This is to clarify recent news reports and headlines pertaining to my PDAF Allocation and yesterday’s court apology.
It had been my campaign promise to waive my PDAF allocation and I remain committed to that. However, I was informed by my Senate staff that since I am entering in the middle of the Fiscal year of 2007, half of the P200M PDAF allocation per senator is already part of the budget and, therefore, cannot be waived anymore. Otherwise, if the said amount would not be programmed, it would be like giving GMA a P100M blank check. Hence, I decided to have my PDAF funds programmed to various public hospitals all over the country as well as for the construction of school buildings. This is not a crime!
However, what had been conveniently excluded in the reports is my letter to the Chairman of the Senate Finance Committee, Sen. Juan Ponce Enrile dated 28 Nov 2007, where I requested that my PDAF allocation for infrastructure projects be removed from next year’s budget which is exactly my campaign commitment.
As regards the court apology, it was very clear in the manifestation filed that the apology was addressed to Judge Oscar Pimentel and the Court since they were never the object of our protest to begin with. We remain firm in our conviction that what we have is a morally bankrupt administration that the Filipinos never deserved. Moreover, standing up against the most corrupt president in history is not something to be ashamed of and definitely not something to be sorry for.
Tuloy ang laban!
(Signed) Sen. Antonio F. Trillanes IV
Trillanes’ letter to Enrile:
Okay ngarud. Kontra Kurakutan, November 29th Movement! Ituloy ang laban!
I see, so that was the reason why he is not allowed to utilize his pork barrel… may nakalaan na pala… at gagamitin na naman ni GMA!
Wetness” Sergio Apostol, presidential legal adviser.
It just shows what they really are: liars.
Juggernaut, did you read Esperon’s statement? Click here. That the oakwood agreement is not binding? That it was not “deception” on their part to renege on the agreement?
What kind of officer is that!!!!?
Ellen,
Esperon’s statement is so disturbing…he is redefining the meaning of deception…the Magdalos should have put the agreement in writing with signature and with notarization…and what under duress he is talking about, I think the threat or intimidation was mutual.
Yang si Esperon dapa i-court martial for conduct unbecoming an officer and a gentleman. Sinungaling siya!
“dapat”
According to Gen. Lim’s testimony, there was no tension on the part of the officers in Oakwood. There was no intention to shoot and no shots fired. If anyone showed an intention, again, like in the Manila Penn incident, it was the government forces who showed such intents. Remember Gen. Teodosio saying, “We will use a maximum preponderance of firepower against you!” ?
Let Esperon define ” sinungaling” he might have a different meaning ..
Esperon is claiming that the agreement was subscribed to while under duress. Who was under duress? I cannot understand how a group of 300 junior officers and men can place an entire nation’s armed forces under duress.
Let Esperon define duress, then.
In deceiving the junior officers and the negotiators into an agreement that was never meant to be adhered to anyway, isn’t Esperon guilty of Conduct Unbecoming an Officer and a GENTLEMAN?
Article 133 of the Uniform Code of Military Justice (I don’t know if this is the same as our Articles of War) gives the following examples:
tuloy ang laban,,,, duwag ang sumuko.
mas duwag ang hindi lumalaban…
Kababain ni Asspweron…. Langsot ken naglastog pay… 🙂
Tuloy ag\ng laban!
Kababain ni Asspweron…. Langsot ken naglastog pay… 🙂
Tuloy ang laban!
Sorry for the extra post ma’am Ellen, napindot-happi ako.
esPWEron…..pisot!
Oakwood agreement is not binding -Asspweron
Ate Ellen on Esperon:
“That the oakwood agreement is not binding? That it was not “deception” on their part to renege on the agreement?
What kind of officer is that!!!!?”
Ate Ellen,
He is a big shame in the military!
Saludo ako kay Sen.Sonny.Mayroon siyang isang salita.
Tuloy and laban.
Many have declared that they are against this president; pero ayaw daw ng extra-constitutional means. They will only support peaceful means. No people power daw, dahil pagod na ang mga tao; and it is extra-constitutional.
We tried the ballot, pero nabili ang Comelec. As Sampot said, can we try something new?
Ngayon may cha-cha na naman to prolong her stay. Of course deny to death, just like that spiel about “I will not run because it will be divisive”. Erap says he will fight any move against cha-cha. The civil society wants nothing of it either.
Why don’t we turn the tables on her and do a cha-cha to shorten her stay? Consider the following amendment:
“Section 4 of Article VIII is amended by inserting the following as the second and third paragraphs:
The term of the President and Vice-President elected in 2004 shall terminate on June 30, 2008. Elections for President and Vice-President shall be held on the second Monday of May 2008. The term of the President and Vice President elected in 2008 shall be that stated in the first paragraph of this Section. All subsequent elections shall be held in accordance with the first paragraph herein.
Barangay elections in 2008 shall be held together with the Presidential and Vice-Presidential elections.”
Tagalog.
The above is a constitutional way to kick her out, which will be a direct act of the people. So hindi na kailangan ng mga for sale na legislators. Erap and the civil society can put their money where their mouths are, by working for this amendment.
Let us see who dances the cha-cha better – the people, or Gloria.
Tuloy ang Laban! O Tuloy ang laban? I trust that Senator Trillanes will continue to fight this GMA government. However, all along I thought he and his group do not recognize the jurisdiction of the court calling it a Kangaroo Court. They walked out and then now they apologized for what they did. I reserve my judgment as to why they have to apologize. May legal reason or implication siguro.
Why would Trillanes ask for it when he and Senator Lacson have given up their Pork Barrel? Among the senators, they’re the only two who refuse to avail of their Pork Barrel. Apostol’s mind is bad as his tongue. I hate listening to him. Recently on TV, he said “Ribilyon” instead of “Rebelyon”. Hayaan na natin itong Apostol ni Satanas…
Malacanang can’t even get their press releases right! Pathetic… Toting is out of his depth.
Isang malaking katanungan ngayon kung alam ng mainstream opposition particularly from Erap’s group that Trillanes and company would walk out from the court and stage that failed ouster move against GMA in Manila Pen. Supposed to be the opposition groups would gather and do it a day after, November 30. Bakit sinolo nina Trillanes? Gusto ba nilang solohin ang military junta at new government? Trillanes must realize that without Erap and Erap’s group which is composed mostly of poor masses, it is difficult to succeed.
Brownberry,
The Pen incident took place Nov. 29 while the opposition groups would gather on Nov. 30.
I guess that Nov. 29 was the only opportunity for Sen. Trillanes and Co. to walk out of the courtroom as it was the designated day for the hearing of the Magdalo case. They ‘seized’ the moments, ika nga.
Sen. Trillanes, Gen. Lim and Co. gustong solohin ang bagong gobyerno? I don’t buy it, wala nga silang weapons at ang guard nila ay naka-wig pa!
Besides, Gen. Lim is a soldier par excellence, ‘yan ba ang sasama sa military junta?!
Let’s hear from Ellen.
Brownberry,
Sorry. “Tuloy ang laban”. It’s not Ninoy’s fight pala.
Tuloy ang laban–Oh Lord God! How long do we have to wait? You are our only hope…Thank you.
Erap should be given a rest. He should be allowed to do his para sa mahirap projects but it would do this country a lot of good to keep him out of the ongoing political debates in the country. Raising the spectre of Erap will simply muddle issues.
Brownberry, you read the posted article. The information that you are supposed to be asking are there.
The MILF and the Arroyo governmetn are about to sign a peace agreement. Sigurado ba ang MILF na tutuparin ni Arroyo ang napagkasunduan after what they did to the Magdalo officers?
Delikado kausap itong si Arroyo. Walang isang salita. Manang-mana si Esperon.
Wala sa kanila ang palabra de honor.
Kung talagang tuloy ang laban, why don’t we shorten her term constitutionally? Read the proposed amendment above.
Yan at yan lang ang papipirmahan sa tao, so there is no danger of any tinkering to change from presidential to parliamentary.
ipaglaban_mo:
Isu ngarud kabsat, tuloy ang laban!
We just expressed our indignation over the human rights abuses, etc. versus the Dorobo in Tokyo, Nagoya and Kyoto. Wow, the biggest street demonstration we have had so far complete with back-ups from the Burmese and Japanese human rightists. See pictures at Anna’s blog and at the arkibo ng bayan site http://www.arkibongbayan.org
With the blunder committed by the people at Alcala in Espana, we apparently need to do these demonstratations and protests overseas to educate the ignoramuses. At least, over in Japan, we have already informed the people concerned and who can support our causes, and thank heavens, stop ODA to the Dorobo government.
Kaya sinong may sabing wala tayong magagawa? ‘Kinana ti awan nakim ken bain na nga dugong aso!
Most corrupt president si Gloria Dorobo? Yehey! Hahahahahaha!
atty36252, Excellent proposition if only it could work!
Gloria and her henchmen led by Esperon and Apostol would be on all fours to stop the proposition from gaining ground. Best is to haul Gloria, Esperon, Apostol, Puno and those who have blatantly subvert the rule of law into a bottomless crypt!
*****
Gloria and her henchmen led by Esperon and Apostol would be on all fours to stop the proposition from gaining ground. Best is to haul Gloria, Esperon, Apostol, Puno and those who have blatantly subvert the rule of law into a bottomless crypt!
************************
Ganyan din ang sabi noon kay Macoy. But the people guarded the ballot with their lives.
There are two rallying grounds now – Erap and cory (civil society). After Gloria is booted out, well, kanya kanya na, in campaigning for the candidates.
We only need twelve percent of the electorate. Yung OFWs, well, they can register as absentee voters. Since there are hundreds of thousands overseas, that would help to achieve the 12 percent.
This is the only way to constitutionally oust her.
What is the alternative? Coups? People Power? Wait for two years, while they hatch their own amendment to stay in power?
Atty,
Nabasa ko ang post mo and I liked it, ang galing sana. But, supposing we already “cha-chaed” the unano. How can we be asured that hindi tayo mawawantutre knowing that she has no Constitution at all?
Cory’s civil society, the “blink and wait” group?!
Atty,
Alternative? Realistically or strategically speaking, the only alternatives to my mind is a successful coup d’état is the only way to oust Gloria and to make sure she doesn’t come back.
However, a coup d’état is no guarantee at all, but not at all, that Pinas and its citizens will end up the winners in a coup d’état exercise.
People power? I don’t believe poeple power in the Philippines is a viable solution any longer. The country’s elites and civil society have subverted people power. The exercise will leave a lot of legal questions unanswered, eg., Gloria and her husband forever to my mind subverted the operation and they can do it again with bayong and bayongs of money.
The other viable alternative would be to hold a referendum — if that is at all provided in the Constitution — to ask the citizenry whether they’d approve of a snap election. A referendum containing a yes or no answer would be the best.
But again, is that Constitutiona and if so, will Gloria submit herself to a national referendum?
A national referendum to me is the best democratic exercise when a country is politically divided.
The other viable alternative would be to hold a referendum — if that is at all provided in the Constitution — to ask the citizenry whether they’d approve of a snap election. A referendum containing a yes or no answer would be the best.
****************
That is exactly what I am proposing. The referendum will ask if the people approve of the above amendment or not.
Will Gloria submit to one? She can be forced to one, by way of people’s initiative if people can gather signatures of 12 percent of the electorate.
That is what happened in the failed cha-cha in her favor, but the Supreme Court (Carpio writing) said the signatures were bogus.
Ellen,
On Esperon’s declaration on why they reneged on the agreement concerning terms of surrender at Oakwood. Here’s my humble opinion:
Reneging on the agreement made to end the Oakwood mutiny will have repercussions for the future.
The agreement on surrender terms may now seem favourable for the majority of the mutineers, but at the time they were the best the government could achieve. I find it a bit weak of a government and the military to believe this was duress; there was no need to accept these terms, they could have been harsher (although that might have taken more courage).
I think that breaking such an agreement indicates a grave lack of faith in ones own word.
The Philippines has a history of this sort of incident and normally they are resolved without too much problem. The next time resolution will be considerably harder. The rebels will remember that the government cannot be trusted to keep their word and will be harder to appease.
Breaking the agreement to end the Oakwood mutiny may give solace today to a few who feel they were not harsh enough, but it resurrects the idea of mutiny in the minds of the angry young officers, it brings ideas of injustice to the forefront of young minds, these two will forment the idea of another mutiny and this time there is much more likely to be bloodshed. The next generation of mutineers will have no trust in the word of the government, no respect for the negotiators and will be more prepared to commit acts of violence.
It is never good to go back on ones word. That way lies anarchy.
compañero,
di pwedeng i-shorten by amendment ang term ni gloria (although di rin pwedeng dagdagan kahit in the form of a transitory provision)
pwedeng by amendment i-shorten ang term ng presidente from 6 to 4, and eligible for re-election to another 4-year term, pero that will be applicable lang to the next elected president. entitled na si gloria sa 6 yrs, till 2010
Cite me the provision that prohibits the shortening.
The people can propose any amendment, even a revision, as they intended to do in the failed cha-cha.
If there is such a provision, then fine, amend that too.
ASII, Gloria Arroyo is not eligible for any term because she was never elected to the presidency. As Susan Roces said, “you stole the presidency not once but twice.”
According to Article 7, Section 10 of the Constitution, a snap election (or “special election”) can only be held if there is a vacancy in the Office of the President and Vice-President.
So, Gloria and Noli must both step down in order to have snap elections, since a vacancy can only be effected by death, disability or resignation.
Frankly, I am gobsmacked that General Esperon, chief of staff of the nation’s armed forces could so whimsically declare that the government was “under duress” at the time of the agreement and therefore was right to renege on the terms of surrender.
I am absolutely appalled that Gloria Macapagal’s favourite bodyguard turned 4-star general should even consider reneging on the terms of agreement with his fellow military officers is the right thing to do!
What has become of military honour?
Anna, that simply shows the kind of officer Esperon is. No word of honor.
But then what do your expect from someone who serves a president who also has no word of honor?
So, Gloria and Noli must both step down in order to have snap elections, since a vacancy can only be effected by death, disability or resignation.
**********************
The people can declare a vacancy by shortening their term. The people can propose anything, even a revision. The lesser is always subsumed in the greater. If the people can amend or revise wholesale, then they certainly can amend a little, by declaring an end to the term.
Apostol, sinungaling ka!
“The people can declare a vacancy by shortening their term. The people can propose anything, even a revision. The lesser is always subsumed in the greater. If the people can amend or revise wholesale, then they certainly can amend a little, by declaring an end to the term.”
———————————————————-
Salamat sa paglilinaw, Atty.
Ang legislation, nakatali ka sa Constitution. You cannot legislate anything contrary to the Constitution, on the philosophy that the representative (legislator) cannot contravene the master (the people).
But in proposing amendments, anything goes, because it is the sovereign people themselves acting.

They revealed their hand in the failed cha-cha. Ayaw nilang ma-lengthen ang term ni Glo. She got a stinging rebuke from Carpio (former ally).
Will they agree to a shortening? The people, via a referendum can force the Court.
Of course, before we get to a referendum, there will be all sorts of challenges, asking the Supreme Court to prohibit the COMELEC from conducting the referendum – the same challenge mounted by civil society against Raul Lambino.
How will the Supreme Court rule? Why don’t we find out.
This is a better alternative than that hare-brained idea of asking Glo and Noli to step down. That is like asking a man in bed with a beautiful woman to get off the bed; he will not
unless she wants to do it on the floor.
Tama na ang ngaw ngaw. Like Nike says, Just Do It.
Gabriela,
We may add that the term for that sort of behaviour, particularly in one who is supposed to espouse conduct becoming an officer and a gentleman: “A Double crosser!
Gloria and her govt inquisitors backed by her military top honchos are institutionalizing double cross!

Hi Ellen,

Subject: WHO’S THE BOSS?
All the organs of the body were having a meeting, trying to decide who was the one in charge.
—————–
“I should be in charge,” said the BRAIN, “Because I run all the body’s systems, so without me nothing would happen.”
—————–
“I should be in charge,” said the BLOOD , “because I circulate oxygen all over so without me you’d all waste away.”
—————–
“I should be in charge,” said the STOMACH , “because I process food and give all of you energy.”
—————–
“I should be in charge,” said the LEGS , “because I carry the body wherever it needs to go.”
—————–
“I should be in charge,” said the EYES, “Because I allow the body to see where it goes.”
—————–
“I should be in charge,” said the RECTUM , “Because I’m responsible for waste removal.”
—————–
All the other body parts laughed at the RECTUM and insulted her, so in a huff, she shut down tight. Within a few days, the BRAIN had a terrible headache, the STOMACH was bloated, the LEGS got wobbly, the EYES got watery, and the BLOOD was toxic. They all decided that the RECTUM should be the boss.
—————–
The Moral of the story?
—————–
The “ASS HOLE” is usually in charge!
Ellen,
On “Mr. Wetness” (Sergio Apostol).
HG,
Dapat diyan kay apostol, i-hogtie pagkatapos, ipakain sa crocodiles sa Palawan (I know someone there with a crocodile farm…)
This Apostol is like an inveterate idiot of a cockfighting aficionado who attends a cockfight derby with a duck!
This Apostol like the ideal patient in a home for the aged…
Apostol is so like a Swiss watch — he opens his mouth on the dot, never making a miss. If he were in a home for the aged, he’d be an ideal patient: at 7h00, he goes for a pee, at 7h30, he goes for a crap but the problem is he only wakes up every day at 8h00… That’s Apostol.
Story about Apostol when he was still a young man and an wanted to learn to parachute or to skydive. Apostol’s jumpmaster liked to recount how stupid Apostol has always been.
He said, “He’s just desperately thick!”
The jump mater continued with his story. “During his first jump, we repeated and repeated what he ought to do once on the plane. I told him, you jump out of the plane, you count up to three, then you pull the ripcord from and the parachute opens. Sure, he jumped out of the plane but his parachute didn’t open! He crashed on the ground with a loud splash!!!
“The ambulance arrived … a nurse bent to take his pulse and you know what she heard? Apostol’s lil voice whimpering and counting THREE!”
No kidding! I was there, and those words are the first you will hear when you visit the Crocodile Farm near Puerto Princesa.
The (croc farm) manager goes on to say, “It’s grossly UNFAIR to compare our crocs with those in Congress, because they do no harm to humans… they are kinder, gentler. Unlike those crocs (in Congress) masquerading as humans, they will suck your blood dry.”
You can say all you want about Apostol, Esperon, Enrile and all of GMA’s bugaw. You should know by now that that has no effect on these people. They have comfortable lives. They continue to feed on the unfortunate victims of their greed and corruption.
When will these people pay for their sins? Probably never. Iskrima na lang tayo ng laway. And maski na diyan talo pa rin tayo.
You all know that there is only one way to change the current state of affairs. Why is it that there have been no serious attempt made? All this hilaw mute-enis is just that – kulang sa puwersa, hinde buo ang loob, lagi na lang bayot.
Bombanhan na kung bombahan. Tama na yang I am loyal to whatever.
Isagani: “…there is only one way to change….Bombahan na kung bombahan. Tama na yang I am loyal to whatever. Change na kung change na. Ngayon na!”
Paano natin gagawin?
hawaiianguy, itsahan mo ng granada!
Hi Hawaiianguy/AdeBrux,

Isagani;
Majority of Filipinos believe the nation is on the wrong track, they believe politicians are dishonest, and yet the vast majority that think of themselves as centrists, libertarians, moderates or independents, rather than liberals, pros and anti-Gloria.The great paradox is that so many economically literate Filipinos still desperately place faith in politicians. It’s as if through magic or divine intervention some super-honest, non-corruptible, brilliant and charming movie character like Trillanes can reform the system. And make us feel good again, restore quality to Philippine democracy, and fight economic inequality by rejecting and stomping on all the evil corporate and other special interests that have robbed the people of our country. Someone that will actually put the interests of working- and no-class citizen above those of rich and powerful elites. In reality it’s only a pipe dreams.
cont;
So what should Filipino dissidents put their faith in oppositions?
I have long sought the answer to that question to avoid existential depression and despair. And also to avoid doing what most daydreaming pinoy do to dull the pain. This is just fine with mainstream politicians. People living in abject poverty on squalor society are so much easier to govern than active dissidents. I have arrived putting my political doubt in. And doubt is exactly the right word, until opposition’s devotion and commitment is put into action. There is no way to prove that they will materialize or, if they did, that they would deliver all that is needed. Yet, to keep putting faith in glib, power-hungry politicians is plain nuts, based strictly on actual history.
Still, we must ask:Why has Congress not called an Article of Impeachment for a corrupt president? The answer is simple.
The Congress has acted surreptitiously, steadfastly and openly opposed an impeachment. They want to maintain the status quo that gives them ample opportunities to control government and of course! The pork barrel, they have successfully implanted fear into the public consciousness. They especially like to talk about the ghost projects funded by there pork barrel that able to overturn country’s economic progress, destroy our democracy, and rob us of our civil liberties and freedoms.
What a poor masses can do?Senate become a fraternity club of affluent and millionaires, Congress are infested with mostly corrupt elites, they are all illustrados from a prominent families from their district. Who can beat Magsaysay clan in Zambales, Gordon in Olongapo,Marcos from Ilocos Norte and Singson from Ilocos Sur.Although De Venecia faced a formidable battle in Pangasinan, he came out victorious. The partylist congressman has no voices at all, they are all saling pusa.
Whatever the outcome of any revolutions at the end the same people and the same color will resurrect again in power.
Ka Enchong,
Thank you for posting Art. 133 of UCMJ. However, your emphasis missed that part that fits snugly in the case of Esperon and his dogs, to wit:
Well, his boss is The Most Glorified Prostitute who lives in the whorehouse we call Malacañang.
Prostitute : n. a person who takes your money and screws you big time
Isagani,
If only words can kill…..
But I like Atty’s proposal, by way of people’s initiative.
“grabe nýo namang laitin yong matanda, pagbigyan na natin kasi naman nagbabayad utang lang si GMA.” Yeah, be kind to sinile fogeys.
Seriously, don’t you folks notice Gloria’s style of (mis)management? She not only surrounds herself with old fellas (Apostol, Ermita, the 2 Gonzalezes, etc.), but also with 22nd century KARATEKA guys.
Why karate? They know how to PARRY blows coming from critics all over the place, with their unbelieveable and rusting logic –
1) Bunye, with his out-of-tune reasoning that 1,200 cases are “too few” to become significant (siguro, hindi ito nakakuha o pumasa sa Math 100 – Intro to Stat)
2) Apostol, yup, what else! His theory of “that’s-just-a-perception” and doesn’t make a dent on Gloria’s sagging image as the “worst president ever”
3) Ermita and Remonde, on their long worn-out defense of: “I told you so, it’s another destabilization plot of the opposition”
4) Miriam, with her usual legalese that doesn’t stick (except to those with empty skulls): “let’s investigate who funded the survey”
cocoy, all that the people want is to kick out Gloria. All this social, political, economic, moral, etc., analysis is good in the classroom. In the real world what counts is action. The act of one man can change the destiny of many.
It seems that all these talks, complaints, crappy bs only shows that we are not ready for a change. No one is stepping up, saying, “I am tired of all this bullshit and I’m putting a stop to it!” For now, and I am not saying it won’t happen, it is all baka, sana, papaano.
GMA may get to finish her term on 2010, if not longer if she can cha chaching the opposition again. And if she and her cohorts get to finish on 2010, you can bet that she is going to be a celebrity, just like Imelda!
Only in the Pilipins!
isagani;
That is what I am hoping for,the oppositions will put their devotion and commitment to action. If they don’t get there act together Gloria will reach the finish line by 2010.A one man crusade could not awaken the sleeping masses. However,I am still confident that Erap will be true to his word that he will siphon the fuel of Gloria’s cho-cho train. He’ll position an sniper to assassinate the train engineer.
Hi Co2y,
I agree in your point of view!
Isagani, I can sense your frustration. Action, that’s what we really need now. But what kind of action? By another people power? Trillanes and company might have thought of that as a real possibility. But not many joined. I would,
if I were in the vicinity.
Aren’t we “cyber warriors” here?
As a blogger from afar, the only action I can think of is the power of the pen – hoping that words can energize or mobilize. Don’t underestimate a “classroom” technique, my friend. The 1898 Philippine Revolution wouldn’t come about, if Rizal and the other propagandists kept silent and acquiesced to the colonizers. Or, if there were no inspiring messages for freedom from our pasyon. Bonifacio would have kept his bolo forever, without shouting a voice, if he lacked the inspiration.
A real revolution is a mix of several things. One can’t wage it sucessfuly by the gun alone.
Isagani,
I’m not Ilokano? Kalahi ito ng mga magigiting nating Bayani.
klasmayt baka naman magtampo sa atin ang mga kababayan nating Ilokano (I love the very much), dapat walang personal na involve dito sapagka’t maykalayaan tayong mabigay ng ating komento o paliwanag sa anumang pinag-uusapan topic(s).
Sana naman eh iwasan nating magbanggit ng particular group of people, maging patas tayo at wag partisan.
Maraming salamat!
Good day Hawaiianguy,
Your point of view is a whispering sound in my ear, as you said that, “As a blogger from afar, the only action I can think of is the power of the pen – hoping that words can energize or mobilize. Don’t underestimate a “classroom” technique, my friend.”
Nice comment!
Atty36252,
Your proposal to limit charter change to the removal/term-shortening of Gloria and Noli is a good one, and well within the boundaries of law. With that, we will see who is really anti-Gloria or nag-aantay lang makatapos si Gloria. Many lip-servers who openly declare their opposition to the cheating liar are actually pro-Gloria who use the constitutionalist excuse to evade revealing their scales underneath faux skin.
But I have my misgivings. The cheating machinery is well entrenched in many towns and cities, especially in ARMM. The people there cannot muster enough courage to swim against the current, flowing generously from Gloria’s purse of stolen funds to her warlords’ pockets. I doubt if such towns, even provinces like Maguindanao, will produce the required 3% vote to get the Concon started. Noli de Castro is married to an Ampatuan. The Ampatuans control politics in that province and have won all elections although none were even held!
Then you also have Lanao del Norte, Lanao del Sur, Sultan Kudarat, Basilan (‘tho Akbar is resting in pieces) and many others whose town are inhabited by a single clan and will vote wholesale for the highest bidder.
Isagani,
Wala lang! Ganon ba. Good luck!
d0dong: sa kwento mo tama ka..the ass hole is in charge. Tingnan mo sa Phil.. sa ngayon..the ASS HOLES are in charge and in power…kaya look we have Sugar Honey Iced Tea in all the branches of the government…Executive, Legislative and Judiciary and the MILITARY…kalat ang mga ass holes…hindi ba?
Tongue:
Kailangan lang ng three percent per legislative district. Pirma lang ang kailangan, wala pang voting. This can be done quietly, para hindi dumating ang mga goons to scare the signatories.
Pagdating sa actual referendum, well, as long as you have Manila, Cebu, and the big population centers, panalo yan. Put Erap and Cory together, panalo yan.
Diyan papasok ang military brethren ni Trillanes to guard those collecting the signatures.
Mahirap, yes. But this is our only constitutional shot. And the people get the satisfaction of kicking her out, instead of waiting for Godot.
Atty36252,
Mukhang OK yan… but I will prefer parallel approach… yung “extra” and yang “normal”… para sigurado… “never put all your eggs in one basket ” sabi nga…
Atty36252 and PD, ok ung merong alternate plan.
Atty36252, yes we could have charter change, but wouldnt it still be the Comelec that will count the votes?
Same goes for a referendum. It will still be the Comelec that will administer and count the ballots.
klingon:
True, the Comelec will count the votes. They did so too, in 1986. But the people guarded the ballots.
Totoo, maraming balakid. But we have to do something.
As for piping dilat’s constitutional and extra, as parallel approaches, wasn’t it the anger of the people after the snap elections that gave the military the opening to do EDSA? So ito na, ang parallel approach.
Many in 1986, including myself, were leery about the snap elections. But when Cory threw her hat into the race, ayun, nag-snowball and as the worn-out expression says, the rest is history.
Financier ba Hawaiianguy? May uusbong diyan, once lumarga ang movement. I will bet my penurious bank account.
atty36252, me too. Call ako, I will put in my last penny. Isa na lang ang kelangan: ang kulektor.

Malacanang can’t even get their press releases right! Pathetic… Toting is out of his depth.
Ma’m Anna, matagal nang ganyan si bunyeta, since the “I have two discs…” blunder pa niya lahat na ng lumabas sa bunganga nyan if you would ask most the logical people of our country, they will tell you that his words don’t even have an iota of truth behind it. hehehe but what can we do, bunyeta’s motto became “hindi bale na akong sinungaling, kesa naman stupido na sinungaling pa”..nyahahaha 😛
when atty. apostol(es ni gloria) came out with that press release the other day, about the issue of Sen. Antonio Trillanes IV’s 100M pesos PDAF, insinuating that the honorable young senator was salivating to get the appropriated fund for his own agenda of “tapoling the guverment”, these Mayna Bird of Malakanyang unwillingly helped a lot of sick people, because the myth that laughter is the best medicine still holds water. I should know, because I was not feeling well that day, but after watcing it on TV patrol…bwahahahaha, behold I was cured. 😉
Mabuhay ka Trillanes! In the next 50 years, when gloria, his fatso husband and their hordes were all gone, their bodies were all but earthworms waste products, and history books of the Philippines were already re-written, your name LTSG. Antonio F. Trillanes IV, the young soldier who became a rebel against the oppressive regime of these generation, would be included and honored together with Rizal, Bonifacio, and the other Filipino martyrs, who in their search for justice for the common people have sacrificed their lives and wealth in fighting the powerful rulers that our nation had since the Spaniards came to our shores and planted their flags and crosses.
His Wetness Apostol compares Senator Trillanes to the piranhas and barracudas allies in the House of Representatives and the local government units.
Apostol should not smear their dirt to other people.
Atty, the reliance on a vigilant people may be difficult to muster. These last elections, only the exceptions stood out, Fr. Ed and Grace Padaca. Otherwise, the same dynasties and tired old faces were elected. What we need is inspiration that we can do 1986 again. I’m not saying that we should try people power (which, by the way the SC has already ruled as a legitimate means of removing a leader) again. But the bloggers here are right. Something new is necessary, but one that does not involve the corrupted institutions.

Atty36252,
Then we are not much different in situation as that in the 70’s and early 80’s , don’t you think?. But on the other hand, the Americans were there moving in the backdrop, then. Just don’t know, how much interest, they have in “expediting” change now as compared to that particular period mentioned…
Ang mga Kano ang ultimate fence-sitter. They will wait for definitive signs. Hindi ba sila (Reagan) ang nagsabing there was cheating on both sides? At that time, they still believed malakas pa si Macoy. When the tide changed, they changed sides.
Ngayon, wait and see yan, hanggang may clear winner.
Thats common with all politicians, tells you something and deny it afterwards.
Watch out guys, with Trillanes and and company rapidly becoming popular with the people and press, unscrupulous politicians who were silent before will try to join the bandwagon.

Here’s to our wives and girlfriends … may they never meet!
piping dilat,
I don’t know why, but wives seem to have this gift of insight. Two days ago, my wife said don’t drink, I didn’t listen and downed 10 bottles of San Mig Light, sure enough I got so sick the next day, I couldn’t drive to work. Last week she said “don’t eat that crispy pata!”, I didn’t listen, sure enough my blood pressure went up the next day she had to drive me to the doctor.
Now she’s saying “huwag kang mambababae, pag nahuli kita, nothing will ever bring back my trust, sira na relationship natin forever!” …So now I’m extra careful not to get caught!
BUDGET Secretary Rolando Andaya Jr. yesterday said the request for funding for Sen. Antonio Trillanes IV’s pork barrel projects amounting to P100 million was rejected because there was no allocation for it.
Andaya contradicted the claim of chief presidential legal counsel Sergio Antonio Apostol that the Palace did not approve the request due to suspicions that part of it would be used for destabilization.
“That’s his theory,” Andaya said, while refusing to comment on Apostol’s statement that Trillanes needs to get a court order for the funds to be released because his rights as a senator are suspended in view of his detention.
Trillanes said what he asked for was his pork barrel allocation in the 2007 budget. -Malaya

SYSTEMATIC ERADICATION OF THE WEAK (POOR)
I don’t know if GMA and the members of congress (vast majority) are aware of their actions. By blocking the CHEAP MEDICINES BILL, they have literally ordered the deaths of millions of people who cannot afford life saving medicines. By blocking genuine land reforms, they have sentenced to death millions of poor farmer families around the country. They may not be conscious of it, but they are following a Darwinian theory of evolution – “natural selection, only the strong and fittest survive.”
God help us if they are aware of what they are doing!

NLA cancels session as mob calls for end to ‘dictatorial’ legislation
The junta-appointed National Legislative Assembly (NLA) cancelled its afternoon sitting yesterday after several score of protesters stormed legislature grounds and squatted in front of the Parliament.
The breakaway mob from a group of about a thousand demonstrators chanted demands for the NLA to stop passing dictatorial laws detrimental to society and to resign.
They insisted the NLA must cease its legislative function now because the general election will take place in less than two weeks and a new parliament will soon be formed.

ASIII,
That’s alright , you don’t have to bother atty36252… mahal ang per hour nya and we are not that helpless anyway with your Latin legal terms… why do you have to hide behind this “proof of the case is self-evident” ? run out of words… man! oh thank you. sorry lang if i can’t say the same of you
piping dilat,
saka its not a matter of just using latin maxims/phrases. its the sense of the arguments commented to thats missing. kaya ang pakiusap ko – leave the legal arguments to the lawyers
ASIII,
Yes. Thats what I do, I have retainers to handle legal arguments for me, I call this firm in Pacific Tower. But lately, I find it more expedient (and less expensive) if I just sit down with the person/s concerned, hear their side, explain my company’s side, and eventually look for a middle ground somewhere and strike a deal. That way I avoid burning bridges, the way things usually result to when you call in the lawyers. But when it comes to issues with a government office asking for money (or more money), I let the lawyers handle it…
applying the principle that vested rights cannot be impaired. the present constitution grants the person elected in 2004 a 6 year term, until 2010. the 6-year term is vested under the present constitution (of course subject to impeachment and other provisions on removal). amending the constitution by reducing the term will violate that vested right.

Public office is a public trust. (section 1, Art XI). It is not a right. It cannot be vested. Trust may be lost or revoked by the sovereign will of the people.
If the people may shorten by impeachment, through the act of representatives, then with more reason may they do it directly, through an amendment.

I agree, if the “vested right” argument is valid, what do we make of the vested right of Marcos during the “people power revolution”? “Sovereignty resides in the people and all government authority emanates from them.”(Article II, Section 1)
“Sovereignty itself is, of course, not subject to law, for it is the author and source of law…while sovereign powers are delegated to…the government, sovereignty itself remains with the people”-Yik Wo vs. Hopkins, 118 U.S. 356
juggy,
thats how it should be done, letting the lawyers do the unpleasant tasks.
compañero,
at least now, this early, you’ll know the main argument when any proposed amendment to shorten term limits is challenged before the Supreme Court
saka the ‘sovereign will’ of the people can be expressed not just through amendments. EDSA 1 and 2 are expressions of the ‘sovereign will’
ang pinag-uusapan natin, the ‘sovereign will’ expressed through amendment.
pero believe pa rin ako talaga sa fighting ng mga kababayan nating still romanticized by people power/EDSA. humihirit pa rin! ang problema lang, every attempt to stage another people power/EDSA the country suffers collateral damage.
ace,
Marcos was not booted out by an amendment. Yes, he was kicked out by the ‘sovereign will’ of the people.
As i wrote in the preceding post, amendment is not just the only way the ‘sovereign will’ may be expressed.
ang pinag-uusapan natin ay shortening the term limit by amendment
Tama ka, i have no problems with the law and case law you quoted.
Kung gusto talaga ng tao i-kick out si gloria a la EDSA 1, e pwede din nilang gawin yon. eh ilang beses nang may nag-aatempt, eh nasan ang mga tao?! marami pa ring humihirit!
since demokrasya tayo, sige, freedom of expression daw yun. kaya sige, subok pa rin. let the country suffer severe collateral damages. mas matimbang pa kasi ang expression of the ‘sovereign will’
Juggernaut,
Please see “Toadies crawling oout of the woodwork” post. I’m interested to know your comments.
compañero,
at least now, this early, you’ll know the main argument when any proposed amendment to shorten term limits is challenged before the Supreme Court

You are privy to what will be the main argument?
It’s good to know we are talking to one with the inside track.
Trillanes must live — many Filipinos like the commenter above doesn’t deserve the martyrdom of brave men.

compañero,
“You are privy to what will be the main argument?
It’s good to know we are talking to one with the inside track.”
wow, i can’t believe you’ve descended into that kind of reasoning. a fellow UP Law graduate at that! is that how desperate you are in removing gloria? do you resort to such a line of reasoning if you run out of arguments? what are you insinuating? that im a paid gloria hack whose influence extends up to the judiciary, to whoever would be trying a probable court case on an amendment that shortens the term limits?
let me re-post that:
at least now, this early, you’ll know the main argument when any proposed amendment to shorten term limits is challenged before the Supreme Court
take note i didn’t say “you’ll know the main reason when the Supreme Court strikes down such an amendment”
what i said is plain and clear – that will be the main argument in any Supreme Court petition challenging the proposed amendment that shortens term limits.
all these times ive been trying to keep discussions on a purely legal level, starting with the earlier thread on the mural issue. hope you reciprocate.
i can understand if the non-lawyers here post that way. but not from you.
Cool ka lang.
I never insinuated that you are a paid hack. Your words not mine.
I can come up with other arguments against my position. But when you state that THAT will be the argument, it means you know the people who will make the argument.
That does not mean you are one of them.
I know the possible arguments against impeachment because I speak to people who are against it. I also know the arguments for it, because I am for it, and researched it.
But if somebody says she knows THE main argument against impeachment, then I will presume he/she has spoken to Devanadera, or some DOJ judge (yes goddammit, they call each other judge, dahil ka-level daw, even if they do not exercise jducial functions).
So if you know THE main argument, then I presume you occasionally have coffee with some of the main players.
Masyado kang hot, just like your idol Arno Sanidad. Mas cool yung kuya, Pablito of Baguio City; magaling, maginoong kalaban, ang frankly, more impressive than Arno.
compañero,
“Cool ka lang.”
okay sabi mo eh
“I never insinuated that you are a paid hack. Your words not mine.”
okay, presumption of regularity of functions of a fellow bar member
“I can come up with other arguments against my position. But when you state that THAT will be the argument, it means you know the people who will make the argument.”
noted. okay, ill force myself to believe that you hold the view that only the government can challenge such an initiative.
“I know the possible arguments against impeachment because I speak to people who are against it. I also know the arguments for it, because I am for it, and researched it”
noted.

didn’t you just say that you were not insinuating anything?
“So if you know THE main argument, then I presume you occasionally have coffee with some of the main players”
didn’t you just say that you were not insinuating anything?
the COMELEC of Abalos, binawasan ang kapalmuks, denied the SIGAW petition. for sure, today, para masabing di tuta ang COMELEC, it will approve the referendum of your proposed initiative – in which case, a private citizen can challenge the proposed amendment sa Supreme Court, with the OSG defending the COMELEC approval! thats where the ‘main argument’ will come in! kakampi nyo pa si Devanadera or whoever is SolGen at that time!
“Masyado kang hot, just like your idol Arno Sanidad. Mas cool yung kuya, Pablito of Baguio City; magaling, maginoong kalaban, ang frankly, more impressive than Arno.
noted.
eh sino ba naman ang hindi magiging hot sa kind of post mo? prior to that, purely legal ang arguments natin. tapos magpo-post ka nang ganun? frustrating
saka sino kaya ang mas hot? ano kaya yung tawag mo sa nag-assume kaagad na i spoke with some of the ‘main players’?
I did not insinuate that you are a paid hack.
But being acquainted with the DOJ lawyers is something else.
I faced a friend in a land squabble in Cagayan de Oro. We had beers at the Trellis before we flew to the south to litigate. And yes I had the inside track to his arguments.
An officemate was engaged to a Makati lawyer; another to a SolGen lawyer, we knew each other’s arguments before pleadings were filed. Nag-aargue pa kami sa Trellis before we faced each other in Court.
People know each other in the profession, and they get deployed to various offices. Ganyan din si juggernaut, he knows men in uniform from both camps.
Nothing wrong there; legal arguments lang naman, there was no sharing of client info. Sharing of beer, yes; lots of it.
for sure, today, para masabing di tuta ang COMELEC, it will approve the referendum of your proposed initiative – in which case, a private citizen can challenge the proposed amendment sa Supreme Court, with the OSG defending the COMELEC approval! thats where the ‘main argument’ will come in! kakampi nyo pa si Devanadera or whoever is SolGen at that time!

Good observation. I will keep this in mind when people ask about the chances of the proposed amendment.
