Esperon’s promotion disregards process: Biazon

Statement of Senator Rodolfo G Biazon, chair of the Senate Committee on national defense and security, on the promotion of AFP Chief Hermogenes Esperon without going through the process of confirmation by the Commission on Appointments.

Biazon cited that in the case of General Lisandro Abadia who had been selected by former President Aquino for appointment to the position of AFP COS, General Abadia within a period of five years –from 1986 – 1991 had to be confirmed by the Commission on Appointments in his promotions in each and every step of the way – from Colonel to Brigadier General last February 1, 1989; from Brigadier General to Major General last February 20, 1991; from Major General to Lt General last June 5, 1991 and from Lt General to General also last June 5 1991. Although his confirmation from Lt. General to General was on the same date, still General Abadia had to be confirmed as Lt General.

Former President Corazon Aquino invoking her prerogative as Commander in Chief in the appointment of General Abadia to the position of AFP Chief of Staff, and the series of promotions that took General Abadia to the four-star rank WAS IN ACCORDANCE WITH THE CONSTITUTIONAL PROVISION OF HAVING THE COMMISSION ON APPOINTMENTS CONFIRM THE PROMOTIONS IN THE AFP.

General Abadia was promoted from the rank of Colonel to the rank of 4 star General by going through the confirmation process of the Commission on Appointments. He was advanced in rank and position according to the Constitution on the basis of his merit and performance and there was no issue against General Abadia except by senior officers who were by-passed by his promotion.

The case of General Esperon is a different matter. There is still this pending resolution in the investigation of the Garci Tapes for his alleged participation in the conduct of election fraud last May 2004. This has to be resolved.

General Esperon still has to be confirmed to Lt General and his appointment to the rank of 4 star General is a disregard by the President of the confirmation process as provided for in the Constitution.

One thing that could have helped in clearing this issue would be the submission of the Mayuga Report. The Mayuga Report needs to be examined by the Commission on Appointments for the confirmation process.

One strange public statement by Vice Admiral Mateo Mayuga when he headed the Mayuga Board issued after his submission of his report to the President was: “ It was not the intention of the Board to investigate culpability.”

This statement sounded strange and needs to be closely examined in this confirmation process otherwise this disregard of the confirmation process could lead to more instability in the
ranks of the AFP.

  1. One thing I have noticed in GMA’s administration is that they can do almost anything they like. Even if what they’re doing is wrong or illegal or unconstitutional, they just do them still the same. If proven wrong (EO464, PP1017), there’s no punishment anyway.

    In Gen. Esperon’s case, when proven that Biazon is correct, then what? What kind of punishment is there for people in the administration, and as Anna de Brux asked, who can punish them?

The question is, will we allow this administration to continue its unconstitutional practice? Constitutionality and due process has been thrown out the window. I would like to amend portions of the constitution myself. I would like to make impeachment easier and make accountability stronger. Let’s do away with immunity from suit. Abuse of power stems from this. Let’s do away with EOs. If the legislative is tasked with making laws, then let them. Let’s take this power away from the president. Power must at all times emmanate from the people. To give government too much power such as a parliamentary system leads to tyranny. This is why the administration is pushing the Cha-Cha, they will no longer need due process to get what they want without having to be made accountable to the people.

    Executive Secretary Eduardo Ermita, in defending Esperon’s promotion, stressed the jump in his ranking from a two-star general to a four-star officer, without the benefit of a CA confirmation on his third star, was not without precedent.

    He said former AFP chief Lisandro Abadia was also holding a major general when named military chief of staff during the Ramos administration.

    Ed Ermita is really pushing breach of good faith too far. As a former lietenant general, he is speaking pure unadulterated shit.

    When General Lisandro Boy Abadia was promoted to Chief of Staff, he had to be confirmed to the rank of Lt General beforehand. His promotion to 4 stars (rank of GENERAL) was incumbent on being confirmed lieutenant general first which carried 3 stars.

    Only afterwards could he be OFFICIALLY PROMOTED to 4 star rank.

    General Abadia didn’t go about wearing 4 stars until he had secured his 3-star rank. The rank of general (4 stars of which there’s ONLY ONE military officer holding that kind of rank in the Philippines) was held in abeyance.

    As General Biazon said, this is provided for in the Constitution and NO ONE BUT NO ONE in the Philippines could change that.

    Gloria Macapal(gal)-Arroyo didn’t have to promote Esperon to the rank of 4 stars until after he’s been confirmed as 3-star ranking officer. Esperon could remain chief of staff AFP as major general (2 stars) until his confirmation as lt general is made.

    Or, is this the case? Did Gloria promote Esperon to CSAFP with the caveat that he remains major general pending the CA processes?

    But that is still jumping the gun because CSAFP carries the 4-star rank automatically.

    Talagang bastusan na! Gloria is commander in chief of the BASTUSAN REPUBLIC!

    General Biazon during his leadership of the AFP (even for just 5 months) was responsbible for the drafting and the enforcement of the CODE OF ETHICS, AFP.

    Biazon was no desk general. He was a field general which this stupid Assperson (Esperon) will never be able to achieve. His last real field combat mission was when he was a major (and even then, he was showing off most of the time) and his stints in field commands were only for show and to make sure that Gloria’s votes were padded.

    Most of the time, he was busy having dinners in big hotel restaurants.

    His real combat duty was to protect the person of Gloria Macapal-gal.

    My point is, when laws are being taken for granted or disrespected, ignored as in bastos the laws and the same is done by this commander in shit to the military, she sets a major precedent for turning that military, which is supposed to be the last bastion of defence of the country against the enemies of the state, into a banana military.

    When that happens, all hell will break loose!

    You will end up with a West African “republic” that boasts of a highly confused and indisciplined military.

    When the military component of the republic,the ultimate component that epitomizes discipline in a republic, becomes confused and indisciplined eg, not respecting the laws of the Constitution, it is the ordinary citizens of the republic who lose on several fronts.

  29. Anyway, it appears that Esperon got the CA nod today to officially become lieutenant general. Esperon hurdled the confirmation proceedings because Senator Biazon is no longer a member of the powerful Committee on Appointments.

    Just the same, Gloria has shown that she can violate the elementary laws on military promotions without batting an eyelash and the people (or their elected representatives) are cowed to submission.

  35. With Congress confirming Esperon’s rank to Lieutenant General Assperson, he immediately doubles his retirement pays and general benefits.

    I don’t know how much the law appropriates for the retirement of a 3-star rank but it will run in millions of pesos.

    Gloria doesn’t even have to take money out of her personal coffers containing the nakaw of her husband to reward Esperon financially for having helped pad her votes in 2004, all she has to do is make bastos of the military promotion laws of the country and taxpayers’ money will make Esperon a millionaire. (While the ordinary trooper wears holes and rags… and can barely make ends meet for his family.)

    And when Assperson (Esperon) attains full general rank equivalent to 4 stars (ONLY 1 in the Philippines), he will be all the more financially secure. Of course, this does not include the nakaws that he’s getting by padding the prices of defence equipment purchase!!!! With that in mind, Assperson (Esperon) who could be likened to the original “poor boy from Lubao” will end up being FILTHY, F*cking rich.

    And lest you forget guys, Filipino taxpayers are responsible for making Assperson’s (Esperon) wealthy beyong the imagination status absolutely possible!

  38. There really is nothing new with military officers becoming filthy rich beyond their wildest imagination when they were cadets (most of them came from modest-income families if not outrightly poor).

    Commodore Domingo Salipsip owned or still owns several mansions in Valle Verde.

    General Arnie Acedera (1st PAF commanding general to become AFP chief of staff) made a killing and owns several condominium units as well as a fleet of cars.

    Not to forget: General Lisandro Abadia, owns a golf course and has a mansion and a couple of other homes worth 10s of millions of pesos as well as being part owner of a restaurant in Cebu.

    His brother, LtGeneral Loven Abadia, former CG PAF owns a home abroad and many business concerns.

    Rear Admiral Pastor Ramos, is considered the richest member of the Armed Forces of the Philippines after he was put in charge of the engineering brigade by the National Pinatubo Commission (assigned there by Rene de Villa, erstwhile, chief of staff Armed Forces of the Philippines and DND Chief, who at the time was chair of the National Disaster Commission of the Philippines, handling billions of pesos and spending them without being audited.)

    LtGeneral Joey Calimlim, former PSG commander and J2 is equally one very financially rich man.

    Brig General Ramiscal who was J6 under Boy Abadia was in charge of RSBS owned Vetronix (soldiers’ mooney) that lost hundreds of millions in no time at all but BrigGeneral Ramiscal became filthy rich.

At one point, so awed he was by his instant millionaire’s luck (that went with the “ambassadorship” to Taipei) that he boasted to friends that he’s got plenty of check books, something that he never owned in his entire life until Gloria appointed him to the post in Taipei!

  53. I believe I know the military history of the Philippines and of the AFP even if only modestly.

    Unless I’m mistaken, this is the first time in AFP military history, that the pelting with a rotten egg of the top AFP leadership happened.

    This incident speaks volumes. The man is not respected, his suitability for his military office is doubted, his authority greatly diminished and his courage to stand up to the real enemies of the republic is seriously therefore to be questioned!

    I can’t imagine how this fake general rank officer in the service of a bogus president, can assemble the troops at clarion call against the enemies of the state begins.

No question ask, just that Assperon is qualified for the highest post. How about the person’s credibility and integrity as a person?     I read the Ilocano Times to brush up my Ilocano which I learned only by ear from my mother and grandmother. Never got proficient in it because I have nobody to talk to for the past 40 years except when I visit my mother in the USA and/or her relatives in the Ilocos during rare visits to the Philippines when I do my genealogy or attend conferences, etc. in connection with the advocacies for Filipinos I am in these past 20 years or so.

    So, what’s the problem, dear, with having lived overseas longer than staying in the Philippines made rotten by these crooks who run the country literally like hell? You bet, Anna, age is not a question here. The question is the bogus president, who is my contemporary, and her bastos reign!

    So what’s wrong with getting old? Age is not the problem. It is how one makes use of the time given him/her by God above here on earth Why should I be ashamed of my age especially with all the available remedy now to remove the wrinkles!!! Lucky me, though, I have no crow’s feet yet around my eyes. Thanks to health food and a fairly good and contented life!     I expect to live more than a hundred even just to make sure that the Philippine properties in Japan cannot be sold and the money squandered or stashed in some private bank in Germany, etc. Life span here is 87 for women and the age is getting higher.

    Will probably have a face lift when I’m 85, and try to look half that age! I don’t stay long under the sun because it is bad for the skin.

So, my suggestion, as to the subjects private lives that do not impinge on their public duties, we’ll leave them private. There are a lot of issues to talk about, but touching on privates lives that has nothing to do about with anyone’s performance of their public duties is I believe crossing the limit and would be in violation of privacy, even if you know first hand of the facts.

    Your closing remark reminded me of a story that involved a former PNP chief (not Lacson, heheh! more to do with PMA Class of 66 but definitely not Gen Sarmiento who is of Class 66 and former PNP Chief)…Anyway, here’s the story…

    PNP Chief (let’s call him Kolokoy) had done something naughty during his stint. He put his loveydovey in one of the homes in Crame or thereabouts. His family of course, lived in the same compound. Every day, before going home, he would drop in on loveydovey to relax there; unholsters his gun, takes off his shoes and all other bits of clothing, well, I suppose to be able to relax really well. Then, at 7 PM sharp, he dresses up and returns to his quarters to join his family.

    One day, feeling ill, he went hole to his quareters directly and fell asleep soundly. The clock struck 7 – Kolokoy woke up in panic and got out of bed, started dressing up, put his gun where he usually put it, put on his shoes and started for the door. His wife stared at him and said, “But where do you think you’re going?”

    Kolokoy said, “Home sweetheart! It’s 7 already and am late!”

    Anna, you mentioned a certain Admiral Sibayan. Was this guy already a Phil. Naval Officer in the 70s? If I’m not mistaken, he used to be the school commandant at La Salle in the early 70s.

    I mentioned age Anna ’cause someone said she’s no longer a Pinoy since 20 years old. If she’s now in her 60s, she must be away from the Philippines for over 40 years now.     China has been staging a series of progressively larger initial public offerings for its Big Four banks, and the attendant investor frenzy, some would say madness, is escalating in lockstep, conjuring images of the gold rush spawned by the Internet boom.
     

    Hong Kong bank branches have resembled movie theatres on opening night, with lineups queuing out the door as hopeful investors jockey to buy shares. Such is the unabashed confidence in the prospects for these banks that one woman reportedly plowed three times her annual salary into Bank of China’s $11.2-billion offering in June. China Merchants Bank, a smaller player, was so overwhelmed by the response to its $2.4-billion IPO this month that retail orders were oversubscribed by nearly 270 times.
     

    Analysts are predicting this demand will reach even greater heights on Oct. 27, when Industrial & Commercial Bank of China launches what is expected to be a $19-billion IPO of its shares, beating the previous record set by Japan’s NTT DoCoMo Inc. in 1998.

     
     
    Zhiwu Chen, a professor of finance at the Yale School of Management, has seen the challenges of Chinese privatizations up close as an independent director of a handful of firms there.     npongco, last time I heard there will be an inquest before Quebec Human Rights Commission regarding that issues. Until the scheduled inquest starts, all parties refrain from any press release or talking publicly in order not to undermine the integrity of the inquest and also not to jeopardize their respective case.

    The Teddy Reodica Coroner’s Inquest resumes Sept. 12 (the Filipino Descendant Teenage boy shot to death by undercover drug officer), but most testemonies now are from officers of the emergency people and special investigation units and witnesses whose testemonies will affect mostly as an “aid to legislation” which is one the main purposes of the inquest of the coroner’s inquest to find out what went wrong. The Provincial Ombudsman may take over the investigation after depending on the coroner’s report. The Reodica family Civil case which was filed before the statute of limitation expires (two years) for $5.4 millions will be either heard after or settled out of court. Our Police Services Board just settle another similar case for $3.8 million when an officer shot to death a South Asian (Indian) descendant car napping suspect. Although the officer was judged justified, the force used was unreasonable. In Reodica Case, it’s more of the Cop’s attitude at the issue here. but we will have to wait for the Coroner’s, beacause his is the final say.

    I have some feelings that one of the recommendations the Coroner’s will submit will be to equip all Officers with Stun Gun (laser guns), which the police services in most cities are already doing. Our uniform officers already equiped with stun guns. Leave the use of lethal force to the ETF and only when life in in imminent danger.

    So Vic, can you honestly say that the killing of Filipino youth in Toronto by a white cop was committed partly or mainly due to racism? The case has taken so long that it has not even reached the first base.

    Speaking of armed security men, I think it’s high time for Canadian government to arm their border guards. Imagine, Canadian immigration border guards are unarmed. Compare it to the US guards who are equipped with the latest. I know the Canadian goveernment is now planning to arm the guards but it would take some years to be implemented. In the meantime, these poor border guards are at risk daily.

    Believe it or not, the only people authorized to carry guns for lawful purposes are the police officers and the armored carrier guards. All others are illegals. Our soldiers can’t even carry their weapons out of training or not on duty. Even our cops can’t carry theirs off duty. But drug groupies and bike gangs are having a shootout night and day.
    Regarding the Reodica case, the officer is already ruled justified by the special investigation unit (SIU). He can not be subjected to criminal prosecution anymore, but can be subjected to internal discipline. The issue that is being brought in the inquest is the ‘attitude’ of the cop. More of his “bad temper” or macho attitude. The subject officer is a Status Indian himself, meaning a native, and he was accused of and got away of beating a “white suspect” in another case. In another word he is unfit to be a police officer in the first place. I hope pretty soon our custom officers, our immigrations and our court officers will also be trained and armed.

    As to the implementation of the arming of the border guards and security personnel, it could be hasten if we have a majority government. Our prior governments have different priorities. The current government, which party I belong has been open about our plans to improve our security, borders and our military capability to enable us to respond to more peacekeeping roles and emergency responses, but the look of it, the Liberals are getting smart of trying to elect a Leader of Harvard Professor Ignatieff who is more of a conservative leaning than a liberal. We did beat them by playing the game and now they are returning the favour. hayyy politics…
