose constant lies are so boringly predictable you don’t need to look into his eyes to feel sleepy. Last news? Licking his wounds over at Danding’s ranch, Down Under.

    It seems, the House lapdogs are keeping their safe distance from their master, er, mistress, er, both, in this very sticky issue I’m sure that if this negativity holds much longer, we’d see them riding the snowball one by one. Hey, this is an election year, and no one would want to take the unpopular position and get hit by horse manure being thrown from all directions. Unless you have the innards of a Sir Raul O. Gonzales.

    We have seen a few surprises, Anna from Bruxelles, said so about Joe Sison. The other day, I read (which I haven’t done in months) Belinda Olivares-Cunanan, the perpetual Gloria pantyliner, condemning the decision to deliver Smith to the US Embassy. I guess she thinks Gloria really didn’t have a hand in it. The day after Gloria’s admission, she was back to her old self and even suggested that the CA reject the contempt cases. Even Rody Duterte of Davao, another hard-, er, liner, has said it wouldn’t have happened had he been in Manila.

    And some others.

    If this scandal, the latest of many self-inflicted catastrophes that has been characteristic of this brazen regime, drags on, even the rats will soon abandon ship.

    I am happy to respond to your letter of April 29, concerning the way the US Government views the Philippine-US Visiting Forces Agreement in US legal terms. You raise an important question and I believe this response will help in the Senate deliberations.
    As a matter of both US and international law, an international agreement like the Visiting Forces Agreement is legally binding on the US Government, In international legal terms, such an agreement is a ‘treaty.’ However, as a matter of US domestic law, an agreement like the VFA is an ‘executive agreement,’ because it does not require the advice and consent of the senate under Article II, section 2 of our Constitution.
    The President’s power to conclude the VFA with the Philippines, and other status of forces agreements with the other countries, derives from the President’s responsibilities for the conduct of foreign relations (Art. II, Sec. 1) and his constitutional powers as Commander in Chief of the Armed Forces. Senate advice and consent is not needed, inter alia, because the VFA and similar agreements neither change US domestic nor require congressional appropriation of funds. It is important to note that only about five percent of the international agreement entered into by the US Governments require Senate advice and consent. However, in terms of the US Government’s obligation to adhere to the terms of the VFA, there is no difference between a treaty concurred in by our Senate and an executive agreement. Background information on these points can be found in the ‘Restatement 3rd of the Foreign Relations Law of the United States,’ Sec. 301, et seq. [1986].

If true, Asperon, the Philippine Army leadership and even the Inspector General stand accused of a terribly heinous crime against members of the Army. Name it, illegal detention, torture, conduct unbecoming an officer, etc, blah, blah, and they can be charged with it in Pinas, or in any human rights courts anywhere around the world. No ifs, no buts.)

    THE wives of two mutinous Army officers on Thursday claimed their husbands were being “tortured” while under isolation conditions in a maximum-security area in the Army’s Fort Bonifacio headquarters.

    Wilma Baldonado and Venus Sarmiento said they have seen their spouses handcuffed and blindfolded during their week­ly visits.

    An officer “close” to the two officers also confirmed the report, saying the harsh treatment was to force them to issue affidavits against politicians that allegedly sheltered last year’s coup plotters.

    Wilma is the wife of 2nd Lt. Aldrin Baldonado; Venus, wife of 1st Lt. Sonny Sarmiento.

    The two officers were captured in July 2006 with other comrades accused of hatching yet another foiled coup against President Arroyo.

By the way, there is habeas corpus in any civilized military court… Call the British or French or US Defence or Military Attaché and they can give you a copy of what their own military may think of this terrible treatment of these 2 young, bona-fide members of the Philippine Army by their peers.

  20. I am deeply flabbergasted that Gloria’s chief of staff AFP could be such a dirty dog about his men. He has a duty to his officers and men to fulfill, morally, legally and physically! If he doesn’t know it, he should be sacked and taken to court, or hanged like a mad man!

Nakita naman natin, ng ibasura ng CA ang apela ng manyakis na amerkanong si Daniel Smith, dahil nga naman “moot” na iyon dahil sa pakikialam at pangbabaraso ng Malakanyang sa pagpapapuga sa rapist pabalik sa kanlungan ng US Embassy, taas noo pang sabihin on national tv nitong si bunye na “vindicated” daw and hakbang na ginawa nila ng desisyon na ito ng CA? Tama sabi ni Tikbalang, napakasakit sa ulo isipin ang lahat ng pinagsasasabi ng pangkat na ito ni gloria. Ang tindi talaga ng mga ito sa pag-twist ng facts so that it would be on their advantage. Ang tagal naman ng Mayo, at nang mahatulan na ang mga ibang alipores nitong aleng may napakaitim na gilagid, pero mas maitim pa ring budhi.

In criminal cases, the sole objective of judicial proceedings is the fair determination of guilt or innocence of an accused. Some people here obviously think that Smith has lost this right to a presumption of innocence. They are wrong and ignorant of the Law. It is immoral to insult him and call him names. When extrajudicial killings occur it is this same fundamental right that is violated.

    A petition was filed before the CA by the rapist for transfer of custody, but before a decision was made, he was smuggled out from his cell and handed to the US in the midst of darkness. Why? Because they may have an advanced knowledge that the petition will be trashed and may be tipped-off that if this rapist landed on the US lap before the decision, it’s all touch and go from there. And so they moved quickly to pre-empt the CAs decision.

    If we take a second look at the decision, it upholds the decision of Judge Pozon, so if this rapist was not freed by the goons of the evil queen, he will and still remain in Makati jail and they could not do anything about it, The CA meantime acted it’s part of the script and rendered it as moot because the rapist was already in US “soil”.

    How can a convicted rapist like Daniel Smith found guilty and sentenced by a court of law be presumed innocent? Is it because the court that handed the verdict is a Philippine court and he is an American?
    If that’s the logic, then all suspected criminals found guilty by the lower courts were also to be presumed innocent, until the supreme court says so. Napakarami palang trabaho itong mga justices ng supreme court kung lahat ng mga convicted ay mag-appeal dahil review ang mga kaso then confirm or reverse the decisions. Ganoon ba yon?

    Ms. Ellen, You’re correct to say that when the leprechaun went to sttend the 4th of july 2004 celebration by the US Embassy, it is already considered that the leprechaun went on an official visit to the US of A, knwoing that under the Vienna convention, that an Embassy or Consulate General of a particular country is considered as a territory of the celebrating country, Funny thing about that celebration, I recall that even Noli boy was there, and even Bert Romulo attended the celebration, even thought he just came back from an official visit. Everyone else was suprprised to see the leprechaun attending the US celebration, and even some ambassadors says that she should also attend their national day celebration.

    In the Enchanted kingdom of the leprechaun, everything else is possible, anything under the moon and sun can happen in just one snap of a finger. So I say this again, in May 2007 election (if the election will push through) let us be wise in choosing our representative/s or else we are going to suffer again and again.

    Let us remove those officials who are only after their personal interest, especially to those who killed the impeachement and those who railroaded the con-ASS.

    Ask any lawyer this question: Has Daniel Smith lost the presumption of innocence at this stage of the judicial proceedings? NO! That is why there is an appeal. It is still the Prosecution’s task to prove that he was found guilty beyond a reasonable doubt. It is most certainly NOT the task of the Defense to now prove him innocent.

    Only fascists would insult, taunt and villify an accused who, at any stage of the appeals process, either in the SC or CA could be declared not guilty. Only fascists deprive human beings of this most precious right to the presumption of innocence until the verdict is final and executory.

    What indeed will people here say or do if or when the Court of Appeals finds Smith innocent? Can they take back what amounts to an immoral and despicable inhumanity with hurtful and hateful words they have written?

It’s really quite the same principle with the appeals process. remember that we do not have a trial by a jury of Daniel Smith’s peers here. What we have is one judge at the RTC that decides. The Court of Appeals and the SC are like “Houses of the Judiciary” like the Senate must concur with the RTC’s decision before it become final and executory, before it becomes Justice.

    i wonder what happened to our in-blog lawyer, fencesitter.as i have said before i am not a lawyer so correct me if i am wrong.trial courts are the ones who examined the evidence and after that makes a decision.the court of appeals examines the decision if one of the parties does not accept in whole or in part the decision.so far it is only the trial court who had examined the evidence. so, in a way i agree with zen. to me he is guilty, unless the court of appeals after re-examining the evidence, overturn the ruling of the trial court.unless new evidence come, the probability that the court of appeals will overturn the verdict is small.but this can mean sometime. somebody even said that it can take years. meanwhile he is a convict.in fairness, not all those convicted are necessarily guilty.

    Dean used to be a columnist for the Inquirer and has his own blog. He was a Marcos victim and was in prison for some time.

    It might not show in my tit for tat with him but I have the utmost respect for his opinion. He doesn’t say or put down something just to annoy people. What he says are borne out of conviction based on a very good logic and thought process.

    He and CVJ are two of the people I admire greatly in the blogging world for their intellect and their consistency – that is even if some of Dean’s ideas clash violently with my own convictions.

    But Cruz admitted that Manila had invited the Secretary General to address the high-level meeting, but that he had declined the invitation.
    The new UN Secretary General will not be available for the summit in Cebu, Cruz said. He just assumed his post and it’s his first week so he’ll have to attend to a lot of things in New York. Ban Ki-moon, former South Korean Foreign Minister, took over the reins of the UN from Kofi Annan. He assumed the post last Jan. 1.

    On Smith, I tangled with a rabidly pro-American and the end result of our discussion really bothered me with his parting statement. This is what he exactly said to me.

    Now that Smith is inside the US embassy, do you think that the US Embassy will facilitate the return of Smith to the local jail should the CA reverse its stand on mooting the question of custody? How long will it take the Supreme Court to make a ruling, five years, ten years? And don’t you realize Smith, for all intent and purposes, is no longer in Philippine territory?

    maneuver by Arroyo to appease her master at the cost of our country’s
    dignity and sovereignty,” stated Rachel Redondiez of BAYAN USA.

    “The only hope for justice for Nicole and for our country is a total ouster
    of Arroyo, the number one traitor of the nation and violator of Filipino
    women. It will be up to the people now to disinfect Malacanang of her
    administration. Arroyo will not be able to prevent the inevitable wave of
    outrage and isolation she will suffer for her treacherous ways,” Redondiez
    continued.

    Redondiez likened the custody transferal to a condonement of continuous rape
    and sexual violations of Filipino women and the Filipino people under the
    context of the historical unequal relations between the US and the
    Philippines.

    “As Filipinos in the US, products of this unequal relationship, we demand
    every US troop leave Philippine soil, that the Visiting Forces Agreement be
    revoked. The VFA is the concrete manifestation of a century-long legacy US
    interests raping our land,” Redondiez added. ###

    I feel elated that what I wrote is almost the same with the stand of Undersecretary Zosimo Paredes, executive director of VFACom, who just resigned from his post.

    Paredes said officials of the executive branch “took the law into their own hands” when they arranged a convoy to whisk Smith out of the Makati City Jail, where the Marine had been held since he was convicted on Dec. 4 of raping “Nicole.”

    He said that while he fully agreed with Smith’s transfer to US custody because it ostensibly fulfilled Philippine obligations under the VFA, “it should have been done properly–no coercion, no bullying.”

    The transfer was made when the Court of Appeals had yet to rule on Smith’s petition for his return to US custody, for which the convicted Marine invoked the provisions of the 1999 agreement.

    Paredes wondered why Malacañang, through the DFA, had earlier bothered to file pleadings in support of Smith in the appellate court, only to carry out the transfer ahead of a court “authorization.

    I’m not bothered by the opinion of some Amerikanong hilaw. He’s entitled to it. I just wish he would not try to impose his opinion on free spirit like yours truly especially with experience like mine—actually being part of the judicial system that see these erring bullies from the US bases in Japan go to jail with no special favor or treatment.

    It’s actually not a hopeless case to impose on the Americans to abide by Philippine criminal procedure even if the horny soldier is back in US territory. It is just a matter of will of the Filipino people to demand for the US to recognize their nation’s sovereignty.

    Problem is do Filipinos have the same guts of the Iranians or the Venezuelans for instance to threaten the US with severance of ties if they don’t abide by Philippine law especially when the judgment of the court against horny Smith has in fact made him a ward of the court that should have been dishonorably discharged by the US military? It is not moral inconsistency mind you. It is more a matter of some people playing the idiot for some monetary compensation even as when they surrendered some documents, etc. on the Islamic Fundamentalists’ plan to destroy post WWII US bullying found by Filipino policemen in some apartment in Manila in 1995. FVR, et al was reported to have received 30,000 dollars for those evidences that should have remained in the possession of the Philippine police.

    Yes, that’s the more ample description of all these pacts with the US—a matter of idiocy more than a matter of morality. Kind of gustong makalamang, sila ngayon ang nalamangan. Nagbilang na ng sisiw, hindi pa man napipisa ang itlog. Palaging ang isip kasi “baka makalusot!”

    If there is a strong public outrage, I don’t believe that the US ambassador will insist on being another idiot herself but will be wiser to abide by Philippine rule regardless of such lousy treaty at the VFA. It is a matter really of mutual respect and cooperation, not a relationship between a bully and a weakling!

    As a people, we know that majority of the Americans are upright especially when it comes to other country’s sovereignty especially the freedom of expression. In fact, sabi ko ng kay GSDC, I don’t personally hate Smith. Why should I? What you and I and almost all of our friends-bloggers, hate are misdeeds of the present leadership.

    Alam mo, I was hoping, just a tiny hope, that GMA in one shining shining moment, will come forward and will say, tama na yan. Nagkasala at nahatulan, ibinigay na sa korte kung ano pa ang mangyayari. But on the contrary, siya pa ang nagmadali to bail out Smith from Makati jail.

    I believe Smith & Garci will be something that GMA and her candidates (nagkakagulo na sa kabilang thread) will be hard put on depending their bungled actions before the voting public during their campaign sorties.
