Speaker Jose de Venecia succeeded in forcing the nation to accept President Arroyo and his House’s unwanted “Christmas present” to the Filipino people with his congressmen last night succeeding in blocking all moves from the opposition to stop them from amending the rules of the House that pertain to the exclusion of the Senate in matters of convening as a Constituent Assembly (Con-ass). They railroaded the approval of amendments to the House rules through thr tyranny of numbers.

But the Senate is also working out measures to block the one-House Charter change (Cha-cha).

The amendment of the rules is seen as the first step of Malacañang and the House majority to ram through the one-House vote Con-ass, which is expected to bring about the postponement of the May 2007 elections, and the automatic membership of the incumbents in Congress to the Interim Parliament following an early February plebiscite.

The House leadership yesterday made good its promise that, by hook or by crook, the Cha-cha train will move, and move faster than the bullet trains in Japan and Europe.

This was evident when all the efforts exerted by the House minority failed in thwarting the moves of the majority to fasttrack Cha-cha moves by first amending the Rules of the House during the plenary session.

But senators are not about to let themselves be “outwitted” by their lower house counterparts, in getting the Charter change proposal to take off anytime soon, as they set out a brainstorming to plot out their move.

Prompted by administration Sen. Manuel “Mar” Roxas II, who took the floor and expressed serious concern over the events that have transpired during the afternoon plenary session in the House of Representatives yesterday, this move was relayed by Senate President Manuel Villar Jr.

The Senate chief informed the senators they are now readying plans to block the lower house’ resolution calling for the convening of Con-ass and that this would include not only a formal resolution expressing their sense on the issue but also move for legal action to be brought before the Supreme Court.

“We are preparing a resolution reiterating our position that this is a bicameral form of government and the House of Representatives cannot unilaterally call for a Constituent Assembly. This resolution is being prepared by the majority floor leader.

“And of course, at the appropriate time, maybe after a resolution, we could have a caucus among the senators to discuss what our course of action should be. Maybe this week,” Villar said, adding that “our legal (department) is also preparing, just in case and in fact, this is what we are anticipating, that we will have to file with the SC. We are also getting ready for that,” Villar added.

Roxas, in pointing out his concern over the actions being taken in the lower house said this could be “the opening salvo to a sequence of events “that to my mind will unalterably destroy our system of government, our democracy and our way of life.”

He added: “I bring this to the attention of the Chair as well as of our colleagues here because even as the process itself is legal, all of us, every single one of us are also political creatures and while there is, in fact, a legal track for addressing and responding to these matters, there is also equally a political track and hopefully, these are the matters that will be discussed in caucus so that those like-minded can then move accordingly,” Roxas said.

“As we speak, our colleagues in the other chamber, the House of Representatives, are in the process of amending their own rules, which is preliminary to their stated and avowed goal, moving forward on the Constituent Assembly process as enshrined in our Constitution.

“They have a unique interpretation of the contents of this provision in the Constitution. Accordingly, the rules of the House are being amended with this new unique interpretation, that is prevailing.

“Todate, the actions are internal to the House and after consulting with the lawyers, they informed me, precisely because it is internal to the House, there is an absence of an ‘justiceable’ or ‘objectionable’ event. So I leave this matter to the legal fraternity.

“Most substantially, however, these actions, preliminary as they are, are the opening salvo to a sequence of events that to my mind will unalterably destroy our system of government, our democracy and our way of life.

“But now is not the time to discuss or debate what I think about Con-Ass or PI (people’s initiative) or Charter change.”

He said he rose as he wonders what the Senate, a co-equal part of a co-equal branch of government, and as an institution, is contemplating of doing in order to establish what the Senate response will be to what he called an assault on the system of government.

“What are we as an institution thinking or developing as a response to this?” he asked.

The senator was assured as well by Majority Leader Francis Pangilinan that a concrete institutional response to the ongoing effort of the House of Representatives already is underway.

Meanwhile, Sen. Ralph Recto today asked the Speaker “not to let the ‘Con-ass’ train leave the station if no senators are on board as this would plunge the county into a constitutional crisis.”

He said that like a train, the constituent assembly should run on two rails so I hope our House leaders know the grave repercussions of their action.

He stressed that the Con-ass can only be convened with the consent of the Senate and with it voting separately from the House.

Recto predicted that the Supreme Court would stop the “bullet Con-ass train if it sees it to be recklessly running on just a single rail.”

He admitted that “consultations are happening on both sides of the aisle on the possibility of asking the Supreme Court to rule on the legality of a House convening itself as a constituent assembly without the Senate.”The bottomline is that the House will be challenged in court. I think that’s the proper and democratic way of settling differences,” he said.

The House leadership started the Cha-cha ball rolling on the proposal raised last week by administration congressman Arturo Defensor (Iloilo) through the tyranny of numbers.

Using the strength of their numbers, four more administration congressmen rose to second the motion of the resolution made by Defensor that endorsed amendments of the House rules paving the way for the immediate passage of a resolution seeking the convening of Congress into a Con-ass.

Not even the disaster of a Typhoon Reming stopped two Palace congressional allies, Reps. Luis Villafuerte (Camarines Sur) and Edcel Lagman (Albay), whose districts are still reeling from the damage Reming wrought on their constituents stopped them from being in Congress and actively ramming through the rules amendment.

Malacañang allies Constantino Jaraula (Cagayan de Oro), Villafuerte and Lagman quickly seconded the Defensor endorsement to delete Section 105 of the House Rules.

Section 105, which members of the majority deleted, states that “proposals to amend or revise the Constitution shall be by resolution which may be filed at any time by any member (of the House). The adoption of resolutions proposing amendments to or revision of the Constitution shall follow the procedure for the enactment of bills.”

The majority deletef this provision, saying that this must be changed as the House had committed an error when it included the same in the Rules, which have been the guide of the past Congresses.

And with their push to have the provision to be deleted, this will no longer go through the usual process, which means that the Defensor resolution endorsing Con-ass will no longer go through the First, Second and Third Reading, and will no longer be treated as a legislative measure, as the rules state.

The proposal to effect the Con-ass, the administration congressmen stated, should not be treated an ordinary bill.

“It should be emphasized that the resolution (for Con-ass) is not an ordinary but a special resolution, thus it should not be likened to ordinary bill,” Villafuerte claimed.

Rep. Douglas Cagas, apparently admitting the errors committed by the past Congress, said it is the duty of Congress to strike out rules or provisions in the House rules that run counter to the Constitution.

“It is the duty of the Congress to strike out rules that run counter with the Constitution. It should be amended by deletion. It is not only proper but our obligation to strike out the provision that is not in conformity with the Constitution,” he said.

Apparently, what the Arroyo allies refer to is the silent provision in the Constitution that merely states that Congress is to vote on a Con-ass measure, which the House leadership interprets as voting with or without the Senate participation.

Opposition Rep. Agapito “Butz” Aquino (Makati City) argued that it would be inappropriate to amend the rules if they do not apply to both houses of Congress.

“Is this chamber to proceed with the plan even without the Senate? The rules do not apply to the other chamber, the Senate, because it has its own rules. Even if the majority succeeds in amending the section of the rules, this only applies to us, not the Senate. Amendment to the Rules, for me, is patently unconstitutional and inappropriate if not immoral,” Aquino said.

Parañaque Rep. Roilo Golez said he was surprised at the admission made by the House leadership when it claimed it had committed an oversight in crafting the rules, saying that he cannot accept this mistake made since it was the same speaker for the 9th, 10th and 11th Congress.

House deputy Speaker Gerry Salapudin, who presided over the session, shot back, saying that it was precisely the plan of the majority to amend the Rules because they committed an error in the past.

“So how can that motion have precedence over the Water Crisis debate that was unceremoniously terminated? The motion is out of order. According to parliamentary practice in civilized nations, a motion to amend the Rules cannot just be sprung from out of the blue by any member of the House,”Golez insisted.
