Joc-joc Bolante lies and lies

This is lawyer Harry Roque’s report on the trial of former Agriculture Undersecretary Jocelyn “Joc-Joc” Bolante:

As expected, Joc-Joc Bolante filled the Chicago Immigration Courtroom with falsehood and lies. While he initially reiterated matters which he mentioned in his affidavit when he was apprehended in LA, such as, that he had a valid US visa and that he did not get any of the two letters sent to him by the US emvbassy in Manila about his visa revocation; he nonetheless submitted that he was a victim of political persecution on the part of the Philipine Senate.

Some of the preposterous lines of Bolante were as follows:

1. The “warrant of arrest” issued by the Senate is invalid as the Senate has no power of arrest. This is an outright line given the Philippine Supreme Court’s recent decision in Sabio v. Senate ofthe Philippines which case reiterated the earlier cases of Arnault vs. Nazareno and Arnault vs. Balagtas, which rulings held that the power to conduct investigations is germane to the law making power of Congress and thus, the Senate could validly declare individuals in contempt to compel their attendance in Senate investigations;

2. The political persecution, according to him is made evident by the “bounty” offered by the Senate to procure his arrest. Acording to him, and this was self-aggrandizement, the bounty was for $200,000;

3. The Senate, particularly Senators Drilon and Magsaysay “usurped” the power of the House to impeach the President.

Bolante’s story line is that he is a victim of political persecution on the part of the Senators lusting for power and seeking the removal of the President through impeachment. He has forgotten apparently that impeachment as a constitutional process is intended as a means of promoting public accountability amongst ppublic officers.

Contrary to written submissions of Bolante listing me as one of three witnesses for the former Undersecretary, his counsels, who saw me in the corridor outside of the courtroom, did not call me as a witness. this may have been because of a belated realization that my testimony, even as a hostile witness, could never be in favor of Bolante. This was a correct decision on their part.

While Bolante testified from 9 AM, we were again forced to leave the corridor outside of the court room at 12 noon when Bolantes’s counsel, Atty Jod Azulay, saw us listening to the proceedings and some media professionals taking notes. He again requested the court to ask us to leave, obviously because he did not want witnesses to Bolante’s falsehoods.

For the remainder of my trip, I will devote time and effort to file the constitutional challenge against the order of closed door proceedings in Bolante’s deportation proceedings. We were today witness to what a US Court has previously said: that closed door proceedings destroy democracy.

  1. His US lawyers should have warned Bolate, Ellen, about telling lies in court. Over there, lying is not taking lightly. He can be charged with perjury which is punishable under US law. I should know, because we follow the same rules in Japan. I work as an interpreter for the court in Japan, and I do paralegal especially regarding cases in violation of the Immigration Laws of Japan that is now practically the same as that of the US, which has adopted some Japanese rules as to categorize violation of the Immigration Law as a crime, and violators treated as criminals.

    God really works in a mysterious way, Ellen. Just hold on tight there. Justice will be on your side (re the libel suit against you by one who is probably now in the list of whom God will destroy shortly).

    I’d like to share these verses from the Bible: “For ye see your calling, brethren, how that not many wise men after the flesh, not many mighty, not many noble, are called: But God hath chosen the foolish things of the world to confound the wise; and God hath chosen the weak things of the world to confound the things which are mighty; And base things of the world, and things which are despised, hath God chosen, yea, and things which are not, to bring to nought things that are:” (1Cor. 1:26-28)

    May he be imprisoned in the US, shamed and deported, and learn his lesson well. His story will be a good lesson to learn likewise to ambitious crooks who link themselves with the devil incarnates presently squatting, and fellow crooks likely to squat likewise at the palace by the murky river.

    I’m just curious, Ellen, as to who he refers to regarding the alleged bounty of $200,000, a very small amount for some American for example at the US embassy to accept and take the risk of losing their jobs when caught. It cannot even buy a nice cottage in San Francisco for example. Cheapie! Sinong maniniwala sa kaniya.

    Ms. Ellen, I think that “Mike Arroyo shoulders his legal fees and other expenses.” That must suck, though, for the 43 journalists that Mike A. is suing. He sues journalists for telling the truth and then financially supports a Joke; a person who is a party to the BASURA and BULOK system!

    Hopefully, he will stay in jail if he does not want to be deported to the Philippines soon. Mas masarap ang buhay niya sa kulungan sa Muntinlupa bakit ayaw niya doon. Iyon ngang si Jalosjos, nagpagawa ng bungalow para pag may bisita siya doon siya natutulog. Nakita ko iyon when I visited a Japanese inmate we were helping then to be free. Ngayon si Bolate naman ang puedeng magpagawa ng isa pang bungalow para sa kaniya at sa iba pang future inmates sa Muntinlupa na galing sa Malacanang. Sana nga! Amen!

    When we compare the crime that commited by Atong ANG and Joc Bolante there’s almost the same(pangungurakot ng pera ng bayan) So they deserve to go back in the philippines and punish both of them! build a cage inside the rizal park and put both of them;(ANG and BOLANTE) INSTEAD OF BEHIND BARS IN MUNTI. para kompleto na ang rizal park, and put a marker “Ang BAYANI at ang Salbahi” tourist spot pa! THEY DONT DESERVE TO HAVE A VIP TREATMENT IN MUNTI: No wonder why GLORIA abolished quickly the DEATH PENALTY or else her and thier cabinet members get one by one!!

    Maybe so. But there are instances that closed door proceedings are necessary evils in a Democracy. Like for instance for evidence involving a minor where a Public proceeding will divulge the said minor identity, especially today with the advent of internet where anyone can post anonymously that even a judge order may not be able to stop such leakage; or for the matters that concern National Security, which to the opinion of the presiding Judge, the welfare of the State could be jeopardized if publicly exposed. Or for evidence so Graphic that public proceeding will serve no purpose at all. These had been done in so many cases in our court history. We sometimes call it dancing with the lesser evil, where there is no other choice.
    But in Joc-Joc Bolante case, there is no identity to hide, no minor involve and I believe there is no “national securities” in jeopardy in any one side, so I totally agree with Atty. Roque why there is a need for any Closed Door proceedings. Unless of course, Joc-Joc is making a SECRET Deal.

How about the members of this blog writing to the court in charge of Bolate’s case to hasten the deportation of the Bolate since the case for which he is being incarcerated is Immigration related. We should also send the same petitions to the US Senate and US Congress as soon as they have settled down with new sets of officials.

    It is imperative that they take action now and soon on this case by deporting the Bolate to the Philippines sooner or grant permission for the Philippine Senators to interrogate him in the US with US authorities with the possibility that he has likewise committed money laundering by hoarding Philippine money to some US and other foreign banks.

    The perjury case, Schumey, is for lying under oath. It may be just a misdemeanor in the Philippines but in more progressive societies like Japan and the US, it is a serious crime punishable by fine and imprisonment.

    I believe this one as Bolante is so used to secret deals. Anyway, secret or no secret deals, Filipinos will know about Bolante’s pakulo through any means. And while his case is going on, let him suffer and feel the agonizing situation in prison. He deserves more than that, but the thought that he is “nagmamaka-awa” ngayon to get out of jail just makes me feel good.

    I would rather hang him with Mr/Mrs Pidal somewhere in the desert or helly them on top of the Pinas highest mountain and let them rot.

    Precisely my point. We would love to stay longer in the US away from the hands of the Phil. senate. He’s actually threading a thin line and one slip could land him back here or to lengthen his stay in a US prison.

Is it possible, Schumey, that this crook is deliberately lying to insure that he stays in the US rather be sent home where he is likely to be ordered assassinated by his crooked friends so he cannot talk since the crooks can always blame the Abus or the NPAs of doing so even when he is assassinated by hired killers paid with taxpayers’ money? Golly, Schumey, ang tindi, but rest assured that US justice, despite the flaws, is far better than the kangaroo courts in the Philippines.

    I bet you, even when the Americans have very little regard for Filipinos, and still must be considering them as subjects like the slaves of old, they will not allow themselves to look stupid by a crook like Bolate. As a lot many bloggers here say, and I cannot help agreeing even when I wish Filipinos had learned their lessons well, “Filipinos deserve what they get.”

    I am pretty sure that Senator Magsaysay will do his best to handle this case worthy of his father’s name that he cannot afford to tar and blemish by the cajoling of the pests in the palace by the murky river. Kahiyaan na ito, even on the part of the Americans.

    This is an international problem that the Americans will not allow to bog down, with or without those expensive US lawyers paid no doubt with Filipino taxpayers’ money. Even if, for example, he is financed with contributions from gambling lords, it is still Filipino money he is squandering.

    Tiyaga lang, Schumey. May hanggahan naman ang mga kawalanghiyaan sa totoo lang! 🙁

    Inevitably, some legal mind (the state prosectuor perhaps) in charge of prosecuting Bolante should be able to come up with the correct version of what is in the Philippine laws.

    It’s his task to contradict Jolante’s and by extension, his lawyer’s version of legalese in the Philippines.

    Yuko, it seems you’re spot on! The guy would rather have his 3 square meals in a US penitentiary, swallow the last shred of human dignity he has, feel humiliated, bamboozled by, be accused of lying or PERJURY for as long as it’s done by a panel of whites! How extraordinary.

    Either that or he must have received a threat from the baboys in Malacanang that he would be better off in prison in the US because he is alive rather than return to Manila and be dead and buried.

    Japan is not easy on granting political asylum to anybody. I bet you, if this had happened in Japan, Bolate would be immediately turned over to the airline that brought him to Japan, and send him back home. If he claims to be a high ranking official, the Philippine Embassy will surely be asked to billet him in a hotel if there are no longer any flight back to Manila, and make sure to put him back on a flight back to the Philippines.

    He cannot go AWOL, because he could be put on a manhunt by the police as his case could be turned over to the police if he breaks the Immigration Law, which is criminal in Japan.

    Japan is not easy on granting asylum because it does not want to have friction with the government of the country of origin of the asylum seeker. Even famous people who have sought asylum in Japan has been turned down because of the said reason. And definitely, Japan will not allow itself to be privy to a crime as to cuddle a wannabe criminal with a pending case in the Philippines even when the Midget shouts at Siason to do something about this Joke2. Mapapahiya si Siason, because when it comes to implementation of the law, the Japanese do not see black or white as gray! Even lawyers here will not be privy to such crap especially when there will be group like ours that can protest and make a fuss about it. Takot kasi ang mga hapon sa scandal.

    The only ones I know given asylum here are the legitimate refugees from Vietnam, Cambodia and even Burma but only until they can be relocated elsewhere or when their countries are back to normal. Filipinos will have difficulty asking for Japanese asylum because (1) it claims that it is democratic, (2) it has US patronage, (3) they know Filipinos, starting from the Midget, are mostly good at lying!!!

    In short, Anna, he would be sent immediately back to the Philippines. Also, Japan does not give multiple permits to transit visitors or tourists. They apply for a visa every time they come here so that crooks like Bolate cannot make such claim as the illegal cancellation of his US visa.

    Assuming for example that he has a visa to Japan, cancellation of his visa cannot be considered illegal because it is a prerogative of the government of Japan especially when the Japanese government receives such petition as the one submitted by the office of Senator Magsaysay. Most likely, he will be put on the plane back to Manila because Japan would not like to get embroiled in such a messy case.

    Getting a visa to enter Japan is not a right. It is simply a privilege based on diplomacy as a matter of fact. Thus, he cannot claim that any illegality when Japanese authorities implement the law of Japan regarding immigration to Japan. He may try to sneak in as what many stowaway Filipinos do, but the police would go looking for him, and when caught, would put him in jail, indict, convict him in a Japanese court, and then after serving a term in prison will be deported.

    Prison in Japan, Anna, is unlike prisons in the USA or the Philippines. Mahigpit pa sa dilang mahigpit. Only immediate relatives and kin are allowed to write or visit prisoners here, no conjugal privilege is granted, and they are not free to move while serving in prison except perhaps when they sleep. It is to make them realize the difference between being free and not. The purpose is to give them a good lesson on living righteously or correct their evil ways. Otherwise, if they prove incorrigible, they get a death penalty!

    Ganoon kahigpit, Anna. I bet you the Americans would not like to be outdone by the Japanese in this kind of messy case that will not benefit them at all no matter how expensive his lawyers are, because the Americans, despite Bush, are on the whole not that stupid to be hoodwinked by a crook like Bolate. I still have faith in US justice somehow.

    Thanks for the inputs. Wouldn’t it have been great had he been cornered in Tokyo in stead so he could been sent back to Pinas without much ado.

    On second thought, had that happened, Baboy Pidal could easily have either killed him or hidden him leaving the unwanted effect that Gloria’s stinking scam wouldn’t have been exposed as it has been today.

On the other hand, Anna, the only political figure I know who has been granted asylum in Japan is Alberto Fujimori, because he is ethnically a Japanese and the Japanese government recognized the fact that his parents were Japanese nationals still when he was born and therefore was Japanese at birth, and according to our nationality law, he could apply for reacquisition of Japanese citizenship based on the family registry of his parents that are kept intact even when they could have applied for Peruvian citizenship later in their lives.

    Bolate will have difficulty asking for such privilege from the stricter and law-abiding Japanese! In fact, even with just one voice of protest, for example from me, would be enough to turn his petition down especially when there are valid proofs of his anomalous activities from the Philippine Senate versus Malacanang plus petitions from people victimized by this crook.

    I bet you Anna that the US would not allow this crook to go off the hook, with or without the expensive lawyers. Unless they can prove that he has violated any other laws in the US, he will have to be deported sooner than his lawyers would want it prevented. I don’t suppose Magsaysay can do something about postponing the departure of the crook from the US unless he requests the US to hold him there, and they be allowed to interrogate him there prior to departure for the Philippines.

    There are lots of legal options as a matter of fact. Atty. Roque for sure knows what he is doing. We should give him more encouragement and pep to continue what he is doing for the sake of truth and justice.

    Mabuhay ka, Atty. Roque! May your tribe increase!

  23. You bet, Anna, it would have been easy to see him back to the Philippines, kaya lang alam naman natin na ipapapatay iyan para hindi makahirit unless Magsaysay, et al insures his safety.

    Hindi naman bobo ang mga kano sa totoo lang. Sayang na lang ang mga CIA nilang naglipana diyan not to know about the real story of this case. Kaya lang sa palagay ko, the Americans would like to use this case as well to embarrass the Bansot that is why the attempt now to involve Rice, et al in this case to embarrass no doubt Dubya and Rice, who has no love lost with the Bansot. Ini-snub kasi ni Bansot iyan nang deputy pa lang siya ni Powell. Remember?

    Sabi siguro ng mga kano, “Is this what you want? OK. We give it to you, but beware of the consequences! Masama kaming pagalitin. Tandaan mo!”

  24. Like you, I’m happy that there’s a Filipino lawyer who can call “foul” when Bolante’s lawyer starts fiddling with the truth.

    While I don’t doubt that the US justice system and those who work for them at that level are knowledgeable, it is an advantage to have one legal expert from the Philippines who could help them filter the lies from the mouth of this horrible criminal, an inveterate coward of the horse or cow manure type.

    And boy, do I despise cowards…

  25. Sinabi mo pa, Anna. Kaya nga kailangan ang mga sulat ng mga pilipino to disprove his contentions that we know for a fact to be preposterous that his own lawyers themselves surely know to be fallacious and weak, but for the money they are willing to take his words to court.

    The last election has proved, Anna, that the voice of the people is still being heard in America. Thank God! Kaya sulat na kayo. If you need names and addresses, I have two at least who send me notices regularly, Senator Barbara Boxer of California and Rep. Pete Stark of Hayward and Freemont. Sorry, I made a mistake writing Senator Barber in a previous post. I was thinking of Barbara as a matter of fact.

  26. One thing sure, Anna, is that US courts do not tolerate liars, or that even if one is lying, he has to be extremely credible. This I have found out in fact when I sued some Filipinos in California for swindling me.

    Fortunately, Anna, I kept a diary of all my dealings so when my lawyers wrote my depositions, it was very detailed and could be clarified and confirmed and the people I sued could not rebutt my words and proofs that I have kept intact. I won my case, and I got a favorable judgement.

    The Filipino people may be able to get a favorable judgement, too, I bet. The Americans for one thing, despite their faults and imperfections, hate braggarts. The more Bolate call American names and try to involve big names in his case, the more likely he will incur the judge’s ire. Baka sabihin ng mga kano, “Anong palagay mo sa amin, gago katulad ng mga judges ninyo sa kangaroo court ninyo? Masaya ka! Off you go to hell!”

    The lies of Joc-Joc Bolante won’t pass thru verification, background and security checks. The United States Citizenship and Immigration Services (USCIS) will send a copy of Bolante’s asylum application to the US State Department, FBI and CIA. The U.S. Embassy in Manila knows the real score of the P729 M fertilizer scam unless US Ambassador Kristie Kenney looks the other way around to please Gloria and Jose Pidal crime family. The best thing we can do is to “pressure” (e-mail) US State Secretary Condoleezza Rice to reject Joc-Joc asylum application for the best interests of Filipino farmers. Let’s remind her that the United States is no longer a safe haven for kleptocrats. AMEN

    Is there any link between Atong Ang’s extradition to the Philippines and Bolante’s recent statements at the US court?
    I’m going back to my previous theory; that is, the US and GMA’s government might have some secret arrangement we don’t know. I’m sticking to this theory.

    I agree. Look at Chinatown…everywhere you go be it in the Philippines or Chinatown in other countries, it’s so dirty and messy. I don’t know why the authorities allow them to mess up like that. Could it be the authorities receive some weekly grease money as protection from these merchants? As for spitting, well, other nationals are guilty of such. I know that it’s very strict in Singapore. You get apprehended for spitting in the streets. Japan is also a clean country.

    chinatowns in London and other big cities in the US are much cleaner than before. They are subjected to a regular sanitary inspections by the health departments of their respective cities. Sa Pinas lang yata medyo madumi pa.

    There is also a Chinatown in Yokohama, where the foreigners were concentrated prior to WWII. It is pretty spic and span although policemen in Yokohama have been actively patrolling the area because of these Snakehead gangmembers preying on their own compatriots there, and for overstaying Chinese.

    We have no law like that of Singapore penalizing a person for spitting or throwing litters on the street, but we have kept our streets and surroundings clean because people here are just as disciplined and considerate to others. They know that they are not supposed to spit anywhere because it is unhygienic especially when a person is sick of TB. In fact, we even cover our noses with masks when we have colds, and use a lot of tissue papers to wipe our noses or to spit on.

    My niece was sent by her company in Japan for two months last year. She said that the three cities she visited were all very clean. Actually, she enjoyed Japan but the very thing that disturbed her was that, although with descent jobs, the Pinays she met seemed sad and lonely. Most of them, she said, told her that if only there are good jobs back in the country, they wouldn’t think twice to go home.

    Unlike you, already fully adapted to your chosen country of residence, and of course enjoying every minute of your stay there, these pinays are making a lot of sacrifice for their families to survive in the Philippines.

    Japan’s discipline I understand was rooted from the “word of honor” that the people still follow. My hubby collects Japanese movies on CDs. He likes Samurai Fiction a lot. Hindi ko nga alam kung lahi ng intsik o hapon itong partner ko dahil japanese ghost movies e meron collection :).

    I came to Japan ready to settle here. I studied Japanese from age 12, soon after I finished grade school, for the truth is I always felt that I should have been born as a Japanese for some reason I cannot explain myself.

    My upbringing is a combination of Japanese and Filipino so that when I came here, I actually did not find it difficult to adjust as you say, nor felt like a stranger. Still, with my parents and siblings far away and I was not used to living by myself, I felt homesick.

    The Japanese are by nature isolationists (not discriminatory), and would like to keep their society as Japanese as it is possible, but lately, with the increase in the number of international marriages, their outlook about mixing with foreigners has changed except that majority speak only Japanese and cannot communicate with foreign residents here. Not wanting to get embarrassed, they just stay out of the way of foreigners, who should actually be the ones to open the door to friendship with their Japanese hosts. To be able to make friends with the people here, they actually should learn the language, and even in fact the customs and traditions of Japan.

    Ang hirap sa ibang pilipino kasi, gusto nila sila ang masusunod at kakarinyohin. Not the Japanese, unfortunately!

    I love those ghost movies, too. Most of them are based on Lafcadio Hearns collection of folktales called “Kwaidan (Kaidan)”! My favorite is the “Yotsuya no Kaidan.”

    There is one that is remotely related to the tales of the clan that my Japanese family has originated from, the Taira Clan. My Japanese ancestor was surnamed “Waki.” It is not a very common name in Japan, but it is very Japanese and a branch of the Taira Clan or better known in history as “Heike” about which a legend has been woven and translated into English. The name of the book is “Heike Monogatari” (The Tale of the Taira Clan). This is in fact the reward of knowing one’s genealogy. Nagkakaroon ka ng pride, honor and dignity somehow.

    On the other hand, my husband has a genealogy dating back to 762 A. D. His a a Samurai Class on his father’s from Nagano Prefecture, and a vassal of the Takeda Clan. His mother, on the other hand, belongs to a priestly class with his great great grandfather being the first governor in his mother’s home province, Fukushima. Kaya mahirap gumawa ng kalokohan at makakasira ng pangalan.

    You bet, even now, there are still a great majority of Japanese living by some word of honor, honesty and decency even when they do not profess to believe in a god. Mas masahol pa nga iyong mga ungas sa Malacanang who pretends to be religious pero tignan mo naman ang garapalang ginagawa, pakabit-kabit pa! Pwe!

    I came to Japan in 1969, the year Morihei Ueshiba died. O-sensei means “Great Teacher” in Japanese. Other than that, I don’t know much about him.

    I have taken training in Judo but not Aikido as I used to live near the Judo headquarters in Tokyo, and it seemed but natural to be encouraged to do some training there. I never regretted it, because it gave me confidence that I could, and still can, defend myself singlehandedly when necessary.

    i find aikido the best of defense if one practices it with heart and follow its doctrines. it does not need force to execute, only precise speed and technique where one can subdue an opponent in a split second.

    i also believe it is a means to keep the whole universe in a positive relationship if introduced, practiced and propagated in a right way as it teaches respect to others.

    as what o’sensei said: “aikido is the function of universal harmony expressed through the human body.”

    There are a lot of things to learn in fact in Japan to learn how to control one’s self. For a woman, finishing school is learning how to cook, ikebana (flower arrangement) and chanoyu (tea ceremony), a requirement for marrying into a good classy family in Japan.

    I opted to do just the first two with the excuse that I cannot drink tea because of my religion. My mother-in-law had to be satisfied with that and consider my religion to be a kind of discipline, and reason why I had to show a different side of me. 😛

    Frankly, they have never seen me shout or lose my temper. Bad words are not permitted inside theirs and our homes. I had to have a trainer to learn all the polite words in Japanese and to act like the coy, cultured women you see in movies we call “chambara eiga” or “jidaigeki” films.

    I cannot keep that facade though when I’m in the company of Filipinos, especially when we investigate criminals police here catch for all crimes that Filipinos are capable of doing, and say, “It is for survival.”

    You bet, it is the understanding of universal harmony that people here have been able to develop that aesthetic sense to make even ugly things beautiful, appreciate and be grateful to a supernatural being for blessings received amidst the harshness of life.

    Yesterday, a Filipino friend and I were passing through a park when we saw a grapefruit tree bursting with fruits. Then, my friend said, “Sa Pilipinas iyan, naubos na ang bunga niyan!”

    Over here, nobody touches them. Those fruits in fact will be collected by staff of the city hall and distributed to the schools nearby. Ganoon dito kasi. Ibang-iba sa Pilipinas. This reminds me of the mango tree we have in our garden in the Philippines. Hindi pa hinog ang bunga, pinupukol na ng mga vandals!

    Norpil, were you kidding? My last name is Pongco. I don’t have a Chinese blood; but my mother’s side has some Spanish.
    Even if I have some Chinese blood, I won’t always brag about it like some bloggers do in this blog. I would prefer to talk about Filipinos and the Philippines. Despite all the problems we face, we must all be proud of being a Filipino even if we have long left the country. Unfortunately, that’s not the behavior and mentality of some.
