Court martial against against 30 officers did not push through

Following is Victor Reyes’ account of the postponed arraigment yesterday for Malaya:

CAMP CAPINPIN, Tanay, Rizal – A military tribunal on Thursday failed to arraign dozens of officers linked to the failed February coup after the proceedings were marred by legal wrangling,

Lawyer Vicente Verdadero questioned the constitution of the general court martial as soon as he was introduced by the plot’s alleged leader, Brig. Gen. Danilo Lim, as his counsel.

Verdadero told the court, headed by Lt. Gen. Alexander Yano, that his appearance does not mean that the defense recognizes the validity of the court.

He said the defense will question the legality of the tribunal before civilian courts.

Abraham Espejo, counsel for accused Lt. Cols. Edmundo Malabanjot and Nestor Flordeliza, also questioned the legality of the convening of the tribunal by AFP chief Gen. Hermogenes Esperon.

Verdadero and Espejo said the tribunal is “invalid, illegal and unconstitutional” because Esperon, who ordered the court martial, is the complainant, the reviewing authority and the executioner of any decision against the accused.

More than 20 civilian lawyers, on top of designated military lawyers, represented the 30 accused either as lead or collaborating counselsd. Many of them also supported the contention of Verdadero and Espejo.

Homobono Adaza, a counsel for accused bemedalled Marine Col. Ariel Querubin, said: “We are moving for the dissolution of the court on the ground that it is illegally constituted.”

The defense lawyers were repeatedly reminded by the court, especially by law member Col. Marian Alledo, that it was not yet time to question the legality of the court because its members have yet to be sworn in.

Another round of arguments ensued after Esperon’s staff judge advocate, Col. Pedro Herrera Davila, informed the court that the AFP chief has dropped charges against Marine Lt. Cols. Romulo Gualdrapa and Valentine Hizon.

The defense lawyers ganged up on lead prosecutor, Col. Ukol Paglala, asking him to prepare an amended charge sheet in view of the clearing of Gualdrapa and Hizon.

Paglala said erasing the names of the officers from the charge sheet will suffice.

The defense lawyers demanded the charge sheet be amended because their clients are accused of “conspiring and confederating” to commit the supposed mutiny.

All the 30 accused arrived except for Marine Col. Januario Caringal who is still recuperating at the Manila Naval Hospital from hypertension and Hepatitis B. He was previously confined at the AFP Medical Center.

Of the accused, 19 are from the Army and the rest from the Marines. Except for Capt. Dante Langkit, the Army officers are detained in this camp, the home of the Army’s 2nd Infantry Division.

Langkit is confined at the Army headquarters in Fort Bonifacio.

The Marine officers are detained at the Bonifacio Naval Station in Fort Bonifacio and at Fort San Felipe in Cavite City.

All the accused Army officers – except Lim – arrived handcuffed to their custodians.

Like Lim, the Marines were not handcuffed but were followed by their escorts everywhere they went.

    Speaking with reporters after attending the weekly briefing of Executive Secretary Eduardo Ermita, Gonzalez accused Pozon of wrongly interpreting the provisions of the VFA in order to “suit his agenda.”

    He said the judge was “sympathetic to Nicole and leftist groups.”

    “I think his agenda is to please the Left,” Gonzalez said, adding: “Maybe he thinks that by doing so, he would be praised and would get the kudos and hosannas of certain sectors.

    “He’s sympathetic to the victim. He’s sympathetic to those who support the victim, and who are those supporting the victim?”

    There is no need to rush the arraignment of the accused soldiers as it is very clear that what Esperon wants to happen is to shut the mouths of these soldiers. Releasing two officers before the proceedings started was also demoralizing on the part of the soldiers to see that the whole justice system in the military is very unprofessional.

    We do not even have a copy yet of the PTI report. We are not idiots to accept the reason this morning of the GCM panel that the PTI report is a privileged communication…Huh! Are we under martial law?

    What kind of prosecutors do they have in the Philippines? Ang bobo naman!

    Over in Japan, a person cannot be indicted in a Japanese court without any case being proved by the prosecutor with the help of investigators to have been committed, or when there are evidences of forced confessions, or what they call as “insufficient evidences” to prove culpability.

    Anong klase iyan? Ni hindi nila alam kung ano ang ikakaso sa mga sundalong, even those who refused to follow some order for them to kill innocent civilians by planting bombs on the path of rallyists to blame them for some terror scare made in some AFP camp and/or the palace by the murky river.

  6. Lieutenant General Alexander Yano should have had the balls to do this bogus Court Martial with absolute haste so that the officers can join their families for the holiday season.

    If he doesn’t know that Esperon is simply making bastos of military laws, LtGen Yano should be arraigned himself for lacking the brain and worse, the balls!

  7. The truth is there is no other pre-trial investigation report other than the one prepared by the panel headed by Col. Al Ferreras which recommended that charges of mutiny agaist all the respondents be dismissed and that they stand trial for conduct unbecoming of an Officer and Gentleman.

    What kind of military asshole leadership do we have that they should make a mockery of basic decency.

    This is the time when the good officers and men of whatever military we have left should rise and put order in THEIR camps.

    How can we trust them to defend the sovereignity of the nation when they cannot even put ORDER in their own institution.

    If they continue to allow this brazen violation of military traditions, they will end up no better than the mercenaries in West Africa selling their nation to the highest bidder!

    Nung Wednesday evening lang daw pala sinabi ni Esperon kay Davila na hindi na isali ang 2 colonels. Ganun lang pala yun kadali. Pwede bang tumawag siya uli at sabihin na released lahat ngayong pasko? Eh isang tawag ka lang pala style nya eh. Tapos pina reinstate niya pa ang isa na retired na into full duty status.     Another sad state I would like to point out is how the Rangers are treated. Not because my other half belongs to the Black Panthers but simply because there are biases between the Marines and the military. Bakit kelangan posasan ang mga Rangers na nasa Capinpin lang at yung mga naka aircon na Marines eh labas masok lang sa korte? Di na yan divide and rule tactic siguro. Kabobohan na yan. Life, Liberty and Property na ang issue dito kaya di pwede na parang naglalaro na lang ang mga taong may hawak ng kapalaran ng mga sundalong ito.

    Pag pinag take ng MENSA si Esperon, siguradong bagsak yan sa sobrang kabobohan. Anhirap na isang taong bobo ang magdidikta kung anong mangyari sa buhay ng mga sundalong ito. Naku, next time na bumisita yang Esperon na yan sa UP, lahat kami di na itlog ng manok ang ibabato, yung itlog ng mga ostrich dun sa Camp Tecson ang kukunin ko at ibabato sa kanya. Mas matalino pa yata mga ostrich dun kesa sa bobong yan.

    Come to think of it, Col. Varilla must have something in his mind when he issued that warning that he will arrest any politician speaking at the stage in Luneta.

    He may be referring to GMA, who, in earlier reports, would like to attend the prayer rally. Siempre, as the occupant of Malacanang but not necessarily the duly elected president, pagbibigyan siyang makapagsalita. Siya lang among the politicians.

    After reading the opening post in this thread, I first thought it was off-topic, deeper thinking however made me realize the opposite. Look, the entire executive branch is on a mad jockeying to make the his move to please the Amercian soldier who raped a kababayan. Lahat yata gustong sumipsip at sumakay sa malibog na si Smith papuntang Amerika. From the jail marshalls who play chess with him inside one of the airconditioned offices, to the DOJ staff members who make him coffee, to Gonzales who lambasts the judge, to the DFA who wants to fly Smith out on the first plane.

    On the next post, we hear the sad plight of our own detained soldiers, coming from one of the soldiers’ wives, the injustice being dealt them for an offense that has never even been committed.

    It’s inexcusable that while a rape-convicted foreign soldier is treated with kid gloves by the “offended” country’s Executives (Amb. Gaa, in the news just this evening has officially informed the White House that the Phil. Govt fully supports US custody of Smith, and include that pronouncement of Sir Raul O. Gonzales posted above), our own Rangers have been languishing at Camp Capinpin for an imagined crime.

    It’s also appalling that the Justice Secretary, instead of praising the judge for making such a brave decision, had to resort to Red-Labelling just because we might have pricked Uncle Sam’s sensitivity, never mind that one Filipina was raped.

    Just goes to show what this government works for: the selfish interests of its leaders, who are on a survival mode from day to day.

    Incarcerating this soldiers was an offshoot of Tiyanak’s 1017 proclamation( ala-martial law). The tiyanak said that the right aligned with the left to overthrow her. Quite honestly, the tiyanak herself did that act of alignment to overthrow Erap. So, now she thinks that these soldiers are copy cats. I do not think so. These soldiers she is branding as “coup plotters” have morals to discern what needed to be done for their men who were so agitated because they were used in the rigging of the 2004 elections. Worse, the Mayuga whitewasked report cleared these riggers. Tiyanak, thru Assperon have to show to the whole AFP that if a soldier goes against his boss, the tiyanak, the prison and a possible dismissal without pay and benefits are inevitable. But they are dead wrong because the sentiments of a lot of the soldiers are with these incarcerated men in uniform. Two of the marine officers are MEDAL OF VALOR awardees, Querubin and Parcon. Just two of 13 medal of valor awardees alive. These two men served their country beyond their call of duty unmindful of their own safety. THAT IS A CONTRAST TO WHO TIYANAK AND ASSPERON ARE, THESE TWO DESPICABLE CREATURES ARE ONLY THINKING OF THEIR SELF PRESERVATION,TO BE IN POWER FOREVER AND EVER. AMEN

    Also, why are they harassing Judge Pozon?

    The Makati judge is a Filipino judge who did his work, rendered his judgement on the basis of Philippine laws which is the way it should be done, regardless of who or whatever national was in the docks.

    The accused committed a crime against Philippine laws – political considerations even they concern our major ally should have no bearing at all on the way how or why Judge Pozon must interpret the law, i.e., in favor of the accused or in his disfavor.

    America is abusing Philippine good will by intimidating Judge Pozon. This is NOT right.

    I may like Ambassador Kenney but when it comes to principles of justice, she should know where and when to toe the line.

    She and her government must not intimidate a Philippine judge who did his job according to the dictates of his conscience and to serve justice. FULL STOP!

    Futher, Anna, Amb. to Washington Willy Baja has just committed our official position on Smith’s custody to no less than Dubya himself. I can foresee Pozon’s decision to jail the convict in Makati being overturned by the Appellate Courts any time now.

    Hey, many law experts have said that negotiations for custody in such a case should be undertaken by top-level bureaucrats, not by a small fry like Zuño who signed his concurrence with the embassy memo to reclaim Smith. Now, surely, its has been elevated to the top level and the eager Ambassador wasted no time to lick W’s puckered exhaust pipe and reiterated the subject’s submission to the wishes of the master. You call that negotiation?

    I liked Kenney, too, until she spoke about the donations and aid on the context of collecting payback by way of Smith’s acquittal. Her mishandling of this case may have cost her the early termination of her tour of duty.

    Additional information:

    The court convened at about 9 am. All accused officers were accounted for and were made to introduce their defense lawyers.

    The battle began when the military prosecutors insisted to shortcut the process by quickly swearing in the members of the court thereby constituting it “legally” and would then proceed to arraignment.

    The officers’ lawyers complained that proceedings should not push through until they have the copy of the signed PTIR which is the basis of the charge sheet since the accused were given copies of the charge sheet only.

    Art 36a of Manual for Court Martial clearly states that: ”No charge shall be refered for trial until after a thorough and impartial investigation thereof shall have been made”

    Further, Art 36b states that “No appointing authority (Gen Esperon in this case) shall direct the trial of any charge by GCM until he has considered the advice of his Staff Judge Advocate (SJA- Col Davila) based on the information relating to the case…..the advice of the SJA shall include a written and signed recommendation of the action to be taken by the appointing authority. Such recommendation will accompany the charges if refered for trial”

    The prosecutors insisted that the trial can continue even without the PTIR citing a Supreme Court decision re: Commendador vs PP. The defense retorted that the said case cannot be applied to their clients because in the case of Commendador, the respondent did not attend a pre-trial. It was a (pre)trial “in absentia”

    Again, the prosecutors insisted that a charge sheet is more than enough to continue the trial.

    To their dismay, the defense lawyers asked the prosecutors if it is possible for the Chief of Staff AFP to accuse anybody and convene a court martial without a thorough and impartial investigation. The prosecutors quickly replied: “YES!”

    One annoyed accused officer commented: “ptna, baka gusto pa nila tayong i-charge ng murder!” His co-accused jokingly replied: “ok lang kung ganun, wag lang tayong i-implicate sa Helo Garci.”

    As if to save the day from “infamy”, the law member of the court promised to furnish a copy of the PTIR “later” because it was impossible to photo copy a 210-page report and that there are no photocopier in the area. Moreover, the copy of the PTIR should be requested thru proper channel and not through the court martial since it is not yet constituted.

    Again, the defense lawyers complained. For many weeks they have been waiting and making rounds in GHQ hoping to get a signed copy but they were not entertained.

    Finally, Gen Yano suspended the hearing until Jan 11 next year.

    Observers, relatives and even soldiers present during the hearing can only comment: mas malala pa sa kangaroo court.

    The military injustice continues.

    I have actually made suggestions to my barkada to get softwares that can prevent any attemt by the Malacanang Internet Brigade to block off our participation in this blog.

  34. I love this Querubin. He has restored my faith in the Filipino. I saw him during the stand-off in February on the video clips sent to us for translation into Japanese. I kind of sympathized with him then as he felt helpless that they were being told to kill the very same people he had taken an oath to protect. He was talking about some bomb being ordered detonated at the path of the rallyists and being blamed on the “reds” and that he and his fellow marines refused to follow.

    Pinahanga niya ako sa kagitingan niya even when he actually looked pathetic then. Very principled indeed. So with Trillanes even when they were actually defying the military that they took an oath to serve. At least, he knew how to distinguish between good and evil, virtue and vice, legal and illegal.

    May his tribe increase! Sana sa linggo dumami pa ang may yagbang sundalo!!!

    Assperon thinks that he is above the law. He thinks that even if he does not follow the rules of law, he can still convict these respected soldiers. But he is dead wrong! These principled soldiers are not taking Assperon’s unfounded accusations lying down. These soldiers are fighters.If the law of the land will be followed to the letter, Assperon do not have a foot to stand on. Assperon committed a lot of blunders against these soldiers. He had repeatedly violated their human rights. He will go down in the history of the AFP as one of the most corrupt and insensitive Chief of Staff. All these because of his loyalty to a bogus president.

    Assperson doesn’t only THINK that he is above the law, he thinks HE IS the military law.

    He doesn’t know what he is doing or if he does, he has complete disregard for the military law.

    When he uttered in a manner of speaking “I can do whatever I want with them (referring to the detained military officers)”, he is in fact showing his full ignorance of what the military law is.

    By saying such, he has instituted an ignoble Assperson’s Law but what he doesn’t know or fails to realize is that there’s such a thing as Murphy’s Law which is bound to arise when he least expects it precisely because he is dumb, he is unprofessional and because he chooses to violate with impunity the basic human rights of the military officers.

    He committed not only a grave military indiscretion but also a clear violation of the basic military rights of Lim and Querubin and all the others when he detained them for a long time without access to military lawyers. In a professional military, whatever those officers may be accused of, their rights were brazenly abused.

    Moreover, in the aftermath of the February brou ha ha, Lim, to my mind did not commit any serious wrongdoing because had he done that, General Senga would not just have sent him back to his quarters.

    The fact that Senga, the AFP chief at the time was stared down by the Philippine Army Commanding General at the time is very telling of the serious unprofessionalism in the AFP.
