The noose is tightening

Gloria Arroyo must be feeling the noose tightening around her neck.

It showed in the statement her spokesman issued last Saturday threatening Rep. Alan Peter Cayetano “full retribution” if he did not retract his exposé that some “immediate members” of her family maintain a bank account in Hypo- und Vereinsbank in Munich.

Bunye demanded a public apology from Cayetano to which the young congressman from Taguig-Pateros replied: “You should be the one to apologize to the Filipino public for cheating, lying, and stealing.”

Cayetano said the information he has about the German account is in a document inside the boxes that they were supposed to open if the impeachment complaint against Arroyo pushes through. Arroyo’s allies in the Lower House, however, are determined not to have those boxes opened.

But Arroyo is nervous because she knows the documents Cayetano and the opposition have, came from international investigating agencies, which are thorough and uncompromising in their work. As Cayetano said, “this is not a wild goose chase because one, there is an account number and two, this is going around among official circles. This is going around not only locally but internationally.”

Arroyo knows this because some members of an anti-corruption agency of another country met with local officials. If she thought the case would just end like that of former justice secretary Hernani Perez, she has former Agriculture Jocelyn “Joc-joc” Bolante miserable in a Chicago jail to remind her that things could work against her this time.

Early in 2001 Swiss banking authorities informed the Philippines of a suspicious $2 million deposit to Coutts bank in the account of Perez’ wife and brother in-law Ramon Arceo. The money was later traced as having come from businessmen Mark Jimenez and was believed to be part of the alleged payoff of the Argentinean power firm IMPSA in exchange for a government guarantee for its foreign loan.

Despite the Swiss banking authorities’ report and charges filed by anti-graft crusader Frank Chavez before the Ombudsman, Perez was never prosecuted.

In Bolante’s case, however, the US government’s anti-corruption drive snared him. Wanted by the Philippine Senate in connection with the alleged diversion of P728 million fertilizer fund for the 2004 election campaign of Arroyo, Bolante was arrested last month upon arriving in Los Angeles after his business and tourist visa was cancelled.

Bolante is now under detention while his request for asylum is being processed.

The discovery of the German account should tell Arroyo and her family that there is no safe place for kleptocrats, the term used by her friend George Bush.

Two weeks ago, Bush launched his “National Strategy To Internationalize Efforts Against Kleptocracy.”
The White House statement on Bush’ anti-corruption crusade said it was built on his commitment with the G-8 leaders at their recent summit in St. Petersburg.

“At the G-8 summit, President Bush committed to promote legal frameworks and a global financial system that will reduce the opportunities for kleptocracies to develop and to deny safe haven to corrupt officials, those who corrupt them, and the proceeds of corrupt activity,” the White House statement said.

The Group of Eight (G8) consists of Canada, France, Germany, Italy,Japan, Russia, United Kingdom, and the United Sates. These countries represent about 65 percent of the world economy.

The White House statement also said national strategy against kleptocracy will utilize US-established links with international bodies and connections like UN Convention Against Corruption; OECD Anti-Bribery Convention and the OECD Working Group on Bribery; Financial Action Task Force (FATF); Council of Europe Group of States Against Corruption (GRECO); OAS Mechanism for Implementing the Inter-American Convention Against Corruption; Asia Pacific Economic Cooperation Forum’s Anti-corruption and Transparency (ACT) Initiative, and Broader Middle East and North Africa (BMENA) “Governance for Development in Arab States” (GfD) Initiative.

Germany is a member of the Council of Europe. A German company, Fraport, would have a lot to say about high level corruption in the Philippines.

Bunye threatened: “The President and the First Family will not take this vicious attack sitting down.”

    If I were Rep. Cayetano, I would say “I’m sorry. I fell sorry not for the Arroyo family, but for the people. However, I need to know the truth; hence, investigation must be conducted to determine if indeed there’s illegal wealth deposited in German bank.”

Let the Pidals sue Cayetano, who should then demand that the case be heard in a neutral court or a court with a judge who is not an appointment, friend or chicken judge like the one that is trying the Dambuhala’s case against Banayo for there must be a law in the Philippines in Japan and other more progressive countries where the defendant may be able to file petition for change of venues, judges, etc. especially when there is the same case of paid judges, etc. as in the Philippines.

    I suggest passing of the hat for Cayetano to fight this case in lieu of an impeachment.

    Kudos to this young Congressman, who is living up to the name of his father, and the Cayetanos before him.

Its focus naturally is the Philippines and its organizers see PAMUSA as providential (hulog ng langit).

    Since Filipinos don’t seem able to solve their problems on their own God, truly loves the Philippines that in his mysterious ways has devised the “No Safe Haven” policy for the whole world to help our country solve its most debilitating problem: government corruption. The U.S. and other G8 nations, namely: Canada, Germany, France, Italy, Japan, Russia, and the U.K. as well as over 100 other countries have adopted “No Safe Haven” pursuant to the U.N. Convention Against Corruption (UNCAC) to deny entry for corrupt officials (past and present), those who corrupt them whether in public or private sector, and their illicitly-acquired assets.

    Former DA Usec Jocelyn Bolante became the first Filipino recorded to be collared (in police parlance) under “No Safe Haven” when he arrived in LA on July 7, 2006. The reason: he’s ipso facto a corrupt official. Evidently, Bolante had a valid U.S. visa when he departed Seoul; otherwise, he wouldn’t be allowed to board the plane to LA. Since the U.S. Dept. of Homeland Security receives advance passengers manifest of all those bound for the U.S., Bolante’s visa conceivably was cancelled by the U.S. Embassy in Manila while he’s in flight.

    He could’ve returned though on the same plane he came in which is the procedure when a person is denied entry. Instead, Bolante opted for detention as illegal alien and applied for asylum according to reports the U.S. immigration wouldn’t deny or confirm. The ground is fear for his life if he answered a Senate subpoena on his role in the PhP728-million fertilizer scam. That’s jumping from frying pan to the fire because he’d be subject to U.S. laws like Imelda Marcos who was charged under the Racketeering Influenced and Corrupt Organization Act (RICO).

    After Bolante’s story came out, rumors went around the “No Safe Haven” could’ve been a reason Mrs. Arroyo skipped Italy after all she’s in Rome already as well as France, Germany and Russia in her last European trip. A visit to Russia would’ve had great political mileage. Russia could supply RP with oil to balance our country’s dependence on Middle East sources and as quid pro quo Russia could be a big RP export market.

    That in a nutshell explains a serious problem Mrs. Arroyo and all those supporting her have caused our nation. The solution obviously is for Mrs. Arroyo to step aside since RP recovery under her is now an impossible dream. Any economist knows at least two conditions sine qua non for our nation’s recovery to take off, to wit: (1) Confidence of the people and business community in the national leadership; and (2) Net inflow of foreign investment which again depends on the international community’s confidence.

    It doesn’t take a rocket scientist to know Mrs. Arroyo couldn’t elicit confidence from the international community when she might not even be allowed to enter the G8 nations which is the biggest single source of foreign investment. Sad to say, no matter how Mrs. Arroyo’s drumbeaters spin it, local and foreign investors’ confidence in her has been leaking like gas in a tank nearing empty.

    PAMUSA’s organizers know most of you aren’t just for the ride but to faithfully serve our country which is an honor to be proud of. In that case, please ask yourselves: What has Mrs. Arroyo done for the nation to deserve further support for her dubious presidency? Could she prevent her impeachment every year by bribing congressmen who are no doubt concerned now with “No Safe Haven”? All of us know Mrs. Arroyo can step down sooner if she so decides rather than later which would exacerbate our nation’s problems unless some sense is hammered into her that resignation like Nixon’s is a good and honorable option. Otherwise, she would bring her family and allies including all of you down to the hole worse than the Marcoses and their corrupt supporters fell into. They didn’t have “No Safe Haven” then.

    How many of you can say there aren’t people awaiting when you’re out of power to execute affidavits even if perjured about your involvement in some corrupt practices and ask PAMUSA to submit them to the U.S. Department of State to deny you entry to G8 nations? Worse, if you have investments in any G8 nation you can kiss them goodbye and if it’s in the U.S. you can’t prove to have been legally acquired you’re bound to face prosecution.

    The point is this: PAMUSA’s long-term goals are focused on reducing corruption in the Philippines to a manageable level. We all know corruption is rampant in the States, but it’s manageable so that anyone caught definitely goes to jail. Recent examples include California Rep. Randy “Duke” Cunningham now serving 8 years in jail convicted for colluding with contractors by inserting added appropriations in defense contracts during congressional bilateral conference, TV personality Martha Stewart for lying to the grand jury about inside stock trading, and the biggest fish of all former Enron CEO Ken Lay who cheated 80-year jail term with a massive heart attack before he could be sentenced.

    You’d agree that for PAMUSA to create an impact to reverberate throughout our country for years to come we must start with Mrs. Arroyo, which is probably the best she can do for our country to hang a “Sword of Damocles” over every bureaucrat’s head from a customs or BIR examiner up to the highest official. Afterwards it’d be as though “Big Brother” would be looking over every government employee’s shoulders reminding graft and corruption doesn’t pay. Those of you whether there’s something to hide or not could do the country a great favor if you collectively could ask Mrs. Arroyo to consider the worsening situation you’re all in now. PAMUSA isn’t out for blood. Forgiveness is part of the Filipino DNA.

    Although many Filipinos here have reached the end of their patience Mrs. Arroyo can improve the lives of their relatives and friends left in the homeland. Their agony becomes more painful living a good life in America and seeing kinfolk suffering daily.

    You should see the reaction to the OFWs’ plight during the war in Lebanon. They were cursing Mrs. Arroyo and every member of her adminsitration how our country has been bankrupted that it has lost the semblance of a nation when disaster struck its people. Hence, if we see your efforts to end this nightmare constitutionally, peacefully and reasonably not necessarily like the Hyatt 10 with 15-minute of fame, I assure you as PAMUSA’s president we’d give you a fair break. Out of court settlement is more acceptable in the United States than very long litigation that costs a big fortune. In the end you might keep part of what you have here.

    PAMUSA has a pending MOU with a high-profile American NGO famous for battling government corruption and other irregularities, which we’re enlisting to help us ferret out illicitly-acquired assets of corrupt officials and their partners in crime hidden in the U.S. pursuant to Bush’s Presidential Proclamation No. 7750 implementing UNCAC and other applicable U.S. laws such as the Freedom of Information Act, Racketeering Influenced and Corrupt Organization Act (RICO), and so on.

    The lawyers among you know nothing can be hidden in the U.S. that can’t be dug up. Be aware that corruption doesn’t need to be proved in court under “No Safe Haven” since the rule of evidence res ipsa loquitor suffices to deny entry or search for ill-gotten wealth. Also note the policy is retroactive to corruption committed in the past whether in the public or private sector, which means ill-gotten wealth from Marcos to Arroyo is fair target. Since there’s government prescribed attorney’s fee for asset-recovery PAMUSA and the counsel involved would share the fees so the movement would’ve sufficient resources to fight corruption for years to come. Don’t contribute the hard way, do it willingly now.

    This also means a customs or BIR examiner who stashed ill-gotten wealth and retired in the U.S. would have had sleepless nights since hearing the enforcement of “No Safe Haven” more so Mr. and Mrs. Mike Arroyo and close associates such as Bernardino Abes, Donald Dee, etc. who are already in PAMUSA’s hit list

  6. Indeed, this is unlike Victor Corpuz’ allegation way back in 2001 regarding Lacson’s supposedly bank accounts. I don’t think that Rep. Cayetano, as a brilliant and principled lawyer and public servant, is only out to engage in a witch hunt against the Arrovo errrr… Arroyo family. He must have been able to secure certain documents linking the said bank account to the First family.

    It’s sad that the impeachment complaint was not given due course by Arroyo’s allies in Congress for obvious reasons.

    Our meeting mainly to talk about the political killings in the Philippines and the AI initiative to launch a worldwide campaign against it was pretty well attended by both Japanese and Filipino. We are actually sending pictures to Arkibo to publish in their website together with the AI declaration that has already been distributed and read in various meetings worldwide.

    Kaya iyong bagsak ni Pandak malapit na, at pihadong lagapak na mas malakas pa sa lagapak ni Macoy dahil sa totoo lang mas grabe ang ginagawa ng mga ungas na ito.

    Hopefully, next time they reorganize the Philippine government, puede ba sipain na iyong mga alikabok at agiw na mga kurakot noong pang hindi pa yata ako ipinapanganak ay siya nang namamayani diyan at nakaw dito, nakaw doon ang ginagawa hanggang ngayon tapos ang lakas ng loob na magsabing dati daw silang mayaman!     I admit I have no knowledge of Congressman Cayetano character of background, but many a principled and suppossedly ‘steadfast’ oppotisitions had been swayed by the Administration juiced up offer of “money or kahon”, could it be possible that the are (malacanang) already doing one for him? Just basing my obervation from the past experiences as we all have known and seen.

    A father’s mistake cannot be blamed on the son. Alan’s late father Senator Rene Cayetano was a good senator but the elder Cayetano didn’t come clean either. He was involved in some illegal stock trading using his office and influence. The case didn’t prosper until he died. But if the elder Cayetano is alive today and healthy, he would be among those fighting for GMA’s ouster.

    The young Alan is a brilliant and principled lawyer/politician. He is a Born Again Christian. He lives his life according to the words of God. That makes him different from the rest of the politicians.

  22. Sorry, Ellen, but I find judicial procedure as mouthed by the seemingly No. 1 crook in the Philippines today really ridiculous. I cannot understand why the court or anybody would even take the challenge of the Fat Guy for Cayetano to open an escrow when the suspect is not Cayetano but him and his family.

    Para bang sinabi ng isang kriminal sa pulis at imbestigador na kayo ang magpakulong, bakit ako ang huhulihin ninyo.

    Aba, e tarantado na nga! Hindi nga mahuhuli iyan kasi ang daming palusot! Hopefully, Cayetano will not budge but stand by his principles and guns, figuratively and literally speaking because we know how whistle blowers are getting killed now in the Philippines with this Fat Guy acting the siga-siga just because they have their fellow crooks manning the Philippine Justice Department, police and military in their hand, but Rep. Cayetano should not be undaunted, for as God has said, “Fear them not therefore: for there is nothing covered, that shall not be revealed; and hid, that shall not be known.” (Matt 10:26)….kahit na balita ko pati mga pulis nanginginig ang tumbong sa takot sa mga naghahari-hariang mga mandudurong ito!

    BTW, my Japanese friends helping Burmese fight the SLORC are wondering why Romulo has gone to Burma when the Philippines cannot claim exemplary with a lot many critics of the Pandak getting killed in broad daylight, and therefore, has no valid reason to be hobnobbing with the leaders of SLORC, unless he goes there to learn the ways and means of turning the Philippines into another Burma! 🙁

The soldiers must plan better and not allow spies to penetrate their groups. The church must step in. Uncle Sam must not interfere. All these are important factors to succeed in ousting this GMA. Not just talks. The time is no longer talking. The time is to ACT NOW !

I’m glad to note that Cory Aquino did not attend the functions where she would be forced to show civility to the Pandak and her minions once again labeling it for publicity’s sake as a reconciliation. It shows that Cory has more delikadeza and sense of propriety than the siblings of Ninoy, who could just leave Lupita for what she intends to gain for her chuchu to the Pandak just because they are kabalens.

    One thing sure is that Cory has some followers round the world and respect of a lot of people that the Pandak cannot have no matter how much she tries and only because of some publicity stunt that when taken will leave her with nothing!

    Talk of people getting wiser as they grow older if they are not afflicted with dementia or some mental illness like the one the Pandak suffers, which is some illusion of grandeur together with the ugly fat guy. Nakakasuka talaga ang mag-asawang iyan! 😡

    I read that “Sen. Tessie Aquino-Oreta wants to publicly say that she’s sorry to all those she may have offended with her impromptu damce during the Estrada impeachment.” It’s no wonder. I just found out that, together with her “twin”, John Osemena, and also Tito Sotto, they plan to run in 2007. Gosh, so much for sincerity; it’s apparently, another bastardized “I am sorry” stunt.

    I also saw a photo of PANDAK and Butz Aquino during one of the rites commemorating the death anniversary of Ninoy Aquino. No wonder President [Cory] Aquino didn’t show up. Who wants a photo-op with PANDAK? It will only destory one’s credibility. To those who don’t mind a photo-op with PANDAK, wala naman silang credibility to beign with.

    The basis of Malacañang’s libel threat against Congressman Cayetano according to news report was that the alleged dollar deposit in Germany was discussed by the congressman in a news interview. I am not sure if during the justice committee hearing and deliberation on the substance of the allegations in the articles of impeachment, the evidence of said dollar deposit contained in one of the boxes was already taken up. If it was, I am sure well minded and thinking Filipinos have already got the message loud and clear. From there, intelligent Filipinos could have formed their own opinion on the matter not favorable to the first family. The purpose of Congressman Cayetano’s derogatory revelation inside the committee hearing had already been served. Further media mileage would no longer be necessary. I don’t see any more point why it should be discussed outside the committee hearing where the good congressman knows fully well he is amply and constitutionally protected with immunity from suit.

    In our country, threat of libel suit is standard armour or defense of people in power when attacked by perceived enemies rightly or wrongly. Are they legally entitled to file it? Yes. But no amount of libel threat should deter crusading and well intentioned congressmen from doing their jobs of fiscalizing if the cleansing process already started by them must be pursued to its final conclusion. If this dollar deposit in Germany is well documented and the documents in Congressman Cayetano’s hands are authentic and genuine, then libel suit is a welcome challenge. It’s just a matter of change in venue and forum -from the congress to the court- where opening a can of worms would be much easier.

    MS06-042 Related Internet Explorer ‘Crash’ is Exploitable

    Overview:
    On August 8th Microsoft released MS06-042 which was a
    cumulative update for Internet Explorer. Over the course of a few days after the release of this patch various Internet Explorer users and businesses started to experience Internet Explorer crashing problems when viewing certain websites.

     

    Later on August 11th Microsoft created a knowledge base article which talked about problems with the MS06-042 patch and how Internet Explorer could crash when viewing some web pages that used compression. This Microsoft KB article referenced a patch, which could be requested through Microsoft Product Support Services, that would fix the “crashing” bug. There was further discussion about the extent of the crashes and widespread nature of the bug on places such as SANS and various patch and IT mailing lists. Because of the widespread discussions and number of people experiencing the Internet Explorer crash various security researchers, including eEye, decided to investigate as a lot of times crashes can be exploitable.
     

    We have since found that indeed the reason that people are experiencing Internet Explorer browser crashes is certain websites, that use HTTP 1.1 compression (as stated by Microsoft ), are causing a non-malicious buffer overflow to occur within Internet Explorer. After investigating and confirming that indeed this is an exploitable condition we are alerting people to the true severity of these “crashing” problems that people are experiencing, so that they can take the appropriate mitigation steps as need be.

     

    This information is already known in various research circles and also with exploit writers. So it is important that IT administrators understand the true threat of this problem that this is not simply a crashing bug as Microsoft has been incorrectly misrepresenting it but in fact that it is an exploitable security bug. Researchers and exploit developers know this, therefore it is extremely important that IT administrators are told what really is going on.

     

    Prevention:
    Windows 2000 IE6 SP1 Systems
     

    Patch: Microsoft created and released a non-public patch on August 11th. You can find out more about this patch here: http://support.microsoft.com/?kbid=923762.
     

    This patch can only currently be obtained through the Microsoft PSS process. However, Microsoft does plan to eventually release a public patch through Windows Update.

    Windows XP SP1 IE6 SP1 Systems

     

    Patch: The best way to protect your XP systems is to upgrade to Windows XP SP2 as it is protect against this vulnerability. Also support for XP SP1 ends in October and there are huge security benefits to XP SP2 so hopefully your already migrated to it. If you are not however and you are stuck on XP SP1 then you can use the Microsoft Knowledge base patch which was released on August 11th through the PSS process. http://support.microsoft.com/?kbid=923762

    Ellen,

    I happen to pass by the Gov’t Forum site (http://www.gov.ph/forum).. Durog na durog ang mga anti-MIDGET dun.. halos murahin at alipustain so I posted several replies to ‘at least share a piece of my mind’.. I was wondering why after several minutes na of postinf to several topics, walang lumalabas sa posts ko.. Only after I read a note somewhere in that site that the Forum Admin has to read and analyze the content of the post and the admin has the option of posting it or not.. It is based on the discretion of the admin.. Eh bakit kapag pang-iinsulto sa anti-MIDGET pino-post nya?… kaya pala napansin ko sa site na un na halos lahat sila gustong-gusto ginagawang panloloko ni MIDGET…

  59. Npongco is right, “Alan’s late father Senator Rene Cayetano was a good senator but the elder Cayetano didn’t come clean either.”

    I never was a fan of the late Cayetano because am not too sure that he was a good senator. For the record, he was one of those who took advantage of (or abused) his position to commit a highly suspicious act of “insider trading” in Dante Tan’s WB stock market/shares trading.

    Then when the going got tough, he left his “friend”, Dante Tan, holding the bag alone while he reaped millions of pesos in profit.

    Several people took advantage of Tan’s largesses but one who didn’t accept to “invest” in his bingo business or accept Best World “insider trading schemes”, no matter how hard Tan’s financial powers of persuasion was former Senator and Laguna governor, Joey Lina.

    Tan, by the way, bought small advertising space on a regular basis for his Bingo ads on the front page of the Philippine Star for a total contract of 5 million pesos sometime in 1999 at a time when Max Soliven was hitting him hard. The contract was signed in a restaurant in a flashy hotel in Makati.
