Delaying Arroyo’s downfall

As I’m writing this column, the Court of Appeals has issued a 60-day temporary restraining order on Malacañang’s suspension of Makati Mayor Jejomar Binay.

Binay and his supporters rejoiced over the CA’s decision.

While Malacañang is not rejoicing over the decision, our source said they are relieved. Rodolfo Ferraren, Makati officer-in-charge for two- and-a-half days, said, “Well and good.” He made himself look stupid when he said he will turn over the reins of the Makati government back to Binay. When did he ever take control of the Makati government?

On the surface, the TRO was a victory for the political opposition. But it actually did Gloria Arroyo a favor. It delayed her downfall.

Last Wednesday night, there were already reports that Malacañang was urging the CA to grant Binay’s petition, as they needed a face-saving excuse to extricate themselves from the mess they had created in Makati. They realized that they had bitten more than they could chew in the case of Binay.

They had wrongly estimated that Binay would quietly leave his post like Pasay City Mayor Peewee Trinidad. They didn’t expect that Binay’s defiance became a rallying point for the opposition to come together to push for Arroyo’s ouster.

Yesterday morning, a jittery AFP warned members of the Armed Forces against going to Makati. There were already reports of renewed linkups between an opposition group and rebel forces.

What happens now to the big rally planned for today starting at the Ninoy Aquino statue on Ayala Avenue at 1 p.m. and ending at Makati City Hall?

The latest word I got was, the protest action will proceed “all the way.”

No doubt, the TRO diffused the sense of urgency that the Makati standoff provided. That’s precisely what lawyer Lorna Kapunan tried to counter when she spoke in a meeting at St. Peter’s church last Wednesday.

Kapunan said the opposition has scored a number of victories in the Supreme Court: Proclamation 1017, EO 464, CPR (Calibrated Pre-emptive Response), and the latest, against PCGG’s claim of immunity from investigations. “But why is it that we don’t feel that we have won?” Kapunan asked.

She said the issue is not about Binay. It’s Gloria Arroyo’s naked abuse of power. It’s about “garapalan.”

The most defiant of the speakers was former UP president Dodong Nemenzo, who is accused of rebellion in connection with the attempted withdrawal of support by rebel soldiers last February.

Nemenzo said he has decided not to get a lawyer to defend him nor is he going to post bail. He said he will not allow himself to be subjected to the so-called rule of law under an illegal administration. “I have nothing but contempt for this government,” he said.

Nemenzo said Arroyo is trying to destroy all opposition. She started with leaders of militant organizations, then the journalists and now the political opposition.

Nemenzo, who was imprisoned during martial law, said he is not afraid to go to jail again. “Let us show her that we are not afraid of her.”

Responding to Nemenzo’s challenge, lawyer Argee Guevarra, who was also charged with inciting to sedition for his participation in last February’s rally, said they are going to file a petition for inclusion in the rebellion case of Nemenzo.

A surprise presence in the meeting was activist Linda Montayre, wanted by authorities for inciting to sedition and other cases filed against her. She has just come out with a book, “A Nation Unborn.”

In her book, Montayre said, “There was a time I thought that transformation could be brought about through a peaceful political process. But the past years under Gloria Arroyo have shown that she is more repressive and more heartless than any national leader we have known.”

Montayre also said, “The resentment and hatred of the poor against the rich and elite of our society is like a dam about to break. It is only waiting for a trigger point. When that time comes, it can no longer be contained by the elite. ”

    Gosh, itong taong it talaga namang nawalan na ng hiya. She has not an iota of shame in her body. Imagine, even priests tell her “When you speak to God, that’s called prayer but when God answers you back, it’s called schizophrenia.”

    Gloria has an incredibly depraved character, someone who will not balk at committing blasphemy (even grandstanding to the Pope), push truth to the limit and all for the sake of holding on to power. What a phenomenon – for someone so tiny yet so gargantuanesque in doing evil. Quite extraordinary!

    In due time, illegitimate Gloria’s downfall it will soon come, just a matter of time. While Mayor Binay in Makati City Hall surrounded by his loyal supporters, Bogus Gloria is in a self-made prison in Malacanang biting her nails, dying of nervousness, and plotting her next move to beat Mayor Binay. Probably her blood pressure has shot up, and her abnormal pulse is beating like a person’s neck about to be strung on the gallows. Inevitably, justice will prevail and scavenger fake Gloria will be fed to the sharks.

    The 60 days TRO is not about the suspension of Mayor Binay, but more or less it was CA payoff-favor to bogus Gloria in order to save the posterior of bogus Gloria of being kicked out of the People’s House. As bad as the stink of Pasig River, Bogus Gloria still able to smell that thing didn’t go to well at Makati City Hall, has gone wrong unexpectedly. And fake Gloria’s confidence level has gone sour. But, ain’t over yet, halt the celebration ’till bogus Gloria is behind bars.

    People’s has waited all these years, what is 60 days more? It will be here, and soon bogus Gloria will answer to the people for all her crimes against the Pilipino nation.

    Hold the celebration, keep the charcoal hot for the lechons, and keep the San Miguel cold on ice! Folks be patient!

    With CA 60 days TRO it only proven, bogus Gloria charged Mayor Binay with bogus and/or with fabricated lies and couldn’t be proven in court. If the law is on bogus Gloria’s side, and if it’s for the good of the Makati residences, bogus Gloria should’ve proceed in removing Mayor Binay out of the Makati City Hall. But, once again bogus Gloria as we know all along is nothing but a liar and a cheat among other things. Now what should happen to the ex-council Brilliantes if he provided lies against the Mayor, Vice Mayor and the 16 councils? Cut his tounge? Then remove bogus Gloria’s brain for listening to Brilliantes. Oooops, sorry folks, I missed spoke, bogus Gloria is lacking a necessary brain. She was forgotten when the power upstair was giving out brain.

    Things to keep in mind, bogus Gloria is always been a rich kid, a spoil brat, never have to work for a living. Everything was handed to her in a silver platter. She doesn’t know what it’s to sweat for honest days of work. All she got to show for are all has been stolen from others, and she’ll do anything to keep her lavish lifestyle at any cost, including ridding of Mayor Binay of Makati.     Maybe, what is happening now in Makati is the trigger point that Montayre is talking about. Prophetic words? I hope.
    I am not sure if Montayre was one of those members of the Evil Society that was instrumental in the grabbed of power from Erap and in the installlation of the Glue to the presidency. If ever she was, and never apologize to Erap, that will be fine with me if she can help undo what they have done. At least in what she’s doing now is showing some remorse, thus admitting that they committed a big mistake in deposing Erap and installing a corrupt regime. Other evil society members, they are all hypocrites and too proud to admit mistakes. They assumed that they are too perfect and only the poor, the smelly and the toothless are the only ones who are capable of doing wrong things. And when they feel and smell that the Glue’s downfall is inevitable they will be there and the first ones to grab credit.

For me, I’d strike while the iron is hot… Who knows what gloria’s mafia might be cooking up again while we’re here waiting to pounce on them. They seem to be always one step ahead of the opposition, so, I don’t see the point of giving them the gift of time. But, that’s just me…

    Mayor Binay, a hero and history in the making? I think so, if he can keep the flame burning and be the spark and rallying point of the people. Strike while the iron is hot.     All of a sudden, Malacanang is pushing for changes in the Constitution that would allow foreign ownership of mass media in the Philippines, supposedly to boost the standards of local newspapers and broadcast stations and bring them at par with global leaders. (Philippine Daily Inquirer, Oct. 13).

    Executive Secretary Eduardo Ermita was quoted as saying in an interview over radio station DZRH, “I am sure there will be foreigners who will be interested to have a large share or to have ownership of mass media in order to improve their management.”

    Stupid din ha? Over here, foreign media are not allowed to meddle in Japanese affairs. It is one reason why they cannot become members of the Nippon Press Club, which prohibits foreign media to write derogatory articles especially on the Imperial Family even when they think they can corroborate their articles.

Where’s the system of checks and balances? Gloria Arroyo is guilty for obstruction of justice, covering-up fraud and stonewalling by deliberately refusing her underlings to cooperate in senate inquiry of alleged anomalies committed under watch. WE, the people must resist Reina Gloria Encantada’s despotic abuses, if not tyranny will triumph. The limits of tyrants are determined by the courage and strength of those whom they oppress. Despotic Malacanang Palace backed track because of the determination and principled grounds of Makati city Mayor Jojo Binay. The fall of discredited and bankrupt Gloria Arroyo regime is imminent and only time can tell.

    Why Ermita’s Binay suspension order is void

    Executive Secretary Eduar-do Ermita’s preventive sus-pension order against Makati City Mayor Jejomar Binay, dated Oct. 16, 2006, is illegal and, therefore, void on its face.

    Why?

    First, under Section 63 (a1) of the Local Government Code of 1991 (Republic Act 7160), preventive suspension may be imposed “by the President,” not “by the Executive Secretary” and not “by the Office of the President.” The law is clear and specific. It confers the authority on the person of “the President.” In other words, the exercise of the authority requires the personal attention of “the President.” The Executive Secretary has no authority under the law to impose preventive suspension or issue the suspension order.

    Second, under the Adminis-trative Code of 1987 (Executive Order 292, Book III, Title III, Chapter 9, Section 27, sub-paragraph 2), the Executive Secretary has the duty to “IMPLEMENT presidential directives, orders and decisions.” The law does not authorize him to MAKE or ISSUE “presidential directives, orders and decisions.” He may PROMULGATE and IMPLEMENT, but he cannot MAKE them. May

    the President delegate such authority to the Executive Secretary? No. The Executive Secretary cannot substitute his personal discretion over the President’s. To do so would, in effect, make him an “acting President.” Under the Constitution, the Executive Secretary can never become an “acting President.”

    Third, the order was signed by General Ermita alone. While it is true the Executive Secretary is authorized by law to sign papers “by authority of the President,” it is equally true such authority is limited to IMPLEMENTING, not MAKING “presidential directives, orders and decisions.” In the case of Mayor Binay, the suspension order was MADE by the Executive Secretary, not by the President. The order does not merely IMPLEMENT. It is the suspension order itself. The order does not even mention any suspension order signed or issued by the President herself. Thus, it seems clear that the Executive Secretary is imposing, albeit without legal authority, the subject preventive suspension.

    Fourth, while it is true the Executive Secretary is authorized by the Administrative Code to “decide, for and in behalf of the President, matters not requiring personal presidential attention,” it is equally true the matter of placing a duly elected Metro Manila city mayor plainly requires “personal presidential attention.” Moreso where the controversy involves the possible political destabilization of the country’s premiere financial hub.

    Fifth, the Executive Secretary’s order admits Mayor Binay had duly requested a “bill of particulars.” The law provides that – BEFORE responding to the complaint – a party may ask for a definite statement or for a bill of particulars of any matter which is not averred with sufficient definitiveness or particularity to enable him to properly prepare his answer (Rule 12, Section 1, Rules of Court, which applies by parity of reasoning with respect to similar factual situations in administrative or criminal cases). The Executive Secretary completely disregarded the request for a bill of particulars without stating nor claiming there was no need for it. Therefore, there is an implied admission there is valid ground for a bill of particulars. Consequently, Mayor Binay could not possibly “properly prepare his answer or responsive pleading.” It would follow that without being given the opportunity to properly prepare his answer, it was UNFAIR for the Executive Secretary to have concluded the issues have been joined. Under the law, preventive suspension may be imposed only AFTER issues have been joined. In Mayor Binay’s case, there appears no proper joining of issues. Therefore, his constitutional right to due process of law was violated when he was placed under preventive suspension.

    Sixth, the Executive Secretary’s ruling to the effect that “the evidence of guilt is strong” is in the nature of a quasi-judicial conclusion. Reason dictates it must state clearly and distinctly the facts and the reasons on which it is based. Instead, the order lamely argues “the documents submitted as annexes to the complaint present strong evidence of guilt that some of the employees may be ‘ghost employees’ from their respective offices, collecting salaries from the city government to the prejudice of the latter.” This is an absurd case of a conclusion being supported by exactly the same conclusion. What is the nature of the documents referred to as strong evidence? The order does not say. Which particular annex is referred to as strong evidence? The order does not say. Why are such annexes considered strong evidence of guilt? The order does not say. Who are the particular ghost employees? The order does not say. How many ghost employees are there? The order does not say. The order seems to expect the reader to accept the conclusion of the Executive Secretary as self-evident truth. Is that fair or legal? No. The law abhors unreasonability. An administrative conclusion which does not state its factual and legal bases is necessarily presumed to be baseless in fact and in law. That conclusion is, therefore, unreasonable.

    Is General Ermita trying on Mrs. Gloria Arroyo’s presidential shoes for size? So it seems. But he must remember, those shoes were stolen – not just once before, but twice. And the rightful claimant may reclaim it sooner than later.

    What’s odd is that the face is snow white or geisha white but the neck is tan. Very odd make up. Talagang APOG ang labas!

    With all due respect, I don’t agree with Ms Ellen and others. Please don’t get me wrong, I do understand many of you and your arguments. And have great respect of what you believe are just.

    To my point of view, I’ve different attitude about dealing with those in the opposite side of the spectrum. e.g. Jun, anthony and others. I’d rather confront them head on than ignoring them hoping it’ll go away. Perhaps they will, but I think I’ll be losing out of not getting my messages to them, as the different views than theirs. Certainly, I can’t convince anyone that believe the same think that I do, just repeating the same rhetorical that you already knew. We become so predictable, and you can almost anticipate what on one side will say as being agreeable to each other. So, there is no challenge on the argument when all are in the same page, specially in the political arena? Surely, no checks and balances. I think, instead of ignoring others on the opposite side, you should controvert them in substance what you believe are on the side of justice, law, truth or whatever that happen to be. To ignore them (opposite side)is not in my opinion is commendable. I’d rather grilled the opposite side with facts, and at the same undestand their weaknesses, so I can deal with it in a manner appropriately.

    To make my point, no one can convince me that Gloria Arroyo is illegitimate, bogus, fake, liar, cheat, thief, corrupt and among others things, like incompetent, or bansot if you will. I already know all that, but the challenge is to convince, hopefully the opposition of your message,like Jun. Jun might not listen to you but he got something to think about, beside Gloria the boring Gloria’s promises she will bring to Jun.

    I read lots of your comments, and practically they all the same, including mine. That’s why I enjoy seeing Jun peeking in this blog. Jun is quite a dispute in itself. I don’t think he’s listening to reason, yet keep coming back for more. Talking about Pilipino being resilience, Jun would be a good example.

    You can’t convince people like this Jun that may even be the Bansot herself or one of her children to reform especially when they believe that they are right and infallible like the Pope, and worse when they have made cheating, lying, etc. their habit.

    I won’t waste time with people who are hopelessly obstinate, dishonest, etc. It’s a waste of time arguing in fact with such people. In the Bible, in fact, we are told to dust our feet on them.

    I commend you Toney for the effort but, as we’ve noticed in the past and in several other blogs, these brigaders as Yuko calls them, are actually “monkey wrenches from Malacañang’s enormous tool chest” whose only purpose is to take the discussion off its present direction especially when several alternative courses of action are being forwarded by bloggers and when some semblance of agreement seems to have been achieved and the action plan is just about made, these agents-provocateurs throw you off by taking the discussion elsewhere.

    Notice how this Jun conveniently injects into his arguments non-related issues like Cayetano’s German bank exposè, for example, then when nobody takes him up on it, switches to personal issues like, Maka-Erap kayo, or as in that above, mangarap kayo, etc. I still sometimes fall into that trap though.

    We’ve even gone as far as tracking their IP addresses, for example, in PCIJ’s blog and the moment they were exposed, they were back to where they really belong – Sassy’s and Austero’s – and we never saw them again! The same thing in Capt. Faeldon’s Pilipino.org blog, although later, the comments were screened and most monkey-wrench posts were edited out. When that happens, the only alternative left for them is to bomb the blog. Look, even PCIJ’s blog has been defaced and the only way you can conveniently navigate through it is by avoiding using Internet Explorer. The brigaders here are however more prepared as they leave no clues behind, they’re probably using public computers or use prepaid accounts.

    No, I’m not telling you to stop taking them head-on, in fact, it’s good to know there’s one untiring soul who takes up the cudgels for the others. It’s even entertaining sometimes. If you think you should listen to their “reason”, if any, please do not hesitate.

    Anyways, let’s keep blogging and before I ruin the emotions and myself be a monkey wrench by, as the thread fittingly says, “Delaying Arroyo’s Downfall”, let’s give them a fight they never dreamed they’d see.

  77. Dialogue is powerful tool to have. Indeed it is, but not when you are talking to someone with a mind like the Bansot and her Internet Brigade, especially those who make it a living.

    You bet that you and I do not have to fall hook, line and sinker to what Ellen and the rest of the bloggers here say about the pathetic state of the Philippine nation today. Otherwise, why would Filipino professionals opt for instance to do menial jobs overseas where they can even be subjected to all kinds of discriminations?

    You and I in fact have known and outgrown the graft and corruption that exist in the Philippines, a reason in fact why a lot many of us have left the country in the first place. In my case, though, it is more because of family decision than a personal choice.

    Dialogue is applicable only when the other party is willing to listen, not when it is a one-sided affair by one who is deliberately being rude and insulting. It is in fact useless to argue with them. Worse is when they resort to metamorphosing into various personalities with the intent to deceive that they are many. That for me is sick!

    You definitely cannot argue with someone who is sick in the head as a matter of fact! Baka mahawa ka pa. 😛 It is a useless endeavour!

    However, reading between the lines, you know that this is the same person who has been pledging undying allegiance to the Bansot he considers blameless for all the pathetic state the nation is in presently.

    I, for one, cannot have the time to argue with this guy who tries his worse to make one look stupid and unlearned as if he alone has had the best of education that money can afford to provide, in which case I’d rather say goodbye and go to a higher level of argument than end up wallowing in stagnancy and ignorance.

    One thing I do, though, is I don’t argue on matters I am not familiar with. It is for this reason that I can sound strong, powerful and obstinate!
