US cancels military exercises with RP over rape case

THE United States has cancelled its annual joint military exercises with the Philippines due to the continued detention of a US Marine convicted of rape, an embassy spokesman said Friday.

“The custody issue is at the heart of this,” embassy spokesman Matt Lussenhop told INQUIRER.net. “Due to the current custody issue (over the US Marine), the usual protection provided to US servicemembers is in doubt.”

“This is an expression of displeasure on their part and you can’t fault them for being displeased,” Justice Secretary Raul Gonzales told Inquirer.net in a phone interview.

Chief Presidential Legal Adviser Sergio Apostol said the US could be sending the message that Smith’s continued detention at the Makati City Jail was a disrespect of the VFA.

Senate defense committee chairman Rodolfo Biazon meanwhile said the US decision was a form of “arm-twisting” to force the Philippines to turn over the American.

The Court of Appeals on Tuesday threw out a petition by Lance Corporal Daniel Smith that he be transferred immediately to the custody of the US embassy while his conviction is under appeal.

Smith, 21, of St. Louis, was convicted on December 4 of raping a Filipino woman, identified in court as “Nicole”, and was sentenced to 40 years in prison. He has been detained at the Makati City jail.

Lussenhop said: “Until the government and the courts ensure the Philippines is in full compliance with the VFA (visiting forces agreement), it would not be prudent to bring additional US troops to the Philippines at this time.”

Asked to comment on the US’s pullout from the Balikatan 2007 exercises, Foreign Affairs spokesman Eduardo Malaya said: “The DFA has not yet been officially notified.”

There was no immediate reaction from Malacañang.

Armed Forces spokesman Lieutenant Colonel Bartolome Bacarro said they were leaving the matter to the Department of Foreign Affairs.

Asked if the cancellation of the joint military exercises could be done unilaterally, Lussenhop said: “I honestly don’t know about that.”

He said the cancellation of the field exercises was announced by Admiral William Fallon, commander of the US Pacific Command.

Smith’s lawyers, the US Embassy and the Philippine departments of justice and foreign affairs have all said the American Marine’s current detention violates the VFA, which covers the presence of US troops in the Philippines.

A provision in the agreement says any accused American serviceman shall remain in US custody until all judicial proceedings are exhausted.

But regional trial court Judge Benjamin Pozon, who heard the case, said the provision applies only during “the judicial proceedings in the trial court” and expires upon a defendant’s conviction, regardless of a pending appeal.

Lussenhop said that the United States had “no plans” to cut military aid to the Philippines or pull out any additional US troops.

Balikatan is the largest US military exercise held in the Philippines each year, involving as many as 5,000 American soldiers.

At least one round of joint exercises between Filipino and US troops has been planned in February, said a military official who coordinated past war games.

The Field Training Exercises was set to be held at Fort Magsaysay in Laur town, Nueva Ecija province, Crow Valley in Capas town, Tarlac province, and the Marine Base in Ternate town, Cavite province, said the official, who asked not to be named.

The case of the Filipina raped by the US Marine has sparked street protests and revived anti-American sentiment in this former US colony.

    I mentioned in a previous thread that this recent U.S. brouhaha-I hope I am not using the wrong word, but I look at the recent move of cancelling the Balikatan as some sort of “SANCTIONS” on the Philippines. There will be ramifications for this move. They know damn well that she pretty much controls the court here. I cannot accept that a mere Judge Pozon from a mere Regional Trial Court has wrecked havoc on the U.S.-Philippines relations ! And Gloria is not aware ? Tell that to the Marines ! This Woman has this persistent character of taking all sides on an issue. For instance, her War on Terror. On one hand, she says she fully supports the Coalition of the Willing, and in a blink of an eye, for a fellow-province mate, the TNT (Tago-Ng-Tago) Angelo dela Cruz is the cause of her back-peddaling. Even more recent her stand regarding Cha-Cha. First she is for it, then back-tracks, and then she’s back in again. This is sooooo Gloria ! GLORIA is NOT AN ECONOMIST, but a POLITICAL PROSTITUTE, WHO SLEEPS WITH ANYONE WHO CAN SATISFY HER NEEDS.

    Gloria will be able to manipulate the U.S. The Red, White & Blue is no PUSH OVER, AND WHEN THE U.S. BUSINESS, THEY MEAN IT.

Obviously, they smell Gloria’s stench all over the decision of Judge Pozon ! Poor “Nicole”. The woman thinks she won a victory through Judge Pozon..this is all part of Gloria’s “Pretend-Prented”. Watch.

    Certainly, Judge Pozon and the Court of Appeals justices should be commended for their valiant stand against pressures from the administration.

    Chi is correct in saying the world is getting smaller and smaller to the ulupong. Others might say shorter and shorter.

    I would like think ito na ang simula, start and beginning towards nearing end-game. Whether we like it or not, the cancellation of the military exercise will have a side effect on the US conglomerates here. What if they, too, pullout their interests? Watch out for the financial markets’ reaction. And the dollars’ flight!

    The Subic rape case reminds us of the Okinawa case. There, the Japanese govt stood firm in its resolve to put a GI rapist behind bars, and Uncle Sam could not do anything. The problem with the Philippines is that, aside from being a weak state, national leaders are weaker and easily yield to a powerful country. They quickly surrender the nation’s sovereignty at the drop of a hat. Look at how top officials like Gonzales, Nachura and others who lawyer for Smith (Fr. J. Bernas also pointed this out.). Only in the Philippines!

    I would like to believe that Judge Pozon is acting on his own good judgement and that he’s one of the very few independent thinkers in the judicial department. May pag-asa ang pinas habang meron natitirang katulad niya sa korte.

    Christmas gifts, carols for jailed Marine

    Supporters of Lance Corporal Daniel Smith, the 21-year-old US Marine found guilty of raping a 23-year-old Filipina, will sing Christmas carols for the American soldier on Tuesday outside the gates of the Makati City Jail.

    Members of the group Justice for Daniel Smith (JDS) said they would bring him gifts and sing hymns that they hope he would hear from the stockroom of the jail facility where he is detained.

He has a daughter too and he has to be very careful with what he does. The Filipinos may be subservient but they are not stupid!     But on the rape case, your commenter is perceptive that there is a bit of political theatre being put on for the benefit of those inflamed by the usual feelings that Americans and Filipinos are not treated EQUALLY by the VFA. It certainly “unequal” that a convicted American rapist should be able to stay in the luxurious US Embassy rather than Bilibid Prison with the rest of the Filipino convicts. As for Nicole, there is also however a grave inequality being done to her by the VFA. You see, since November 1, 2005, when she was evidently raped by Daniel Smith, the National Statistics and Coordination Board reports that some 3000 Pinays have already been raped by Pinoys, many of them their fathers, uncles, brothers or cousins and neighbors. But NONE of them, to my knowledge has gotten the degree of justice that Nicole, because of that God-awful, unequal VFA with its insane insistence on “Justice delayed is justice denied”. When Leo Echegarray was executed, his crime was already 14 yerars old!

    We should demonstrate against the VFA for such unequal treatment of Nicole!

    I don’t know why Filipinos would even want to publish the BS of some announcement that can be construed as an insult to the mentality of the Filipinos given by some meddling staff of the US embassy.

    Judge Pozon may cite cases in Japan where offending US servicemen are given to the custody of the police and the court before and after indictment for proper criminal prosecution according to Japanese laws when the crime is committed in Japan regardless of whether the case is outside or inside the Philippine base and when the offending serviceman is on a furlough and not wearing any uniform.

    The Americans may as well remember that the Philippines is a sovereign nation even when it is presently headed by a bogus president, who should be kicked out as a matter of fact to make the Philippine position valid and legal. Any agreement with the US by this Great Switik should in fact be considered null and void! 😛

    Smith should not be turned over to the custody of the US Embassy while appealing his case first to the High Court (Mataas ng Hukuman/Dulungan ng Pilipinas) and then if he still insists that he should not be sent to prison despite the evidence of semen, etc. to prove that he has committed rape, to the Supreme Court (Kataas-taasang Hukuman/Dulungan ng Pilipinas).

Americans–4 million of whom are also of Filipino extraction–and responsible for most of OFW remittances, detest, punish and condemn rape far more than Filipinos in the Archipelago, who seem to tolerate it, or won’t punish it as long as it is Pinoys doing it to Pinays! A good fraction of the informal jury of the people still have doubts of Daniel’s Smith’s actual guilt. By the way, he has not yet lost the presumption of innocence — ask any lawyer– to me that means the “judicial proceedings are not over.

    Many here disdain JDV and the House Majority for changing the Rules in the middle of the game to get Con-Ass. Yet isn’t that what many here want us to do with VFA?

    But okay, to substantial arguments…

    Equal protection under the Constitutions of the US and the Philippines are entirely equivalent in concept. In practice it is always a problem.

    But every govt has an obligation to uphold the rights of its citizens. Just because the Philippine govt does not usually do so, is an invalid reason to demand that the US govt do the same.

    But let me make it more concrete.

    Filipinos consider mutilation of one’s penis to be an inhumane punishment, even for rape. Likewise, we find it abhorrent that in many Muslim societies they stone women adulterers to death (but not men adulterers).

    Suppose we decide to help out Darfur (Sudan) or Somalia by offering to send humanitarian forces there, like doctors and nurses. I would certainly find it reasonable for the Philippine govt to want guarantees from the UN that any Pinay nurses caught cavorting with Somalis or Sudanese not their husbands and reported to Somali or Sudanese authorities as “unholy women” are not subjected to some of the local laws and customs.

    Now, since Pinoys also do rapes at an average rate of seven a day (three of them just since I registered this morning) it is not inconceivable that one of those Pinoy doctors commits rape. Are we actually forced to accept the Sudanese and Somali practice of stoning women adulterers, chopping off limbs of pickpockets and robbers, in order that we shall respect their sovereignty, especially AFTER they may have agreed to exempt us from those customs and laws? Would it be immoral and an act of treating the Sudanese and Somalis unequally for us to demand a level of humanity WE are accustomed to, and negotiate for an Agreement with them to address this. Or would we be imperialistic in doing so?

    I think, one day, the shoe will be on the other foot. What is sauce for the goose is sauce for the gander. But we are lost without moral consistency to guide us in all things and not treat everything like a spectator sport in a game between nations.

    Else, we shall never have self-respect. Only cold, hollow ideology.

    Just take a poll of people you know (but not on this thread!)–betcha a good fraction of them side with Smith. Some because this really does not look like a Maggie de la Riva type rape (which burned in my young mind that Rape is Evil, especially when that nice young man basilio pineda had all his hair shorn off and sparks went into his brain). Some call it a “date rape.” Betcha he gets marriage proposals and offers of adoption or help.     No accused loses his presumption of innocence until final judgment is rendered by the competent court.

    But what some want to do is just what JDV and House Majority did: Just the First House and that’s it! Case closed. It’s not Con-Ass by Dan’s Ass, eh?

    If that was your son or daughter in a Somali or Sudanese jail, and a lynch mob of them on carabaos and bolos show up at his or her trial crying blood and demanding that the Visiting Filipinos Agreement they signed ten years ago is no good and unfair to THEM! Well what can I say but…

Actually, the reason I was curious about your answer was because, as you had already mentioned, “Just take a poll of people you know (but not on this thread!)–betcha a good fraction of them side with Smith.” I actually have asked several friends of mine, and quite a number of them have expressed their doubts that Lance Corporal Daniel Smith was guilty of rape. In fact these very people I have spoken to about this issue feel that it was consensual sex.

    As I mentioned earlier, I remain confused..There remains to be unanswered questions on my mind:
    1) What was “Nicole” doing at a place like “Neptune” Bar ?
    2) Why did she agree to ride with these military men alone ?
    3) If my memory serves me right, she (or her family ?) owns a bar in Subic that is frequented by U.S. Service men. Wouldn’t she have had first-hand knowledge already, or even have an idea at least of what these U.S. Service men do or want when they unwind in her bar ?
    4) I remember that the first time “Nicole” came out shouting, “Rape”, she said that all the men in the van raped her. I took that to mean that she was gang raped. Why did she recant her earlier story and say that only one person “raped” her ?

    We can just imagine the pressure exerted on Judge Pozon in rendering that decision. May natitira pang mga matitinong judges na tulad niya. Mabuhay ka Judge Pozon! Hindi naman natin masisisi ang Amerika kung bakit ganoon na lang ang pagtanggol nila kay Smith. That’s just normal for a country to protect her own citizens. America knows who to bully. Malas lang nya at siya ang nasa ganong situwasyon. Isang halimbawa na lang, isa kang ehemplong mamayan ng U.S. Araw-araw nagtratrabaho ka, nagbabayad ng buwis sa tamang panahon, may pamilya, ulirang ama. Pero minsan sa sobrang pagmamadali mo nahuli ka dahil sa overspeeding at binigyan ka ng ticket, masasabi mo na bang masamang tao ka? Nahuli ka ng overspeeding, ang kapalit non ay speeding ticket at multa at puntos sa insurance. Sa tingin mo ba patas iyon sa yo dahil isa kang mabuting mamamayan? Ganiyan lang ang batas.

    Recently, what is perhaps the next most significant victory for Philippine sovereignty after the 1991 Philippine Senate decision to dismantle U.S. military bases from the Philippines was achieved through the conviction of a U.S. military serviceman for rape by a Philippine court. This victory was achieved despite the special treatment accorded to the accused by the Philippine-U.S. Visiting Forces Agreement. Thanks to the victim Nicole and her family who refused to be bribed by the accused and their backer, the United States government, the mightiest superpower on earth today. Thanks to the brilliant legal acumen of Nicole’s private prosecutor, Atty. Evalyn Ursua, as well as the victim’s support groups, ranging from civic organizations to women’s organizations from the broad political spectrum. Atty. Ursua, who graduated class valedictorian from the University of the Philippines College of Law, made her alma mater and the U.P. Faculty proud, for this historic legal
    victory.

    We commend the decision of Judge Benjamin Pozon of the Makati Regional Trial Court in upholding the rule of law and the majesty of the Philippine judicial system in giving justice to Nicole, the Subic rape victim. Likewise, Judge Pozon’s decision to assert the jurisdiction of the Philippines over the convicted U.S. soldier, Lance Corporal Daniel Smith, has put to shame the officials of the Philippine Department of Justice, Department of Foreign Affairs and the VFA Commission. These officials, who are siding with the U.S. government’s position that the
    United States should have custody over the American soldier during the appeals process even after conviction by the trial court, have shamelessly become spokespersons and lawyers for foreign interests .

    Now, after conviction by the Philippine Court, the U.S. still wants to expand special treatment for U.S. Lance Corporal Smith who has been staying in a 5-star hotel all throughout the trial, with bodyguards and the luxurious amenities of a foreign diplomat. The U.S. government now
    threatens to suspend the year-round Balikatan military exercises and the U.S. military assistance that ostensibly go with it. Well and good. Let them eat their words.

    The best thing that could happen to the Philippines right now is for the Balikatan war exercises to be scrapped permanently, for the Balikatan has only been used as a smokescreen for U.S. military intervention in the Philippines under the guise of “anti-terrorism training”. They expect the Philippine judicial system and our laws to cave in to this threat. We cannot bargain the wheels of Philippine justice for supposed “goodwill in RP-US relations”, U.S. military intervention and a
    few crumbs of assistance from the U.S. global anti-terror campaign. This is a question of justice that cannot be compromised.

    Let us also take a hard look at the Visiting Forces Agreement (VFA) and work towards its immediate abrogation. The VFA has only been used to give special treatment and extra-territorial rights to U.S. forces committing crimes on Philippine soil and violations of our laws, while
    engaged in so-called military exercises. This country and most especially its top officials should learn to obey its own Constitution which guarantees “equal protection before the law.” This is what Judge Pozon has taught all of us to assert in our own country.

    This is why this country has difficulty in taking the road to progress, national self-determination and national development: its officials would rather protect the interests of powerful foreign interests, rather than the interests of their own people. Our own Filipino officials are often our own worst enemies.

    Charles Bohlen, who served as U.S. Ambassador to the Philippines in the 1950s, once told a Filipino audience:
    “We in the U.S. Embassy are here to protect American interests. We expect your officials to protect your own interests.”

    For the coming year, we wish everyone more victories in the continuing struggle for national sovereignty and democratic governance.

    Delivering on their promised holiday celebration for Smith, at least six members of the group “Justice for Dan Smith” also lit 23 candles for the serviceman, representing each day that Smith has been incarcerated in the local jail. The group was not allowed inside the jail and handed the gifts and letters to a jail guard.

    “This is my first time to come here to show my support for Smith. He is away from his family, his country, and he is pitiful so we have to help him. I am also a mother with children around his age, and it somehow feels painful for me too. I just want to know the truth,” said Ligaya Tauro, 52, a wife of a Filipino Air Force colonel who came all the way from Sangley Point in Cavite to take part in the activity.

    Comment: Walang masama ang magbigay ng suporta sa isang bilanggo. Kung ang katuwiran ng mga babaeng ito ang susundin, di dapat ganoon din ang gawin sa mga nakakulong na kababayan nating Pinoy sa Amerika. I still think such activities being undertaken by these alleged wives of military personnel are being financed by a group connected to the US Embassy.

He’s still human after all susceptible to commit mistakes. But being the man possessing years of experience in hearing other cases, I don’t think he made an error in interpreting the law.
